HomeMy WebLinkAboutSP-99-10 - Decision - 0140 Shunpike Road#SP-99-10 FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of New England Telephone & Telegraph Company to amend a previously approved plan for a 15,080 square foot wholesale/distribution building. The amendment consists of the construction of 1) a 216 square foot telecommunications hut, and 2) a 4' x 130' sidewalk between the parking lot and the hut, 140 Shunpike Road. On the 1 1 `h day of May, 1999, the South Burlington Planning Commission approved the request of New England Telephone & Telegraph Company for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved plan for a 15,080 square foot wholesale/distribution building. The amendment consists of the construction of 1) a 216 square foot telecommunications hut, and 2) a 4' x 130' sidewalk between the parking lot and the hut. The last review of this property by the Commission was on 6/13/95. The ZBA on 4/12/99 granted the applicant a variance from the front setback requirement and a conditional use permit to allows two (2) principal buildings on one (1) lot. 2. The owner of record of this particular property is W.W. Grainger, Inc. 3. This property located at 140 Shunpike Road lies within the IC District. It is bounded on the east by Muddy Brook, on the north by warehouses, on the west by Gregory Drive and on the south by Shunpike Road. 4. Access/circulation: Access is via a 30 foot curb cut on Gregory Drive. No change proposed. Circulation on the site is adequate. 5. Coverage/setbacks: Building coverage is 13.0% (maximum allowed is 30%). Overall coverage is 27.2% (maximum allowed is 70%). Front yard coverage along Gregory Drive is 17.2% and along Shunpike Road is 3.7% (maximum allowed is 30%). 6. Setback requirements are met for the main building but not for the telecommunication hut. The ZBA on 4/12/99 granted the applicant a dimensional variance to allow the proposed building to project 40 feet into the required 50 foot setback requirement. 7. Landscaping- The minimum landscaping requirement, based on building costs, is $750 which is 2 being met. Proposed landscaping includes four(4) Austrian Pines. 8. Parking,: A total of 15 spaces are required and 23 spaces including two (2) handicapped spaces and a bike rack are being provided. 9. Sewer: No additional allocation required. 10. Traffic: No additional traffic is expected due to the telecommunications hut. 11. Lighting_ Applicant should provide details (cut -sheets) for the light proposed for the telecommunications hut. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of New England Telephone & Telegraph Company to amend a previously approved plan for a 15,080 square foot wholesale/distribution building. The amendment consists of the construction of 1) a 216 square foot telecommunications hut, and 2) a 4' x 130' sidewalk between the parking lot and the hut, 140 Shunpike Road, as depicted on a plan entitled, "Revised Site Plan for W.W. Grainger, Inc. South Burlington, Vermont," prepared by Dunroven Associates, dated March, 1999 last revised on 4/23/99, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the but will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 3) The applicant shall post a $750 landscape bond prior to issuance of a zoning permit. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 4) All new exterior lighting shall consist of downcasting shielded fixtures so as to not cast light beyond the property line. Any change in lighting shall require approval of the Director of Planning & Zoning prior to installation. Prior to permit issuance, the applicant shall provide details (cut - sheets) for the proposed building mounted lights on the telecommunications hut. 5) The bituminous sidewalk shall have a minimum eight (8) inch gravel base. 6) Telephone service vehicles shall not park on Shunpike Road when serving the but but shall use the W.W. Grainger parking lot. 2 7) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 8) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the hut. 9) Any change to the site plan shall require approval by the South Burlington Planning Commission. hairman or Clerk South Burlington Planning Commission Z2- Date 3
