For the guarantee of DEVELOPER's performance of all requirements hereunder set forth, DEVELOPER has caused the BANK to issue its Irrevocable Letter of Credit in favor of the MUNICIPALITY, the original of which is attached to the MUNICIPALITY's copy of this Agreement, and a copy of which is attached to the DEVELOPER's copy of this Agreement. During the term of this Agreement, DEVELOPER shall cause the attached Letter of Credit to be renewed at least thirty (30) days before the maturity date thereof. Failure of DEVELOPER to deliver evidence of such renewal to MUNICIPALITY thirty (30) days prior to the date of expiration of said Letter of Credit shall Constitute a default of the terms of this Agreement. Said Irrevocable Letter of Credit provides that the draftee drawn under maid credit, must be accompanied by a written statement signed by a duly authorized agent of the MUNICIPALITY, that in the judgement of the MUNICIPALITY, the DEVELOPER is in default under the terms of this Agreement, and that the funds to be drawn by the draft are in payment for, or in anticipation of payment for materials, labor and services required for completion of the Improvements .identified in Paragraph 1. Payment of each draft will be made at sight when presented to the HANK by the METNICIPALTTY, the payment limited only by the aggregate amounts presented in relationship to the maximum amount of the Letter of Credit. If DEVELOPER shall be in default of the Agreement for seven (7) days because of its failure to provide evidence of renewal of the better Of Credit, required in paragraph 4 above, the MUNICIPALITY Shall notify DEVELOPER by certified mail of said default. The MUNICIPALITY shall not file with the BANK a Statement of Default until ten (10) days after notice has been sent to the DEVELOPER, by certified mall, setting forth its intention to do so. 9. All funds drawn on the BANK by the MUNICIPALITY pursuant to the Letter of Credit shall be used solely by the MUNICIPALITY for the purpose of completing construction of the improvements identified in Paragraph 1. Any work contracted for by the MUNICIPALITY pursuant hereto shall be let on a contractual basis, or on a time and material basis, or shall be performed by the Mi)NICIPALITY's own work force and equipment, or shall be accomplished in such other manner as in the judgement of the MUN'ICXPALITY shall accomplish the work more expeditiously and economically. 10. If payments are drawn on the BANK by the MUNICIPALITY pursuant to said Letter of Credit, and it shall later develop that a portion of the monies drawn are in excess of the MUNICIPALITY'S needs, any such excess Amount shall be refunded by the M[NICIPALITY to the BANK, to be credited by said BANK to the DEVELOPER. 11, This Agreement and said Letter of Credit shall terminate and shall be of no force and of fact upon completion of the one year warranty period as described in the above Paragraph 3. If the MUNICIPALITY has not delivered any written notice to the DEVELOPER of any defective or improper work or materials in the construction of the improvements within the twelve (12) month period, or if notice has been given and the defective work or materials have been corrected by the DEVELOPER, the MUNICIPALITY shall forthwith notify the BANK in writing that the Letter of Credit may be canceled, and shall return the original Letter of Credit to the BANK, and both the DEVELOPER and the BANK shall be released from all obl..igatione hereunder and under said Letter of Credit. 12, The BANK may not modify the Letter of Credit without first receiving written consent of the MUNICIPALITY. 13. I have determined that the building and utilities have been substantially completed and the site is generally in compliance with the conditions of Conditional Use Determination #2006-354 and the subsequent amendment. The disturbed areas of the buffer zone have been seeded and erosion control measures have been implemented to my satisfaction. Until grass is well established in the spring, the site should be checked after large storm/melt events to ensure that slopes are still stable and sediment discharges are not occurring. As you know, the items remaining to be completed in the spring include removal of temporary erosion control measures and planting of the hedgerow memorialization as shown on the Grading and Utility Plan dated March 11, 2008 and revised May 7, 2008. In accordance with condition 1.D of the Conditional Use Determination, the CUD needs to be recorded in the Town of South Burlington land records and the CUD must be referenced in any deed for the property. The project is approved for a maximum of 630 gallons of wastewater per day. No changes to the wastewater disposal system shall be allowed without prior review and approval by the Wastewater Management Division. If the municipal approval expires, and the municipality files a written request with the Secretary, the Secretary will remove the sewage allocation for this project from the list of committed reserve capacity. If the municipal approval expires, this permit shall be invalid unless the municipality renews its approval and does not request that the Secretary remove the sewage allocation for this project from the list of committed reserve. Once the project is removed from the list of committed reserve capacity, a new permit must be issued for the project. An updated application form and an application fee will be required. Mr. Connolly said an addition to a living unit is an "encroachment." Mr. Lebrun said that the Vermont Statute of Frauds requires any authority to transfer authority regarding ownership in writing. That was not done in this case. He said you can't transfer property just by voting on it. Ms. Tate noted that the members voted to have the owners "maintain" the decks, even though they are common property. Members felt they wanted to consult with the City Attorney and agreed to close the hearing. Ms. Quimby moved to close the hearing. Mr. Birmingham seconded. Motion passed unanimously. 07 Site Plan Application #SP-08-25 of Gardner & Sons Development Corp. to construct a three -unit multi -family dwelling, 18 Southview Drive: Mr. Courcelle said they have spoken with the Arborist and will work with him on the hedge. They will also add snow storage areas on each side of the driveway. Bicycle storage will be wall -mounted in the garages. They will submit cut sheets for lighting. Mr. Dinklage said the essential thing the Board has to consider are encroachments into the wetland buffer. The State has said there is no harm to the function of the wetland. However, the waiver allows for denser development than otherwise possible. Mr. Dinklage said he felt the massing of the building is out of context with the neighborhood and he would like to see it reduced. Mr. Belair noted receipt of a letter from Douglas Marek, a neighbor, who expressed his intent to appeal any approval of the project. Ms. Ambusk asked whether people would be allowed to walk in the wetland buffer area. Mr. Dinklage said they can walk there but not "disturb" the area. He stressed that it is not a "backyard." Mr. Belair added that it can't be mowed and can be brushogged only 3 times a year. It also can't be used recreationally. There will be a stipulation added to that effect. Ms. Quimby moved to approve