WHEREAS, on May 13, 1975 the City of SouthxBurliri i?Rd, rFrk
Planning Commission granted final plat approval for a seven�lo't
subdivision, as depicted on the plat entitled "Proposed
subdivision for Laurence H. Willis, So. Burlington, Vermont"
prepared by Willis Engineering Associates, Inc., dated October 2,
1975 (the "Plat"), which approval was not appealed and became
final; and
WHEREAS, said Plat was recorded on November 14, 1975 in
Volume 105, Page 39 of the City of South Burlington Land Records;
and
WHEREAS, said Plat was not stamped and/or otherwise endorsed
by the City of South Burlington Planning Commission at or prior to
the date of its recording; and
WHEREAS, all of the lots depicted on said Plat have since
been conveyed; and
WHEREAS, Section 508 of the City of South Burlington
Subdivision Regulations and 24 V.S.A. §4416 require that an
approved plat be endorsed in writing in such plat, and recorded in
the office of the City Clerk within 90 days of such approval; and
WHEREAS, the current owner of Lot 4 in the above -referenced
subdivision has requested that this Commission re -approve the
above described Plat in a legally sufficient manner; and
WHEREAS, the City of South Burlington Planning Commission,
having granted Final Plat Approval relative to said subdivision
and the related plat, and the same having been previously recorded
in the Land Records of the City of South Burlington, wishes by the
adoption and recording of this Notice to reaffirm and confirm said
approval.
NOW THEREFORE, Notice is hereby given that (i) the Plat as
recorded November 14, 1975 shall be deemed to have been stamped
and endorsed by the South Burlington Planning Commission as
required by, and so as to satisfy, the requirements of §508 of the
City of South Burlington Subdivision Regulations and 24 V.S.A.
§4416, and (ii) the lots depicted on said Plat have been and shall
continue to be subject to all of the conditions and restrictions
contained in the Final Plat Approval which conditions and
restrictions shall run with said land and be binding upon the
current owners thereof and their respective successors, heirs and
assigns, unless or until modified or removed by the South
Burlington Planning Commission.

:Mr. Weith advised that Item #5 on the agenda will be postponed as
they are waiting for input from the City Attorney.
Mr. Dinklage moved to continue item #5 until 7 July 1998. Mr.
Beaudin seconded. Motion passed unanimously.
2. Review Minutes of 26 May 1998:
Ms. Barone moved to approve the Minutes of 26 May as written.
Mr. Dinklage seconded. Motion passed 3-0 with Mr. Burgess at-
taining.
3. Sketch Plan application of David & La�:ra. Austin to amend a
previously approved subdivision plat for a two -lot subdivision.
The amendment consists of a boundary line adjustment to reduce
the size of lot #1 by 0.2 acres and increase the size of lot #2
by 0.2 acres, 301-5 Swift Street:
Mr. Austin said the adjustment may actually end up being a little
smaller. He agreed to comply with two staff comments, noting on
the final plan that the "old property line is dissolved" and
extending the "limit of clearing" to the new property line.
No issues were raised by the Commission.
4. Public Hearing: Final Plat Application of Beverly F. Willis
for reapproval of a 7-lot subdivision plat originally approved on
5/13/75, Kimball Avenue and Shunpike Road:
Mr. Weith explained that the plat was approved in 1975 but was
not recorded within the 90-day limit so there needs to be a
reapproval so the Chair can sign the plat. There will also have

