HomeMy WebLinkAboutCU-99-0000 VR-99-0000 - Decision - 0140 Shunpike RoadSOUTH BURLINGTON ZONING BOARD OF ADJUSTMENT STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re New England Telephone & Telegraph Request for a conditional use approval and variance 140 Shunpike Road: Findings of Fact, Conclusions of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on April 12, 1999 by application of Hubert Norton representing New England Telephone & Telegraph Company for a conditional use approval and a dimensional variance to construct a 12' x 18' telecommunication but in conjunction with a warehouse/distribution facility located at 140 Shunpike Road. 1) Multiple structures on a lot requires Board of Adjustment as a conditional use. 2) Section 25.00 Dimensional requirements requires a minimum setback of fifty (50) feet a twenty- one (2 1 ) foot setback is requested. 3) Applicant testified that the proposed structure is an essential service to the area due to the increase development of the area. 4) Small cabinet type structures will be replaced by the proposed hut. 5) The actual setback is fifty seven (57) feet from the curb line. The but does not alter the essential character of the area. 6) Topography presents conditions that limits appellant options for placement of the proposed structure.