Site Plan Application #SP-08-25 of Gardner & Sons Development Corp. subject to the stipulations in the draft motion as noted above. Mr. Farley seconded. I have reviewed the proposed 3 Unit Multi Family dwelling to be located on a lot referenced as 18 Southview Drive and formally request the right to appeal the project. I have discussed my position related to my appeal with several neighbors and I believe they all share some of the same concerns. At this time I will allow this letter serve as my formal appeal as I will not be able to attend the DRB meeting scheduled for May 6, 2008. Ironically I have ACL and meniscus surgeries scheduled for that same day, and have attached the letter indicating the surgery date, time and location. I respectfully request the appropriate time to discuss all my issues with this project with the Agency of Natural Resources, my legal council, the City of South Burlington, and my neighbors as needed. Due to the time I will be in recuperation I would like to suggest a rescheduled hearing 30 days from May 6, 2008. The following items are some of the issues I have related to the proposed project: 1. I feel the City has not considered the negative impact this 3 Unit Multi Family project will have on all the abutting property values. 2. Regardless of the zoning regulations this proposed project does not fit in with the building aesthetics, and nature of our community. 3. The developer has been granted a CUD from ANR, but this was based on a different set of plans and a 2 Unit Project. I believe regardless of what ANR says we would then have a right to appeal this decision. 4. In relation to all of the City comments and assuming the project does get approval I request all drawing changes and or modifications be made and reviewed prior to said approval. In closing I would like to reiterate that these are only some of my concerns and would like the time to formalize all of them. Zoning District & Dimensional Requirements The proposed building and lot sizes meet the dimensional standards set forth in the South Burlington Land Development Regulations for the district. The appropriate building setbacks are met. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. Access to the triplex is proposed via two curb cuts on Southview Drive. Staff has no concerns with the proposed curbcuts. The three proposed units require 8 parking spaces. The site plan includes parking for 9 vehicles (three spaces in garages, six spaces in the proposed driveways). (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. Parking is proposed to be located to the front of the building. This is standard given the proposed type of residential use; staff recommends no changes. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The height of the building is proposed to be below 30 feet. This is below the maximum height of 40 feet for a peaked roof. No height waivers are requested or needed. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. 1. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. The South Burlington Water Department has reviewed the plans and provided comments in a letter dated April 16, 2008 (attached). (f) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the South Burlington Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not find any need for additional access to abutting properties. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). No dumpsters are proposed. (d) Landscaping and Screening Requirements Based on submitted building costs of $414,000, the minimum landscaping budget should be $10,780. The applicant is proposing $11,655 in new landscaping. The City Arborist has reviewed the plans and issued comments as follows: ■ There are three street trees which are currently planted in the area where the applicant is proposing to locate the new driveways. These trees shall be properly excavated and moved to a new location chosen by the City Arborist, and under supervision of the City Arborist. ■ It is unclear which type of hedge the applicant is proposing to delineate the wetland area. The plans do not include any landscaping around the utility cabinets. This should be revised and the utility cabinets should be screened to the satisfaction of the staff. 5. The plans shall be revised to show landscaping around the utility cabinets to the satisfaction of Staff. Pursuant to Section 13.06(B) of the Land Development Regulations, the plans shall depict snow storage areas that will minimize the potential for run-off. No snow storage areas are shown on the plans. 6. The plans shall be revised to show snow storage areas 7. The plans shall be revised to show a bicycle storage rack. Lighting Pursuant to Section 13.07(A) of the Land Development Regulations, all exterior lighting shall be shielded and downcasting to prevent light from spilling onto adjacent properties and rights -of - way. The applicant has not submitted any lighting details. Lighting cut sheets should be submitted and the proposed lighting shall meet the standards set forth in the SBLDR. 8. The applicant shall submit lighting cut sheets in conformance with the SBLDRs Wetlands The applicant is proposing permanent and temporary (construction) encroachments into a Class II wetland buffer on the property. There will be approximately 1131 sf of permanent Class II wetland buffer encroachment, as well as 828 sf of temporary encroachment for a sanitary sewer line. The applicant is also proposing 603 sf of temporary Potash Brook buffer encroachment. The applicant has obtained a Conditional Use Determination from the State of Vermont for the wetland buffer encroachments (attached). Upon reading the report from Julie Foley, District Wetlands Ecologist, Staff concurs that the encroachment will not result in any undue, adverse effects to the protected functions of the wetland. However, staff also recommends additional measures to protect the remaining buffer and the wetland. Specifically, there shall be no use of pesticides or other chemicals within the wetland buffer. The applicant has proposed a hedgerow to delineate the buffer. This is sufficient. The wetland buffer shall not be used recreationally; to help ensure that this is the case, the wetland buffer shall not be mowed and may only be brush -hogged a maximum of three times per year. Variations from the CWD Specifications will not be permitted except as provided within the CWD Specifications. The appropriate CWD Supervisor as defined in the CWD Specifications shall determine the acceptability of any deviation from the those specifications. Private water lines and appurtenances shall be designed to the same standards as public water lines and appurtenances. All water installation work and water distribution material must comply with the "CWD Specifications". Details for this project must be the same as those within the above referenced CWD Specifications. 2. All domestic services and fire sprinkler systems that are connected to the public water system shall be protected with a backflow prevention assembly, and an appropriate thermal expansion system in compliance with the Ordinance For The Control Of Cross Connections Within The Water System Of the City Of South Burlington, henceforth the `Backflow Ordinance." Please contact this department for more information on the installation and proper setting of backflow prevention devices. 