stamping and signing the recorded plat, a legal document shall be
recorded which explains the Planning Commission's action
regarding this approval. This legal document shall be approved
by the City Attorney rp for to recording.
Mr. Dinklage seconded the motion which was then passed
unanimously.
5. Continued site plan application of Green Tree Park, Inc, to
construct a 17,400 sq. ft. building for warehouse use for a
multiple number of tenants, 12 Gregory Drive and site plan ap-
plication of Mark Rocheleau to amend a previously approved plan
for a 26,099 sq. ft. building for multiple industrial uses. The
amendment consists of an access modification to allow access to
12 Gregory Drive, 16 Gregory Drive:
Mr. Hart explained that the application had been tabled because
the Commission wanted the applicant to negotiate for a shared
access agreement. There is now an agreement to combine access
with the neighboring property. The applicant will also put a
"jog" in the new building to break up the face somewhat.
Mr. Dinklage asked if the amount of fill on city land has been
changed. Mr. Hart said it has not but it may actually be less.
Mr. Crow moved the Planning Commission approve the site plan
application of Green Tree Park, Inc, to construct a 17,400 sq.
ft. building for warehouse use for a multiple number of tenants,
12 Gregory Drive, and the site plan application of Mark Rocheleau
to amend a previously approved plan for a 26,099—sq. ft. building
for multiple industrial uses, 16 Gregory Drive _ the amendment
consists of an access modification to allow access to 12 Gregory

4) BEVERLY WILLIS - 7 LOT SUBDIVISION - FINAL PLAT
This project consists of the reapproval of a seven (7) lot subdivision plat approved on 5/13/75 . The
approved plat was not endorsed in writing by the Planning Commission and was recorded on
November 14, 1975. Consequently, the approved plat was not recorded within the 90 days mandated
by State Statutes. The purpose of this application is to legitimize the recorded plat to cure any
question regarding the lawful existence of these lots within the subdivision that have the same
boundaries as shown on the 1975 plat. The sketch plan was reviewed on 5/26/98 (minutes enclosed).
Once this plat is approved, the Chairman should sign and stamp the recorded plat and a legal
document should be recorded which describes the Commission's action.
5) WILLIAM BISSONETTE - SIGN APPEAL
The appellant has appealed the issuance of a Warning Notice (see enclosed) to Al's French Fry's
regarding the display of a sign without a permit. It is not clear what he is appealing. Section 29 of
the South Burlington Sign Ordinance (see enclosed) provides that "any person aggrieved by any
action of the Code Officer, may appeal such action... to the South Burlington Planning Commission."
It further states that "in deciding such appeals, the Planning Commission may not grant variances,
exemption, extra -ordinary relief or otherwise alter, amend, enlarge or modify the provisions of the
ordinance." Basically, the responsibility of the Planning Commission is to determine whether or not
the Code Officer interpreted the ordinance correctly.
The sign in question is an A -Frame sign advertising "Al's Ice Cream" (photos of the sign will be
available at the meeting). This sign is visible and readable from the sidewalk along Midas Road and
Williston Road. This A -Frame is a "sign" as that term is defined in Section 3 (bb) of the sign
ordinance (see enclosed) and is also a "temporary sign" (see enclosed definition).

3 ) BEVERLY WILLIS = 7 LOT SUBDIVISION - SKETCH PLAN
This project consists of the reapproval of a seven (7) lot subdivision plat approved on 5/13/75
(minutes enclosed). The approved plat was not endorsed in writing by the Planning Commission and
was recorded on November 14, 1975. Consequently, the approved plat was not recorded within the
90 days mandated by State Statutes. The purpose of this application is to legitimize the recorded plat
to cure any question regarding the lawful existence of these lots within the subdivision that have the
same boundaries as shown on the 1975 plat.
Once this plat is approved, the Chairman should sign and stamp the recorded plat and a legal
document should be recorded which describes the Commission's action.
4) POMERLEAU REAL-ESTATE _ 2 LOT SUBDIVISION - SKETCH PLAN
This project consists of amending a plat for a previously approved planned unit development
consisting of three (3) buildings on a 6.8 acre parcel. The amendment consists of subdividing the 6.8
acre parcel into two (2) lots of4.72 acres (lot #1) and 2.08 acres (lot #2). Lot #1 is developed with
a light manufacturing building(Magic Hat brewery) and lot #2 is developed with two(2) mixed use
buildings (Jiffy Lube and AudioNideo Authority).
Access: Access to lot #1 is by a 36 foot curb cut on Bartlett Bay Road. Access to lot #2 is by a 45
foot curb cut on Bartlett Bay Road and a 30 foot ingress only curb cut on Shelburne Road. No
changes proposed.
Lot size/frontage: The nunimum lot size requirement of 40,000 square feet will be met by both lots.

