HomeMy WebLinkAboutSP-95-0000 - Decision - 0140 Shunpike RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of ICV Construction, Inc. to construct a 54 square foot shed canopy to an existing 16,271 square foot wholesale/distribution building, 140 Shunpike Road On the 13th day of June, 1995, the South Burlington Planning Commission approved the request of ICV Construction, Inc. for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of a 54 square foot shed canopy to an existing 16,271 square foot wholesale/distribution building. This building was approved on June 13 and 20, 1989. 2. This property located at 140 Shunpike Road lies within the IC District. It is bounded on the east by Muddy Brook, on the north by an undeveloped lot, on the west by Gregory Drive and on the south by Shunpike Road. 3. Access/circulation: Access is via a 30 foot curb cut on Gregory Drive. No change proposed. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 13.8% (maximum allowed is 30%) . Overall coverage is 27.5% (maximum allowed is 70%) . Front yard coverage along Gregory Drive is 17.2% and along Shunpike Road is 0% (maximum allowed is 30%) . Setback requirements are met. 5. Landscaping: The minimum landscaping requirement, based on building costs, is $168 which is not being met. Applicant requested a credit for existing landscaping. The site is well landscaped so no additional landscaping was recommended. 6. Parking: A total of 14 parking spaces are required and 23 spaces including two (2) handicapped spaces are being provided. A bike rack was not being provided as required under Section 26.253 (b) of the zoning regulations. The applicant requested a waiver from this requirement. 7. Sewer: No additional allocation required. 8. Traffic: No additional traffic is expected due to the canopy. 9. Other: The landscaping plan should be revised to show the correct building dimensions and square footage. 1 DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of ICV Construction, Inc. to construct a 54 square foot shed canopy to an existing 16,271 square foot wholesale/distribution building, 140 Shunpike Road, as depicted on a two (2) page set of plans, page one (1) entitled "W.W. Grainger, Lot 13 Green Tree Park, South Burlington, Vermont", prepared by Trudell Consulting Engineers, Inc., dated 4 / 24 / 89 , last revised 5 / 10 / 95 , with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plan shall be revised prior to issuance of a zoning permit to show the changes listed below and shall require approval by the City Planner. Three (3) copies of the approved revised site plan shall be submitted to the City Planner prior to permit issuance. a) The site plan (Sheet SP1) shall be revised to show a bike rack as required under Section 26.253(b) of the zoning regulations in a location approved by the City Planner. b) The landscape plan (Sheet SP2) shall be revised to show the correct building dimensions and square footage. 3. The Planning Commission approves a landscaping credit of $168 for existing landscaping. The site is well landscaped so no additional landscaping is warranted. 4. For the purpose of calculating required road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the proposed canopy will generate 0 additional vehicle trip ends during the P.M. peak hour. 5. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 6. The applicant shall obtain a zoning permit for the canopy within six (6) months or this approval is null and void. 7. The applicant shall obtain Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the canopy. 8. Any change to the site plan shall require approval by the South Chairman or Clerk South Burlington Planning Commission Date 2