3. The proposed water service line must be modified so that each unit has an independent %" service line and curb stop. A manifold can be installed at the end of the 1.5" service line, after a "main" curb stop, that will branch off to supply three 1/4" service lines with independent curb stops; one to each unit. Each independent service line shall consist of a curb stop, copper tubing, and curb box with stainless steel service rod placed on a solid concrete block. Curb stops shall be Cambridge Brass No -Lead brass, Red Hed Manufacturing SB 5151/B4151, or Department approved equal. No -lead brass fittings shall be Cambridge Brass No - Lead Brass, Red Fled Manufacturing brass, or Department approved equal. No comments were received during the public comment period. Findings of Fact After careful examination of this application, the Agency finds: 1. A complete application was received from Jeffrey Severson of Oakledge Environmental Services, representative of Brad Gardner, for Conditional Use Determination 2006-354 on July 30, 2007. 2. The wetland and adjacent 50-foot buffer zone are located on the south side of Southview Drive in South Burlington. 3. Julie Foley and .Amy Norris, District Wetlands Ecologists, conducted a site visit to the subject property with Jeffrey Severson on October 12, 2006. 4. The subject wetland is identified on the Vermont Significant Wetlands Inventory snaps and is therefore designated as a Class Two wetland in the Vennont Wetland Rules. The subject wetland is an approximately 10-acre wetland associated with Potash Brook on the south side of Southview Drive and both sides of Route 116. Potash Brook flows west through the wetland complex towards an existing culvert under Route 116. The riparian wetland is beaver - influenced with both emergent and scrub shrub vegetation. The dominant wetland vegetation consists of sedges, reed canary grass, cattails and willows. The adjacent buffer zone is a wooded slope with a mixed overstoly dominated by eastern hemlock. The land use adjacent to the subject wetland is primarily residential homes and condominiums. The wetland soils are identified as Limerick silt loam and the buffer zone soils are identified as Hinesburg fine sandy loam in the Soil Survey for Chittenden County. 2 of 5 " Gardner CUD #2006-354 6. No work will occur in the wetland. This proposal involves the construction of a two -unit condominium in the buffer zone. The building will be 60 feet by 88 feet in size with an approximately 10-foot construction disturbance area and lawn around the south, east, and west sides. Permanent buffer zone impacts from the house and lawn total 1,176 square feet. The installation of a sanitary sewer line will temporarily impact 840 square feet of buffer zone. The project will impact 2,016 square feet of buffer zone. 7. The applicant has submitted a complete application including a site plan for the building, lawn and sewer line: "Gardner & Sons Development Corp., Southview Drive — Site Plan," prepared by Champlain Consulting Engineers, dated June 4, 2007 and revised July 23, 2007. 8. The protected functions of the wetland in question include at least the following: water storage for flood water and storm runoff (§5.1), surface and groundwater protection (§5.2), and erosion control through binding and stabilizing the soil (§5.10). 9. The following functions are either not present or are present at such a minimal level as to not be protected functions: fisheries habitat (§5.3), wildlife and migratory bird habitat (§5.4), hydrophytic vegetation habitat (§5.5), threatened and endangered species habitat (§5.6), education and research in natural science (§5.7), recreational value and economic benefits (§5.8), and open space and aesthetics (§5.9). 10. The wetland is significant for the water storage for flood water and storm runoff function because it reduces the scouring and erosion of stream banks by attenuating flood peaks and by reducing water velocities; maintains the stability of important habitat for aquatic life by attenuating peak flows of flood water and stormwater runoff, and reduces the scouring and erosion of stream banks. Additionally, Potash Brook flows through the wetland and has been listed as impaired by the VT DEC Water Quality Division, thereby increasing the significance of this function. Characteristics of the wetland which contribute to providing this function are physical space for floodwater expansion and dense, persistent, emergent vegetation that slows down flood waters during peak flows and facilitates water removal by evaporation and transpiration; a stream is present with a sinuous course and there is sufficient woody vegetation to intercept surface flows in the portion of the wetland that floods. The wetland will not be impacted by the proposed project and the buffer zone will remain largely intact. Based on the factors described above, the proposed project will not result in an undue adverse impact to this function. 11. The wetland is significant for the surface and ground water protection function because the wetland reduces levels of contaminants in surface water which recharge underlying groundwater; protects water quality by the removal of nutrients (as demonstrated by a constricted outlet; no dead forest or shrub areas; and lower water velocity through dense, erect, vegetation); protects water quality by the retention of sediments and by moderating the adverse water quality effects of stormwater runoff. The wetland will not be impacted by the proposed construction. Based on the factors described above, the proposed project will not result in an undue adverse impact to this function. 12. The wetland is significant for the erosion control function because there are erosive forces present and the following are present: a shrub and emergent wetland adjacent to a stream; dense stands of erect vegetation greater than 20 feet wide; good interspersion of persistent emergent vegetation and water along course of stream flow. The wetland vegetation that provides this function will not be impacted by the project. Based on the factors described above, the proposed project will not result in an undue adverse impact to this function. 13. The project has been designed to avoid wetland impacts. The building footprint was decreased from the original proposal submitted to this office to reduce buffer zone impacts. The building setback from the road is the minimum allowed by local zoning. The sanitary sewer line will be 3 or 5 Gardner CUD #2006-354 installed, bacicfilled and stabilized in one continuous operation. Two lines of continuous silt fence will be installed. One will be wire reinforced and installed at the toe of slope. Erosion control matting will be utilized on slopes of 3:1 or greater. A split rail fence, tree line or boulder line will be installed along the limits of disturbance at or within the buffer zone, and as depicted on the site plans, to prevent future encroachment. 