Dear Ray:
On behalf of our client, Beverly Willis, we are applying for a subdivision approval for Lot 4 of the
Willis Subdivision. Enclosed are a Sketch Plan application, 5 prints of the Proposed Subdivision,
dated 10-2-75, an I I" x 17" copy of the Proposed Subdivision as found in the land records, the
Planning Commission approval dated May 13, 1975 and 5 prints of the Plat of Land for R.D.R.
Enterprises, last revised 8-17-90.
Beverly Willis wished to sell Lot 4 and needs to clear up some of the legal matters that have
recently come to the attention of buyer's lawyer. The plat needs to be approved and recorded
properly. The subdivision was approved as stated above, but the plat wasn't recorded until
November 14, 1975 which is more than the 90 days from the date of approval. Lots 1, 2, 3, part
of 5, 6 and 7 have since been sold and developed. The original Lot 4 (1.9 acres) was called the
barn lot. The present building was moved onto this lot from Lot 6 when Digital bought Lot 6 and
used as an office until the early 90's. The remnants of the barn that burned around the same time
are still visible. The enclosed R.D.R. Enterprises plat shows the resubdivision of Lot 5 and a
section of Lot 4 that was deeded to the Vermont Highway Department after the May 13, 1975
subdivision approval.
In addition to the subdivision approval request, we are seeking a sewer allocation of 405 gpd to
include in the State Subdivision Permit application. Please call Tyler or myself with any

Mr. Ward told the Planning Commission that Mr. Mitchell had submitted his
verbal resignation to the City Manager on Friday but no formal letter of
resignation had been received because Mr. Mitchell had been called away
because of serious illness in the family. Mr. Ward said he believed the
resignation was to take effect in a month.
Subdivision hearing of Willis property Shunpike Road
Mr. Ward distributed copies of a drawing of the property in question, and
explained the only lots to be created as new ones would be the homestead
lot, the barn and shed lot, and the 18 acre piece to the rear of that lot
which has been identified as #5. Lot #6 is under option to GBIC;#7 is across
the road with no plans for that piece in the immediate future. The property
lies in three different zones, R-4, industrial, and the Conservation District.
Also Muddy Brook and Potash Brook are involved.
Mr. Ward stated the City Engineer has no problems with what is being proposed
right now.
Mrs. Krapcho asked about the road coming in from Williston Road, if the 50-
foot right of way could be extended to 60 feet.
Mr. Ward said the City would rather have a 60-foot right of way when talking
about deeding a new road to the City, but in this case the road is already
existing and has been deeded.
Mr. Wessel agreed that the Planning Commission couldn't go back and do it all
over again.
Mr. Ewing asked about the shed being on the abutting property line, and Mr.
Ward said Mr. Willis owns both sides, that the barn and shed are in the R-4
( District, the only way the barn could be used under the existing zone would
be if someone wanted to live in it.
Asked by Mr. Wessel to explain the subdivision further, Mr. Ward said the
subdivision has to be approved or Mr. Willis cannot deed the land. He said
GBIC has had some different thoughts and when Mr. Willis goes to Act 250
GBIC is going to ask for a deferral until such time as they are ready to
develop, but he understands they still want to exercise the option as far as
the Willis farm is concerned. He had hoped that Harry Behney would attend
this meeting.
Chairman Wessel asked about drainage ways and how the number of bridges
could be minimized.
Mr. Willis said the road is where it is so that it will line up topographically
as best suited for placement, and they had tried to get the best possible lay-
out of the road.
Mrs. Maher explained t t approving it as shown does not commit the Commission
to the right -of is is shown, because in the end the engineers have to
approve it.
Mr. Wag�d said the basic reason for the Willis subdivision is to allow the
okchange of land between Mr. Willis and GBIC. There has been some discussion
about dividing the 30 acre piece and possibly the 18 acre piece in the future.
Mrs. Krapcho asked if the Commission would see the plan again after the final
position of the road was approved.
Mr. Ward replied the Commission would see it with the GBIC subdivision, that
this is a subdivision by the Commission's standards but Mr. Willis has no
development thoughts on it at all; that was why he had hoped to have the GBIC
representative there.

