CONDITIONS:
(1 ) The deed for a parcel purchased under the provisions of
this permit must include the following "Waiver of Development
Rights." All subsequent deeds, leases or contracts of sale must
also contain the waiver unless a subdivision permit is obtained.
Notice of the purchaser's name and address must be filed with the
Division of Protection.

"In order to comply with the State of Vermont
Environmental Protection Rules on the subdivision of lands
and disposal of waste including sewage, the grantee shall
not construct or erect a structure or building on the parcel
of land conveyed herein, the useful occupancy of which will
require the installation of plumbing and sewage treatment
facilities or convey this land without first complying with
said State regulations. The grantee by acceptance of this
deed acknowledges that this lot may not qualify for approval
for development under the appropriate environmental
protection or health regulations and that the State may deny
an application to develop the lot."

(2) If the parcel being acquired is to be considered for
building development at some future date, the purchaser
understands that the information required by Section 3-08 of the
rules must be submitted for evaluation. If such information does
riot meet the Environmental Protection Rules, permission to build
on the lot will be denied.
(3) The conditions of this permit shall run with the land and
will be binding upon and enforceable against the permittee and
all assigns and successors in interest. The permittee shall be
responsible for recording this permit and the "Notice of Permit -
Recording" in the City of South Burlington Land Records within 30
days of issuance of this permit and prior to the conveyance of
any lot subject to the jurisdiction of this permit.

MOTION OF APPROVAL
That the South Burlington Planning Commission approve the Final
Plat application of Edward and Nancy Fissette for the two lot
subdivision of 1.02 acres into a .26 acre lot with an existing
house and a .76 acre lot, located at 10 Shunpike Road as depicted
on a plan entitled "Property Survey for Edward R. and Nancy J.
Fissette, 10 Shunpike Road, South Burlington, Vermont" dated
May 19, 1986, prepared by Palmer Company, LTD with the following
stipulations:
1. The new driveway shall have a pipe culvert. Plans shall
be approved by the City Engineer prior to permit for any new
construction.
2. It is the applicants responsibility to record the approved
plan with the City Clerk within 90 days or this approval is null
and void. The mylar must be approved by the City Planner and
signed by the Chairman or Clerk of the Planning Commission prior
to recording.

NOTE: It is interesting to note that we are beginning to see
applications for back yard.subdivisions or. in -filling. Both the
Fissette and Barnes applications are legal subdivisions of deep
lots and seem to be the first we have seen.

`2-),__FISSETTE, TWO LOT SUBDIVISION, 10 SHUNPIKE ROAD
Mr. & Mrs. Fissette propose to subdivide their property into two
lots of 11,479 square feet, with an existing house and 33,085
square feet for future development.. There are no significant
issues or problems. See Bill Szymanski's memo.
3) BARNES, TWO LOT SUBDIVISION, 27 MEADOW ROAD.
Mr. Barnes proposes to subdivide his property of 24,000 square
feet into two lots of 12,000 square feet each. The property has
100 feet of frontage on Meadow Road.
An existing house and garage occupies the front of the property.
The second lot will be located behind this house. access to this
new lot, is through a proposed twenty foot right. -of -way as allowed
under Section 19.20 of the Ordinance. This, access mist be
secured by a permanent legal. agreement and a waiver of City
maintenance must be recorded.
The proposed lot is large enough for a duple-,:. To construct the
access and the nei duplex several_ trees will be moved to a new
.location. Three apple trees, a lilac, a mountain ash, a pine
tree and a flowering bush will be removed.
See Bill Szymanski's comments.
4) LASH, ADDITION, 1515 SHELBURNE ROAD
Mr. Lash proposes to construct a 5090 square foot addition to the
Town and Country Furniture building. The lot is being enlarged
by annexing a strip of land 50 feet, in width along the northern
boundary and 25 feet in width along the western boundary from the
Pomerleau property. (see tax map)
The Zoning Board granted a variance since this is a non -conform-
ing structure and the addition exceeds the maximum building
coverage. The permitted building coverage is 30%. The existing

approve the site Fian application of Partner Tire and Service
Inc.,_ David Desautels, agent, for construction of a 10,200
sq• ft. building for Partner Tire Sales, an automotive
service business and a retail parts business as depicted on a
plan entitled "Partner Tire and Service, Inc., for Howard
Sherman and Dale Franklin, Shelburne Rd, South Burlington,
Vermont" prepared � Gordon G. Woods Associates, Architects,
Burlington, Vermont, dated April 10, 1986, and last revised
5/7/86 with the following stipulations:
1. An $8000 landscaping bond shall be posted prior to permit.
The landscaping plan shall be revised showing the trees that
are located in the northern property to be moved to a loca-
tion approved j?y the City Planner. —
2. The parking on the north side of the ravine shall not be
constructed unless it is determined 1 the applicant and/or
the Planning Commission after one year that it is required.