14. If the project is constructed according to the specifications of the application and accompanying site plans, and the conditions of this Conditional Use Determination, the resulting buffer zone alteration is not expected to result in any violations of the Vermont Water Quality Standards. Conclusions of Law Based on information provided by the applicant and their representatives in the application for Conditional Use Detenmination, the Agency of Natural Resources concludes: Under Section 8 of the Vermont Wetland Rules, effective February 23, 1990, the Secretary may authorize conditional uses in a significant wetland or in its adjacent buffer zone. The Rules state that each Class Two wetland is presumed to serve all of the wetland functions identified in the Rules (Section 4.2b). Protected functions are distinguished from other wetland functions in Section 2.20, as those functions that make a wetland so significant they merit protection under these rules. Under Section 8.5a, the Secretary may only authorize a conditional use when it is determined that the proposed conditional use will have no undue adverse effect on the protected functions, unless the Secretary detennines such impacts are sufficiently mitigated. The proposed conditional use cannot practicably be located on an upland portion of the site or on another site owned, controlled or available to satisfy the basic project purpose. All practicable measures have been taken in this proposal to avoid adverse impacts on protected functions. The Agency determines that the proposed conditional use, described in the Findings of Fact and in the Conditional Use Determination application in question, will have no undue adverse impacts to the protected functions of the Class Two wetland and associated buffer zone on this subject property or the adjacent wetland complex. Decision The Vermont Agency of Natural Resources finds, that on the basis of the information provided in the application for Conditional Use Determination, there is reasonable assurance that the proposed conditional use will have no undue adverse effects on the protected functions of the significant wetland on this property provided the provisions of the application are supplemented with the . procedures described below. This Conditional Use Detennination is therefore approved with the following conditions: A. All activity shall be completed, operated and maintained as set forth in accordance with the proposal in Conditional Use Detern-imation Application #2006-354 and all submittals listed in Finding of Fact #7 above. No material or substantial changes shall be made in the project without the written approval of the Vermont Wetlands Office. B. The applicant shall notify the Vermont Wetlands Office in writing prior to the start of this project. C. A continuous line of orange snow fence shall be installed along the limit of disturbance prior to the start of construction. A continuous line of silt fence shall be properly installed by the applicant immediately upgradient of the snow fence prior to any construction and shall be regularly maintained. An additional reinforced silt fence will be installed at the toe of slope. 4of5 Gardner CUD #2006-354 Care should be taken to ensure that silt fences are installed on the contour and not in areas of concentrated flow such as stream channels or ditches. Sediment shall be cleaned out before and after any significant storm event or when they have reached less than half the height of the fence. Removed sediments shall be disposed of in a stable, upland area outside the 50- foot buffer zone at least 200 feet from waters of the State and stabilized immediately with seed and mulch at a minimum. All other disturbed soils shall be seeded and mulched within 48 hours of final grading. All sediment barriers and construction fencing shall be removed following the successful establishment of vegetation. D. The applicant shall have this Conditional Use Determination recorded in the land records of the City of South Burlington for all affected lands and the applicant shall have this Conditional Use Determination referenced in any deed for the property. The applicant shall supply the Vermont Wetlands Office with a copy of correspondence with the City of South Burlington certifying that the restrictions have been recorded within 30 days of the date of this determination. E. All proposed activities in the wetland and adjacent 50-foot buffer zone, carried out in compliance with Condition A, must be completed within three years of the date of the Conditional Use Determination or it will expire. An extension of time may be granted for cause. A request for an extension must be received by the Department at least 30 days prior to the end of the three-year period in order to prevent the expiration of this Conditional Use Determination. A request for extension will be considered a minor modification. F. The terms and conditions of this decision shall run with the land. G. The applicant shall monitor the portion of the wetland in question annually during early July for five years following construction for the nuisance plant species purple loosestrife (Lythrum salicaria) and common reed (Phragmites australis). All nuisance plants found . shall be pulled by hand and disposed of by burial or burning in a non -wetland location. Additionally, the contractor's equipment shall be cleaned so as to contain no observable soil or vegetation prior to work in wetlands and buffer zones to help prevent the spread of invasive species. 2. The Agency maintains continuing jurisdiction over this project and may at any time order remedial measures be taken if it appears likely that adverse impacts to the protected functions and values will occur. 3. This Conditional Use Determination does not relieve the applicant of the responsibility to comply with any other applicable federal, state, and local laws, regulations, and permits. 4. Mr. Belair noted that staff is recommending additional measures to protect the remaining buffer and the wetland. No pesticides would be allowed in the wetland and a hedgerow of trees or a split -rail fence would delineate the buffer. The buffer would not be mowed, only "brush -hogged" a maximum of 3 times a year. Mr. Carris questioned the future development of the reserved lot. Mr. Gardner explained that they would not be developing it. He would be reserving that lot for wetland -1- / DEVELOPMENT REVIEW BOLO 20 NOVEMBER 2007 mitigation for another property he might be developing. Ms. Ambusk said she's been hearing about the flood plain and asked if this area typically floods. Mr. Behr said it does not; the applicant just has to show the flood plain on the plan. A resident of the area questioned the 2-family home and felt it doesn't fit the character of the neighborhood. Mr. Belair explained that the Board is not reviewing that; it is only reviewing the encroachment into the wetland buffer. Single and 2-family homes don't have to be reviewed. Mr. Gardner said they went to a one -level unit instead of 2-level because they thought it was better. He added that these will be condo units with basements. 