A parcel of land consisting of 14,000 sf,
located on Shunpike Road in the city of South Burlington, Vermont.
I have reviewed your information concerning the creation of a lot
of less than 10 acres in size. You indicate that on this lot
exists a single family residence which was constructed prior to
March 5, 1973, that the house is connected to the municipal sewer
and water systems.
Therefore, in keeping with the Environmental Protection Rules,
Chapter 3 - Subdivisions, Subsection 3-04(A), the house lot
described above is exempt from review by the Agency of
Natural Resources.
Please note, should it be determined that the information provided
is inaccurate or false, this letter will be considered null and
void and the house lot will have to be re-evaluated.

would meet that criteria. Mr. Smith said it is not his province to
make that decision. He felt it would depend on how what Mr.
Pomerleau were willing to pay for the right of way. He added that
he didn't feel the proposed addition would generate more traffic.
Mr. Austin moved that the Planning Commission adopt as its decision
the Findings of Fact and Conclusion on the attached document
entitled PLANNING COMMISSION, CITY OF SOUTH BURLINGTON RE;
APPLICATION FOR JOLLEY ASSOCIATES and deny the applicant's request
to construct a 262 sq. ft. addition to an existing 1000 sq. ft.
building and a 288 sq. ft. dumpster shed, on a site consisting of
a convenience store with gasoline sales, 977 Shelburne Road. Mr.
Craig seconded the motion which passed 3-2 with Mr. Teeson and Mrs
Maher voting against and Mr. Burgess abstaining.
3. PUBLIC HEARING: Final Plat application of Thomas and Nancy
Tavares for a boundary line adjustment involving two properties of
11,241 sq. ft. and 21,500 sq. ft. resulting in two reconfigured
properties of 18,741 sq. ft. and 14,000 sq. ft., 76 and 80 Shunpike
Road:
Mr. Tavares said they are squaring up the two properties. They
still meet the R-4 zone requirements. They have no intention of
building on the back of the lot.
Mr. Weith said there were no outstanding issues with the applica-
tion.
Mr. Austin moved the Planning Commission approve the final plat ap-
plication of Thomas and Nancy Tavares for a boundary line
adjustment involving two properties of 11,241 sq. ft. and 21,500
sa. ft. resulting in two reconfigured properties of 18,741 sq ft
and 14,000 sq ft 76 and 80 Shunpike Road as depicted on a plat
entitled "Boundary Survey, Subdivision of Property of Constance
Weems, Shunpike Road, South Burlington, Vermont prepared by Krebs
& Lansing Consulting Engineers, Inc, dated December, 1981 with a
last revision date of November 30, 1993, with the following stio-
ulations•
1 All previous approvals and stipulations which are not superseded
by this approval shall remain in effect.
2. It shall be made clear that this approval addresses only the
boundary line adjustment between Weems (80 Shunpike Road) and
Tavares (76 Shunpike Road). This approval does not involve in any
way, the adjoining property to the north which is owned by Allen &
Lynn Currier (74 Shunpike Road) and which appears on this approved
plat.
3. The applicant shall submit three copies of the final plat which

have been signed and stamped by a licensed surveyor.
4. The applicant shall record the final plat in the South Burling-
ton land records within 90 days or this approval is null and void.
The Planning Commission Chair or Clerk shall sign the plat prior to

Mrs. Maher seconded. Motion passed unanimously.
4. PUBLIC HEARING: Revised Final Plat application of Gregg Beldock
to amend an approved planned commercial development consisting of
150 residential units, a 61-room hotel, 20,000 sq. ft. movie
theatre (1000 seats), 22,000 sq. ft. of retail use, 1 3100 sq. ft.
fast food restaurant with drive -through, and a bank with drive -
through service. The amendment consists of replacing the 22,000
Sq. ft. of retail use with 11,000 sq. ft. of indoor recreation/
entertainment use and 10,500 sq. ft. of retail/restaurant use, L&M
Park, Shelburne Rd:
Mr. Sheahan stepped down during this discussion.
Mr. Beldock said they have now determined what the full use of the
building will be.
Mr. Weith said he had not yet reviewed traffic data and the new
plan which was just submitted today. Mr. Burgess and other members
expressed concern with reviewing last minute changes that no one
has had a chance to review. Mr. Craig noted that the Commission
had reviewed a 12,000 sq. ft. building at sketch and now were
seeing a 22,000 sq. ft. building which causes much more worry about
parking and traffic.
After a discussion, members agreed to review the plan as a sketch
plan. The applicant withdrew the Final Plat.
Sketch Plan Review:
Mr. Beldock said the building would be 22,000 sq. ft., 5 ft.
narrower than the approved retail building. 7,000 sq. ft. would be
for restaurant use, 4,000 for retail use (a hobby shop) and the
rest of the space for a children;s amusement center. There will be
81 underground parking spaces and 40 more in front of the building.
Mr. Beldock said this is a much less intensive traffic use than the
originally proposed retail building. The peak hours of this use
would not conflict with the retail uses.
Mr. Austin asked what type of restaurant they are proposing. Mr.
Beldock said it will be a high end Italian Restaurant with 180
seats. They have proposed parking based on 200 seats, for a total
of 505 spaces.