Mrs. Krapcho asked if the Planning Commission would see another plan of
Mr. Willis's subdivision showing the precise location of the new road.
Mr. Ward said details such as road, water, sewer, etc. will all come later,
`hat this is a preliminary plan for a subdivision of the Willis farm.
Mrs. Maher moved that the Planning Commission approve th
and the remainder Conservation district.
Seconded by Mr. Levesque.

Discussion on Lamplough proper
e
Chairman Wessel said he would like to continue by partitioning the discussion
into two sections, but if the other members want to do it differently he
would go along with their wishes.
Mrs. Maher said she felt they should discuss the entire triangle.
Mr. Ellis proposed continuing the discussion of last week with respect to
the Lamplough property, but extend it to the whole property under 1-a and 1-b.
Attention was called to the new revised format prepared by the City Planner
to replace the check list which had been used at the last meeting.
Mrs. Krapcho said the issue was really whether there was a need to change
the adjoining property, that the Commission should be looking at the larger
land use. She said she did not agree that all the parcels within the triangle
should be zoned the same way, or that the same land use would be found.
Mr. Wessel asked if they wished to do the whole triangle first for land use,
with the findings to be based on that.
Mr. Ellis said he felt that point 2 would need a discussion of zone, but
Mrs. Krapcho disagreed with that.
Mrs. Maher, referring to the Minutes of May 6, asked if Mr. Hall and Mr.
Towne had been contacted to be present at this meeting, and also asked about
traffic figures to be supplied by the developer.
Mr. Levering said he had only dealt with marketing information as contained in
his letter of May 12 to the City Planner. Mr. Lamphere was to be responsible
for the first six questions asked by the Planner and this had been taken care
of by a letter from Mr. Lamphere to Mr. Mitchell.
It was assumed by the Commission that Mr. Mitchell had been called away before
receiving Mr. Lamphere's communication, or before he had time to do anything
with it, as copies had not been given to the Commission.
Mrs. Daher referred to the memo from Mr. Mitchell dated May 6, 1975, saying
she felt some of the figures to be way off in regard to the optimum carrying
capacity of Williston Road.
Mr. Levering said he was impressed by the additional volume the traffic ex-
perts said Williston Road would be able to take; they were told by the experts
that if they wished to hire them they could fix the traffic problem.
Chairman Wessel recommended deferring the traffic discussion until the next
meeting when Mr. Mitchell would be there.
Mr. Wessel then recommended using the new set of criteria and running through
again the consideration under 1-a as it concerned the whole area.
Discussion then took place on whether the classification considered inappro-
priate for the Lamplough property was equally inappropriate for the whole
triangle.
Mrs. Krapcho felt the suggested 20-80 split would essentially bring total
commercial to the area that borders on Patchen Road because the 20% is optional.
Mrs. Maher felt the land to be good for a mix of commercial and residential,
doesn't have to be 100% either way, and should be a more flexible zone.