Mr. Fissette explained they want to keep their house and
possibly build a multi -family dwelling on the larger lot.
The Zoning Board granted a variance on frontages.
No issues were raised.
6. PUBLIC HEARING: Final Plat application of John Larkin for
the construction of a 200-unit hotel with the existing
restaurant on 9.8 acres and remaining lot 410 of 7.026 acres
at 1710 Shelburne Rd.
Mrs. Lafleur said the application was correctly reviewed as a
site plan with traffic overlay criteria. She noted that
there was a critique by Craig Leiner of the taffic study.
Mr. Spitz explained the traffic study. He acknowledged there
will be long delays for left turns out of the hotel, but said
this is a fact of life of Shelburne Rd. He said their anal-
ysis does not show the need for a signal at the hotel
entrance. Peak hours are not the same as for the rest of
Shelburne Rd. traffic. Theyare 900 ft. from Allen Rd. and
further from Green Mountain Dr. The accident history at the
location is not high. They will have right and left turn
exiting lanes.
At the Green Mountain Dr/Bartlett Bay Rd/Rt. 7 intersection
conditions will depend on Agency of Transportation schedules
for construction. At Allen Rd., Mr. Spitz said their cal-
culations indicate a signal will be warranted now. The
Agency of Transporation will look into this.in their report.
Craig Leiner does not feel a signal is warranted and feels
that Allen Rd. development will be the triggering factor.
Mrs. Maher said she feels that until Shelburne Rd. is widened
this development would pose a dangerous situation. She felt
the applicant should be asked to phase in his project so it
will be less dangerous.
Mrs. Lafleur summarized Mr. Leiner's appraisal: he agreed
with estimates for trip generation and with directional dis-
tribution, but disagrees with length of delays. He felt that
the less severe grade of the new driveway will improve the
situation and agreed with the 2 exiting lanes.
On other issues, Mr. Blanchard said that lot #10 was not
counted in the density. Mrs. Lafleur confirmed that lot
coverage is under 70%, even deducting the ravine. Mr. Larkin
said he will try to sell the restaurant to a separate party.
Mrs. Maher said she would vote for 100 units now and the rest
5) FISSETTE, 10 SHUNPIKE ROAD
This sketch plan is for the two lot subdivision of a 1.02 acre
property with an existing house. The Zoning Board approved a
variance for the 56 foot frontage on the larger lot.
The two lots will be 11,245 square feet with the existing house
and a new lot of 33,344 square foot for a multiple -family
dwelling. It is Zoned R4; three units may be permitted on this
lot. They will require a separate subdivision approval. Muni-
cipal sewer and water will be provided.
6) PARTNER TIRE, Fassetts lot #3, 1785 SHELBURNE ROAD
Partner Tire proposes to construct a 10,200 square foot structure on
lot #3 of the Fassetts subdivision. The structure will have
three uses: Partner Tire sales, automotive service and retail
parts. These multiple uses were approved by the Zoning Board of
Adjustment.
Access and Circulation: This lot and #2 will share a curb cut.
The curb cut is located just south of Harbor View Road.
Circulation is adequate.
Parking: Forty five parking spaces are provided. The plan shows
a second parking lot north of the ravine to meet, the parking
requirements. I suggest this lot be constructed after a one year
review only if the parking is needed.
Landscaping and Screening: The project requires a landscaping
plan and bond valued at $ 8000. Although the plan meets this
requirement, the plan should include larger 4 inch caliper trees
along Shelburne Road. I do not particularly like paving right up
to the building and prefer a landscaped buffer around the
building except, of course, where there are overhead doors. I am
expecting to receive revised plans prior to the meeting.
Traffic: The overlay zone permits 89 trip ends during the peak
hour on this property. The applicant has provided data on the
Partner Tire business in Colchester that 72 trip ends will be
produced by 36 customers per day. The two other businesses
project 44 customers per day or 88 trip ends for a total of 160
trip ends per day. During the peak hour of Shelburne Road, the
maximum projection is 17 trips or 34 trip ends. There is no data
from ITE for this type of use.
The applicant must contribute 1% toward the improvement fund
based on this share of total trips over a two year period.
Other: An evaluation by Wagner, Heindel and Noyse is required.
and the applicant must comply with that recommendation for on
site detention and erosion control. Sidewalks must be built
along the frontage. See Bill Szymanski's and Chief Goddette's
comments.