This project was continued from the 11/23/93 meeting to give staff
time to prepare a motion of denial (see enclosed motion and staff
notes from the last meeting).
3) CONNIE WEEMS/THOMAS TAVARES - BOUNDARY LINE ADJUSTMENT - FINAL
PT. AT
This project consists of a boundary line adjustment between a
21,500 square foot lot and an 11,241 square foot lot to create a
14,000 square foot lot and an 18,741 square foot lot. Both lots
are developed with single family dwellings. Sketch plan was
reviewed on 9/28/93 (minutes enclosed).
These properties are located at 76 and 80 Shunpike Road and lie
within the R4 District. They are bounded on the north by
residences, on the east by undeveloped industrial/commercial lots,
on the south by a residence and on the west by Shunpike Road.
Access: Access to both lots will not change.
Lot size: Both lots will continue to meet the minimum lot size of
9,500 square feet (0.22 acres). Lot frontages for both lots will
remain unchanged. Neither lot meets the minimum frontage
requirement of 80 feet. Both lots could be developed with two-
family dwellings.
4) MARY PROVENCHER - 2 LOT SUBDIVISION - FINAL PLAT
This project consists of the subdivision of a lot with
approximately 6,135 square feet into a 1,845 square foot lot and a
4,290 square foot lot. The existing lot is presently developed
with two (2) single-family dwellings. The purpose of the
subdivision is to create a lot for each dwelling for future sale.
Neither lot will meet the minimum area and dimension requirements

The South Burlington Planning Commission held a meeting on
Tuesday, 28 September 1993, at 7:30 pm, in the Conference Room,
City Hall, 575 Dorset St.

1. Other Business:
a. Mr. Weith advised that Gabe Handy is requesting a 6-month ex-
tension to the site plan approval for the motel and restaurant at
the Bonanza site.
Mrs. Maher moved to approve the 6-month extension on the Handy
motel -restaurant site planapproval as re uested. Ms. Peacock
seconded. Motion gassed unanimously._
b. Mrs. Maher asked Mr. Weith to find out about the large trailer
in the parking lot of the Merchant's Bank on Kimball Avenue.
2. Minutes of 31 August 1993:
Ms. Peacock moved to approve the Minutes of 31 August as written.
Mrs. Maher seconded. Motion passed 4-0 with Mr. Teeson abstain-
ing.
3. Sketch plan application of Thomas and Nancy Tavares and Connie
Weems for a boundary line adjustment involving two existing par-
cels of 0.53 and 0.26 acres to create two newly configured
parcels of 0.31 and 0.48 acres, 76 and 80 Shunpike Road:
Mr. Tavares said they will take the common boundary and extend
it due east to meet the property line. They have no intention of
building there. Mr. Weith advised the applicant that the final
plat will have to show all buildings on both lots. Mrs. Maher
asked whether the lot would now be big enough for a duplex. Mr.
Tavares said there isn't enough frontage.
4. Site Plan application of Contact Communications for conver-
sion of a 2500 sq. ft. builidng to general office use (communi-
cations facility), 2026 Williston Rd:

MEHALER PARKES - CORPORATE WAY
1. This lot which fronts on Corporate Way should not be developed
until Corporate Way is completed and access to it from Corporate
Way.
2. Access to utilities (power, water, sewer) will require
permission from Corporate Way owner Mr. Munson.
3. Sewer main will have to be extended about 400 feet to serve
this lot.
4. Access from Hinesburg Road will place the drive very close to
two residences and may require removal of some mature trees.
5. Plan should include a title block and show utilities and site
drainage.

PLAN
This project consists of a boundary line adjustment between a 0.53 acre lot and a
0.26 acre lot to create a 0.31 acre lot and a 0.48 acre lot. Both lots are developed
with single family dwellings.
These properties are located at 76 and 80 Shunpike Road and lie within the R4
District. They are bounded on the north by residences, on the east by undeveloped
industrial/commercial lots, on the south by a residence and on the west by Shunpike
Road.
Access: Access to both lots will not change.
Lot size: Both lots will continue to meet the minimum lot size of 9,500 square feet
(0.22 acres) . Lot frontages for both lots will remain unchanged. Neither lot meets
the minimum frontage requirement of 80 feet.
Other:
--- the final plat plans must show all existing buildings on both the Weems and
Tavares properties.
--- the final plat plan should show the boundary line to be dissolved with a dashed
line and a notation that it is to be dissolved.
--- new deeds should be recorded for the reconfigured lots.
5) BDP REALTY (IDX) - SITE MODIFICATIONS - SITE PLAN
This project involves expanding the parking area of an existing 20,600 square foot
office building. The Planning Commission last reviewed this site on 10/10/89 when
it approved a day care facility in this building. The day care facility was never
established.
This project located at 1500 Shelburne Road lies within the C2 District. It is
