You indicate that on this lot exists a single family residence which was constructed prior to March 5, 1973, that the house is connected to the municipal sewer and water systems. Therefore, in keeping with the Environmental Protection Rules, Chapter 3 - Subdivisions, Subsection 3-04(A), the house lot described above is exempt from review by the Agency of Natural Resources. Please note, should it be determined that the information provided is inaccurate or false, this letter will be considered null and void and the house lot will have to be re-evaluated. Mr. Austin moved that the Planning Commission adopt as its decision the Findings of Fact and Conclusion on the attached document entitled PLANNING COMMISSION, CITY OF SOUTH BURLINGTON RE; APPLICATION FOR JOLLEY ASSOCIATES and deny the applicant's request to construct a 262 sq. ft. addition to an existing 1000 sq. ft. building and a 288 sq. ft. dumpster shed, on a site consisting of a convenience store with gasoline sales, 977 Shelburne Road. Mr. Craig seconded the motion which passed 3-2 with Mr. Teeson and Mrs Maher voting against and Mr. Burgess abstaining. 3. PUBLIC HEARING: Final Plat application of Thomas and Nancy Tavares for a boundary line adjustment involving two properties of 11,241 sq. ft. and 21,500 sq. ft. resulting in two reconfigured properties of 18,741 sq. ft. and 14,000 sq. ft., 76 and 80 Shunpike Road: Mr. Tavares said they are squaring up the two properties. They still meet the R-4 zone requirements. They have no intention of building on the back of the lot. Mr. Weith said there were no outstanding issues with the applica- tion. Mr. Austin moved the Planning Commission approve the final plat ap- plication of Thomas and Nancy Tavares for a boundary line adjustment involving two properties of 11,241 sq. ft. and 21,500 sa. ft. resulting in two reconfigured properties of 18,741 sq ft and 14,000 sq ft 76 and 80 Shunpike Road as depicted on a plat entitled "Boundary Survey, Subdivision of Property of Constance Weems, Shunpike Road, South Burlington, Vermont prepared by Krebs & Lansing Consulting Engineers, Inc, dated December, 1981 with a last revision date of November 30, 1993, with the following stio- ulations• 1 All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. It shall be made clear that this approval addresses only the boundary line adjustment between Weems (80 Shunpike Road) and Tavares (76 Shunpike Road). This approval does not involve in any way, the adjoining property to the north which is owned by Allen & Lynn Currier (74 Shunpike Road) and which appears on this approved plat. 3. PUBLIC HEARING: Revised Final Plat application of Gregg Beldock to amend an approved planned commercial development consisting of 150 residential units, a 61-room hotel, 20,000 sq. ft. movie theatre (1000 seats), 22,000 sq. ft. of retail use, 1 3100 sq. ft. fast food restaurant with drive -through, and a bank with drive - through service. The amendment consists of replacing the 22,000 Sq. ft. of retail use with 11,000 sq. ft. of indoor recreation/ entertainment use and 10,500 sq. ft. of retail/restaurant use, L&M Park, Shelburne Rd: Mr. Sheahan stepped down during this discussion. Mr. Beldock said they have now determined what the full use of the building will be. Mr. Weith said he had not yet reviewed traffic data and the new plan which was just submitted today. Mr. Burgess and other members expressed concern with reviewing last minute changes that no one has had a chance to review. Mr. Craig noted that the Commission had reviewed a 12,000 sq. ft. building at sketch and now were seeing a 22,000 sq. ft. building which causes much more worry about parking and traffic. After a discussion, members agreed to review the plan as a sketch plan. The applicant withdrew the Final Plat. Sketch Plan Review: Mr. Beldock said the building would be 22,000 sq. ft., 5 ft. narrower than the approved retail building. 7,000 sq. ft. would be for restaurant use, 4,000 for retail use (a hobby shop) and the rest of the space for a children;s amusement center. There will be 81 underground parking spaces and 40 more in front of the building. Mr. Beldock said this is a much less intensive traffic use than the originally proposed retail building. The peak hours of this use would not conflict with the retail uses. Mr. Austin asked what type of restaurant they are proposing. Mr. Beldock said it will be a high end Italian Restaurant with 180 seats. AT This project consists of a boundary line adjustment between a 21,500 square foot lot and an 11,241 square foot lot to create a 14,000 square foot lot and an 18,741 square foot lot. Both lots are developed with single family dwellings. Sketch plan was reviewed on 9/28/93 (minutes enclosed). These properties are located at 76 and 80 Shunpike Road and lie within the R4 District. They are bounded on the north by residences, on the east by undeveloped industrial/commercial lots, on the south by a residence and on the west by Shunpike Road. Access: Access to both lots will not change. Lot size: Both lots will continue to meet the minimum lot size of 9,500 square feet (0.22 acres). Lot frontages for both lots will remain unchanged. Neither lot meets the minimum frontage requirement of 80 feet. Both lots could be developed with two- family dwellings. 4) MARY PROVENCHER - 2 LOT SUBDIVISION - FINAL PLAT This project consists of the subdivision of a lot with approximately 6,135 square feet into a 1,845 square foot lot and a 4,290 square foot lot. The existing lot is presently developed with two (2) single-family dwellings. The purpose of the subdivision is to create a lot for each dwelling for future sale.