3. Continued site plan application #SP-07-78 of Gardner Construction to amend a previously approved plan consisting of two duplexes on a single lot. The amendment consists of revising the landscaping plan, Kaylyn's Way: The applicant provided pictures of what is existing. He noted that when they bought the land, the permit called for a different landscape plan which didn't enhance the site. They met with Craig Lambert on the site and did a walk-through of the proposed changes. Last August they planted. They have put plantings on the island easement, but the new owner asked that these be moved, which was done. Mr. Belair confirmed that all the work has been done and reviewed by the City Arborist. COMMENTS Associate Planner Cathyann La Rose and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the plans submitted on October 25, 2007 and have the following comments. Zoning District & Dimensional Requirements The proposed building and lot sizes meet the dimensional standards set forth in the South Burlington Land Development Regulations for the district. The appropriate building setbacks are met. SUBDIVISION CRITERIA Pursuant to Section 15.18 of the South Burlington Land Development Regulations, subdivisions shall comply with the following standards and conditions: Sufficient water supply and wastewater disposal capacity is available to meet the needs of the project. According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at an acceptable pressure. According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider or developer shall connect to the public sewer system or provide a community wastewater system approved by the City and the State in any subdivision where off -lot wastewater is proposed. 1. If necessary, the applicant shall obtain approvals for sufficient water and wastewater. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. As part of the proposed building protrudes into the Class II wetland buffer, the applicant is proposing silt fencing to surround the rear of the building. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. The proposed duplex will be sufficiently accessible from Southview Drive. The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. A portion of the proposed building encroaches into the 50 foot wetland buffer for a total impact of 1,176 sq. ft. There is also a temporary buffer encroachment of 840 sq. ft for the construction of the sanitary sewer. The applicant has obtained a Conditional Use Determination from the State of Vermont for the buffer encroachments (attached). Upon reading the report from Julie Foley, District Wetlands Ecologist, Staff concurs that the encroachment will not result in any undue, adverse effects to the protected functions of the wetland. However, staff also recommends additional measures to protect the remaining buffer and the wetland. Specifically, there shall be no use of pesticides or other chemicals within the wetland buffer. Staff also recommends a hedgerow of trees or split- rail fencing to delineate the buffer. The wetland buffer shall not be used recreationally. To help ensure that this is the case, the wetland buffer shall not be mowed and may only be brush -hogged a maximum of three times per year. 2. There shall be no use of pesticides or unnatural chemicals within the wetland or wetland buffer. 3. The plans shall be revised to include a visual barrier to the wetland buffer. This could include a line of trees or split -rail fencing. 4. The wetland buffer shall not be mowed more than one (1) time per calendar year. The proposed building exceeds the required 100 foot buffer from the Potash Brook. Pursuant to Article 12 of the SBLDR, all lands within the stream buffer shall be left in an undisturbed, naturally vegetated condition. 5. No trees or other vegetation shall be removed within the 100 foot buffer from the centerline of the Potash Brook. 6. Any areas within the stream area which are disturbed during construction shall be reseeded with a naturalize mix of grasses rather than standard lawn grass. The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. The proposed subdivision is compatible with the planned development patterns of the R4 Zoning District. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. This criterion is not applicable to the proposed project. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. The proposed subdivision does not warrant review by the South Burlington Fire Chief. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. This requirement is being met. Southview Drive, South Burlington File #: 2006-354 DEC ID #: EJ07-0217 The Vermont Agency of Natural Resources received application #2006-354 for a Conditional Use Determination. This application has been publicly posted through September 6, 2007 and notice sent to all parties as required by Section 8.3 of the Vermont Wetland Rules. No comments were received during the public comment period. Findings of Fact After careful examination of this application, the Agency finds: 1. A complete application was received from Jeffrey Severson of Oakledge Environmental Services, representative of Brad Gardner, for Conditional Use Determination 2006-354 on July 30, 2007. 2. The wetland and adjacent 50-foot buffer zone are located on the south side of Southview Drive in South Burlington. 3. Julie Foley and Amy Norris, District Wetlands Ecologists, conducted a site visit to the subject property with Jeffrey Severson on October 12, 2006. 4. The subject wetland is identified on the Vermont Significant Wetlands Inventory maps and is therefore designated as a Class Two wetland in the Vern-iont Wetland Rules. 5. The subject wetland is an approximately 10-acre wetland associated with Potash Brook on the south side of Southview Drive and both sides of Route 116. Potash Brook flows west through the wetland complex towards an existing culvert under Route 116. The riparian wetland is beaver - influenced with both emergent and scrub shrub vegetation. The dominant wetland vegetation consists of sedges, reed canary grass, cattails and willows. The adjacent buffer zone is a wooded slope with a mixed overstory dominated by eastern hemlock. The land use adjacent to the subject wetland is primarily residential homes and condominiums. The wetland soils are identified as Limerick silt loam and the buffer zone soils are identified as Hinesburg fine sandy loam in the Soil Survey for Chittenden County. 2of5 / Gardner CUD #2006-354 i. No work will occur in the wetland. This proposal involves the construction of a two -unit condominium in the buffer zone. The building will be 60 feet by 88 feet in size with an approximately 10-foot construction disturbance area and lawn around the south, east, and west sides. Permanent buffer zone impacts from the house and lawn total 1,176 square feet. The installation of a sanitary sewer line will temporarily impact 840 square feet of buffer zone. The project will impact 2,016 square feet of buffer zone. 7. The applicant has submitted a complete application including a site plan for the building, lawn and sewer line: "Gardner & Sons Development Corp., Southview Drive — Site Plan," prepared by Champlain Consulting Engineers, dated June 4, 2007 and revised July 23, 2007. 8. The protected functions of the wetland in question include at least the following: water storage for flood water and storm runoff (§5.1), surface and groundwater protection (§5.2), and erosion control through binding and stabilizing the soil (§5.10). 9. The following functions are either not present or are present at such a minimal level as to not be protected functions: fisheries habitat (§5,3), wildlife and migratory bird habitat (§5.4), hydrophytic vegetation habitat (§5.5), threatened and endangered species habitat (§5.6), education'and research in natural science (§5.7), recreational value and economic benefits (§5.8), and open space and aesthetics (§5.9). 10. The wetland is significant for the water storage for flood water and storm runoff function because it reduces the scouring and erosion of stream banks by attenuating flood peaks and by reducing water velocities; maintains the stability of important habitat for aquatic life by attenuating peak flows of flood water and stormwater runoff, and reduces the scouring and erosion of stream banks. Additionally, Potash Brook flows through the wetland and has been listed as impaired by the VT DEC Water Quality Division, thereby increasing the significance of this function. Characteristics of the wetland which contribute to providing this function are physical space for floodwater expansion and dense, persistent, emergent vegetation that slows down flood waters during peak flows and facilitates water removal by evaporation and transpiration; a stream is present with a sinuous course and there is sufficient woody vegetation to intercept surface flows in the portion of the wetland that floods. The wetland will not be impacted by the proposed project and the buffer zone will remain largely intact. Based on the factors described above, the proposed project will not result in an undue adverse impact to this function. 11. The wetland is significant for the surface and ground water protection function because the wetland reduces levels of contaminants in surface water which recharge underlying groundwater; protects water quality by the removal of nutrients (as demonstrated by a constricted outlet; no dead forest or shrub areas; and lower water velocity through dense, erect, vegetation); protects water quality by the retention of sediments and by moderating the adverse water quality effects of stormwater runoff. The wetland will not be impacted by the proposed construction. Based on the factors described above, the proposed project will not result in an undue adverse impact to this function. 12. The wetland is significant for the erosion control function because there are erosive forces present and the following are present: a shrub and emergent wetland adjacent to a stream; dense stands of erect vegetation greater than 20 feet wide; good interspersion of persistent emergent vegetation and water along course of stream flow. The wetland vegetation that provides this function will not be impacted by the project. Based on the factors described above, the proposed project will not result in an undue adverse impact to this function. 13. The project has been designed to avoid wetland impacts. The building footprint was decreased from the original proposal submitted to this office to reduce buffer zone impacts. The building setback from the road is the minimum allowed by local zoning. The sanitary sewer line will be 3 of 5 Gardner CUD #2006-354 installed, backfilled and stabilized in one continuous operation. Two lines of continuous silt fence will be installed. One will be wire reinforced and installed at the toe of slope. Erosion control matting will be utilized on slopes of 3:1 or greater. A split rail fence, tree line or boulder line will be installed along the limits of disturbance at or within the buffer zone, and as depicted on the site plans, to prevent future encroachment. 14. If the project is constructed according to the specifications of the application and accompanying site plans, and the conditions of this Conditional Use Determination, the resulting buffer zone alteration is not expected to result in any violations of the Vermont Water Quality Standards. Conclusions of Law Based on information provided by the applicant and their representatives in the application for Conditional Use Determination, the Agency of Natural Resources concludes: Under Section 8 of the Vennont Wetland Rules, effective February 23, 1990, the Secretary may authorize conditional uses in a significant wetland or in its adjacent buffer zone. The Rules state that each Class Two wetland is presumed to serve all of the wetland functions identified in the Rules (Section 4.2b). Protected functions are distinguished from other wetland functions in Section 2.20, as those functions that make a wetland so significant they merit protection under these rules. Under Section 8.5a, the Secretary may only authorize a conditional use when it is determined that the proposed conditional use will have no undue adverse effect on the protected functions, unless the Secretary determines such impacts are sufficiently mitigated. The proposed conditional use cannot practicably be located on an upland portion of the site or on another site owned, controlled or available to satisfy the basic project purpose. All practicable measures have been taken in this proposal to avoid adverse impacts on protected functions. The Agency determines that the proposed conditional use, described in the Findings of Fact and in the Conditional Use Determination application in question, will have no undue adverse impacts to the protected functions of the Class Two wetland and associated buffer zone on this subject property or the adjacent wetland complex. Decision The Vermont Agency of Natural Resources finds, that on the basis of the information provided in the application for Conditional Use Determination, there is reasonable assurance that the proposed conditional use will have no undue adverse effects on the protected functions of the significant wetland on this property provided the provisions of theapplication are supplemented with the procedures described below. This Conditional Use Determination is therefore approved with the following conditions: A. All activity shall be completed, operated and maintained as set forth in accordance with the proposal in Conditional Use Determination Application #2006-354 and all submittals listed in Finding of Fact #7 above. No material or substantial changes shall be made in the project without the written approval of the Vermont Wetlands Office. B. The applicant shall notify the Vermont Wetlands Office in writing prior to the start of this project. C. A continuous line of orange snow fence shall be installed along the limit of disturbance prior to the start of construction. A continuous line of silt fence shall be properly installed by the applicant immediately upgradient of the snow fence prior to any construction and shall be regularly maintained. An additional reinforced silt fence will be installed at the toe of slope. 4of5 Gardner CUD 42006-354 Care should be taken to ensure that silt fences are installed on the contour and not in areas of concentrated flow such as stream channels or ditches. Sediment shall be cleaned out before and after any significant storm event or when they have reached less than half the height of the fence. Removed sediments shall be disposed of in a stable, upland area outside the 50- foot buffer zone at least 200 feet from waters of the State and stabilized immediately with seed and mulch at a minimum. All other disturbed soils shall be seeded and mulched within 48 hours of final grading. All sediment barriers and construction fencing shall be removed following the successful establishment of vegetation. D. The applicant shall have this Conditional Use Determination recorded in the land records of the City of South Burlington for all affected lands and the applicant shall have this Conditional Use Determination referenced in any deed for the property. The applicant shall supply the Vermont Wetlands Office with a copy of correspondence with the City of South Burlington certifying that the restrictions have been recorded within 30 days of the date of this determination. E. All proposed activities m the wetland and adjacent 50-foot buffer zone, carried out in compliance with Condition A, must be completed within three years of the date of the Conditional Use Determination or it will expire. An extension of time may be granted for cause. A request for an extension must be received by the Department at least 30 days prior to the end of the three-year period in order to prevent the expiration of this Conditional Use Determination. A request for extension will be considered a minor modification. F. The terms and conditions of this decision shall run with the land. G. The applicant shall monitor the portion of the wetland in question annually during early July for five years following construction for the nuisance plant species purple loosestrife (Lythrum salicaria) and common reed (Phragmites australis). All nuisance plants found shall be pulled by hand and disposed of by burial or burning in a non -wetland location. Additionally, the contractor's equipment shall be cleaned so as to contain no observable soil or vegetation prior to work in wetlands and buffer zones to help prevent the spread of invasive species. 2. The Agency maintains continuing jurisdiction over this project and may at any time order remedial measures be taken if it appears likely'that adverse impacts to the protected functions and values will occur. 3. This Conditional Use Determination does not relieve the applicant of the responsibility to comply with any other applicable federal, state, and local laws, regulations, and permits. 4. By acceptance of this Conditional Use Determination the applicant agrees to allow representatives of the Department of Environmental Conservation access to the property covered by the Conditional Use Determination, at reasonable times, for the purpose of ascertaining compliance with the Vermont Wetland Rules and the Vermont Water Quality Standards. 5. The Department, by issuing this Conditional Use Determination, accepts no legal responsibility for any damage direct or indirect of whatever nature and by whoever suffered arising out of the project described. Appeals Any person with an interest in this matter can appeal this decision pursuant to 10 V.S.A. Section 1269. Pursuant to 10 V.S.A. The project consists of constructing a single residential structure that will include two condominium units, a driveway, a small yard area, utility connections, and associated site grading. The various project elements and the wetland and buffer zone boundaries are shown on the Site Plan. No work is proposed within the wetland. Approximately 1,176 square feet of the buffer zone will be permanently disturbed by the project, as shown on the Site Plan. The installation of the sanitary sewer will temporarily disturb an additional 840 square feet of the buffer zone. A combination of erosion prevention and sediment retention features is proposed for all work within the wetland and buffer zone. The proposed combination of erosion prevention and sediment retention features is designed to prevent any off -site migration of sediment by limiting the movement of sediment towards the project margin and trapping any sediment that reaches the project margin. • The project shall incorporate the standard erosion control BMPs outlined in the Vermont Stormwater Section Construction Guides, available at the State of Vermont website. • The method of construction/installation shall be that which presents the least disturbance and prevents any discharge of sediment downstream. • Additionally, the extent of bank disturbance shall be strictly limited, and all existing vegetation maintained to the greatest degree practicable. • The sanitary sewer service line shall be installed in one continuous operation. 4- • No heavy equipment shall be allowed outside the limits of disturbance, in the wetland, or in the stream. • Prior to construction, orange snow fence and silt fence shall be installed to limit disturbance. • Due to steep slopes and proximity to an impaired watershed, wire reinforced silt fence shall be installed by hand approximately 10 feet from toe of slope. The reinforced silt fence generally will be installed on the contour as shown on the Site Plan, and shall avoid areas of concentrated flow such as stream channels or ditches. • Inspection and maintenance of the erosions prevention and sedimentation control measures shall occur at least once per week during active construction and after each heavy rainfall. Sediment shall be cleaned out before and after any significant storm event or when they have reached less than half the height of the fence. • Removed sediments shall be stockpiled and/or disposed of in a stable, upland area that is located near the eastern tip of the building envelope shown on the Site Plan. The soil stockpile area is located outside the 50-foot buffer zone at least 100 feet from waters of the State. This memorialization will be a fence, hedgerow/tree line, or stonewall. 14. Before this section is completed it will be necessary to determine for which functions the wetland in question is significant. The functional criteria for evaluating a wetland's significance are described in Section 5 of the Vermont Wetland Rules. The Vermont Wetland Evaluation form is available through the Wetlands Office to help determine which functions may be significant. Demonstrate for the project as proposed will avoid adverse impact on each of the functions. As noted, the project will not impact any wetlands, and only a relatively small area of the wetland buffer. The project temporarily impact 840 square feet of the buffer during the installation of the sanitary sewer, and will result in only 1,266 square feet of permanent buffer zone impacts. Apart from the building construction site defined by the limits of disturbance shown on the Site Plan, the forested slopes in the wetland buffer will not be altered. The building will be located as close to the street as allowed under the local zoning ordinance. The building has been modified to be a one level condominium and walk -out basements have been eliminated. A fence will be installed along the southern limit of the building envelope shown on the site plan. 6- C. Wetland functions and values 14a. Water storage for floodwater and storm runoff The wetland is significant for water storage for floodwater and storm runoff. The water storage capacity of the wetland is located in the floodplain of Potash Brook, which provides a significant area for floodwater and storm runoff expansion. The wetland and stream complex has a constricted outlet where a culvert runs under Hinesburg Road (Route 116) downgradient from the project site. The roadbed effectively functions as a large berm with a single outlet through which Potash Brook flows west. Downstream conditions include developed properties and stream banks susceptible to scouring and erosion. The project will not impact the water storage capacity of the wetland. The project is located entirely within an upland portion of the site above the 100-year floodplain of Potash Brook. 14b. Surface and groundwater protection The wetland is significant for surface water quality protection, due to its location adjacent to Potash Brook, an Impaired Watershed. The wetland is located in an urban portion of the watershed and receives runoff from numerous sources. A mix of roads, residential areas, the Burlington airport and commercial businesses and activities are all present upgradient from the site. The wetland has the opportunity to trap and retain some of the sediments, nutrients, and other pollutants that are transported into the wetland. The project will not impact the capacity of the wetland to provide surface water quality treatment. The project is located entirely within an upland portion of the site above the 100-year floodplain of Potash Brook. 14c. Fisheries habitat The wetland complex is characterized by several features that could contribute potentially to fisheries habitat. The wetland borders a long section of Potash Brook, and provides shade and habitat for food resources, along with potential spawning, nursery, feeding and cover habitat for certain fish species. Small unidentified fish were observed in a section of the stream upgradient from the project site. The project will not impact any wetland features that contribute to fisheries habitat. The project will not impact any wetlands and is located almost entirely out of the wetland buffer. 14d. Wildlife and migratory bird habitat The wetland complex is significant for wildlife and migratory bird habitat. The wetland complex and adjacent upland forest in the buffer zone provide habitat for several heron CUD application 10 Gardner/Southview Drive species and a variety of waterfowl in the ponded areas located upgradient from the project site, as well as habitat for a variety of other forest and marsh bird species. The wetland complex also supports an active beaver colony, and provides habitat for mink, and, to a lesser extent, possibly otter. The wetland complex also meets several of the conditions indicative of wildlife habitat diversity outlined in the Vermont Wetland Rules. The project will not result in an undue adverse impact to wildlife and migratory bird habitat in the wetland. While a certain level of noise, light, and related activities associated with residential life can be expected in a limited zone around the proposed structure, the impacts from this project on wildlife and migratory bird habitat should be minimal. The wetland and stream complex upgradient from the site are already surrounded by residential developments. The project consists of a single residence that will not impact any wetlands and is located almost entirely out of the 50-foot wetland buffer, e.g. the wetland and nearly all of the buffer zone will remain unfragmented and undisturbed. Human activities at the site will be largely directed north towards the street. The condominiums will not have walkout basements, and will only have a 1 Moot wide strip of "lawn" around the west, south and east sides of the building. 14e. Hydrophytic vegetation The wetland is not known to be significant for the hydrophytic vegetation function. The wetland does not exhibit any of the significant hydrophytic vegetation characteristics or features outlined in the Vermont Wetland Rules 14f. Threatened and endangered species habitat The wetland is not known to be significant for threatened and endangered species habitat. No threatened or endangered species are identified at or near the site on the Vermont Non -Game and Natural Heritage Program location map on the 14g. Education and research in natural science The wetland is potentially significant for education and research in natural science, as it provides a variety of opportunities for these types of endeavors. Large beaver ponds and other components of the wetland and brook complex are readily accessible via a trail that is open to the public, and the site is located relatively close to several local schools that could utilize the site for field trips and wetland and aquatic ecosystem studies. The project will not adversely impact any features of the wetland that make it potentially significant for education and research in natural science. The house site is located in a residential neighborhood on the opposite side of the wetland from the area with public access. The project will not impact any wetlands and is located almost entirely out of the wetland buffer. 14h. Recreational value and economic benefit CUD application Gardner/Southview Drive The wetland is significant for its recreational value, due to the presence of an established recreational trail that follows along the southern/southeastern side of the wetland complex. The wetland complex provides habitat for beaver and mink, which are potentially trappable wildlife species. The wetland complex provides habitat for a variety of wildlife and bird species, and thus may provide opportunities for natural history based recreation and wildlife and bird watching opportunities. The project will not adversely impact any features of the wetland that make it potentially significant for recreational value and economic benefit. The house site is located in a residential neighborhood on the opposite side of the wetland from the area with public access. The project will not impact any wetlands and is located almost entirely out of the wetland buffer. 14i. Open space and aesthetics The wetland is significant for open space and aesthetics. The wetland is not a prominent feature in the landscape and does not possess any particularly special or unique aesthetic qualities as open space. While the site is readily visible from public viewing areas along Routes 4 and 7, the view is of a rather non-descript old field and shrub complex that is largely surrounded by commercial development, large highways, and a railroad. The shrub swamp and wet meadow portions of the wetland are relatively indistinguishable from adjacent upland field areas. The project will not result in an undue adverse impact to the open space and aesthetic values of the wetland. The house site is located in a residential neighborhood on the opposite side of the wetland from the area with readily accessible public access and public views. The house site will largely be out of site from public viewing areas along the trail system for much of the year, and will not appear dissimilar to numerous other residences that are visible from the recreation path along the southern side of the wetland. 14j. Erosion control through binding and stabilizing the soil The wetland is significant for erosion control through binding and stabilizing the soil along a section of Potash Brook. While the stream section adjacent to the project area between Hinesburg Road and Kennedy Drive is relatively low, significant potential erosive forces characterize it during peak flows. Dense herbaceous vegetation anchors the stream banks along the sections that are not flooded by beaver impoundments. The project will not impact the capacity of the v,,etland to control erosion through binding and stabilizing the soil. The project is located entirely within an upland portion of the site above the 100-year floodplain of Potash Brook.