The concrete sidewalk along the Williston Road frontage is
continuous across the entrances. Plan shows it does not exist.
This sidewalk shall remain as is.
GREEN TREE PARK - LOT 11 - GREGORY DRIVE
1. A lot of fill was placed on the lot last fall especially in the
southern part of the proposed building.
2. Depressed concrete curbs shall be constructed at new entrance
drives.
3. Concrete sidewalk at entrances shall be 8 inches in thickness.
POMERLEAU DEVELOPMENT - BARTLETT BAY ROAD & SHELBURNE ROAD
1. The City has a sewer easement along the westerly lot line
(along railroad track) this should be shown on the plan.

Mr. Ward told the Planning Commission that Mr. Mitchell had submitted his
verbal resignation to the City Manager on Friday but no formal letter of
resignation had been received because Mr. Mitchell had been called away
because of serious illness in the family. Mr. Ward said he believed the
resignation was to take effect in a month.
Subdivision hearing of Willis property, Shunpike Road
Mr. Ward distributed copies of a drawing of the property in question, and
explained the only lots to be created as new ones would be the homestead
lot, the barn and shed lot, and the 18 acre piece to the rear of that lot
which has been identified as #5. Lot #6 is under option to GBIC;#7 is across
the road with no plans for that piece in the immediate future. The property
lies in three different zones, R-4, inddstrial, and the Conservation District.
Also Muddy Brook and Potash Brook are involved.
Mr. Ward stated the City Engineer has no problems with what is being proposed
right now.
Mrs. Krapcho asked about the road coming in from Williston Road, if the 50-
foot right of way could be extended to 60 feet.
Mr. Ward said the City would rather have a 60-foot right of way when talking
about deeding a new road to the City, but in this case the road is already
existing and has been deeded.
Mr. Wessel agreed that the Planning Commission couldn't go back and do it all
over again.
Mr. Ewing asked about the shed being on the abutting property line, and Mr.
Ward said Mr. Willis owns both sides, that the barn and shed are in the R-4
( District, the only way the barn could be used under the existing zone would
be if someone wanted to live in it.
Asked by Mr. Wessel to explain the subdivision further, Mr. Ward said the
subdivision has to be approved or Mr. Willis cannot deed the land. He said
GBIC has had some different thoughts and when Mr. Willis goes to Act 250
GBIC is going to ask for a deferral until such time as they are ready to
develop, but he understands they still want to exercise the option as far as
the Willis farm is concerned. He had hoped that Harry Behney would attend
this meeting.
Chairman Wessel asked about drainage ways and how the number of bridges
could be minimized.
Mr. Willis said the road is where it is so that it will line up topographically
as best suited for placement, and they had tried to get the best possible lay-
out of the road.
Mrs. Maher explained t t approving it as shown does not commit the Commission
to the right-of-way , g is shown because in the end the engineers have to
approve it.
Mr. Wa¢d said the basic reason for the Willis subdivision is to allow the
okchange of land between Mr. Willis and GBIC. There has been some discussion
about dividing the 30 acre piece and possibly the 18 acre piece in the future.
Mrs. Krapcho asked if the Commission would see the plan again after the final
position of the road was approved.
Mr. Ward replied the Commission would see it with the GBIC subdivision, that
this is a subdivision by the Commission's standards but Mr. Willis has no
development thoughts on it at all; that was why he had hoped to have the GBIC
(` representative there.
PLANNING COMMISSION MAY 13, 1975
Mrs. Krapcho asked if the Planning Commission would see another plan of
Mr. Willis's subdivision showing the precise location of the new road.
Mr. Ward said details such as road, water, sewer, etc. will all come later,
that this is a preliminary plan for a subdivision of the Willis farm.
Mrs. Maher moved that the Planning Commission approve the proposed subdivision
of the Willis property as shown on their plan dated 475 which indicates that
the land is zoned into three districts, some lots R-4, and some industrial,
and the remainder Conservation district.
Seconded by M. Levesque.
Motion approved unanimously.
Discussion on Lamplough proper
Chairman Wessel said he would like to continue by partitioning the discussion
into two sections, but if the other members want to do it differently he
would go along with their wishes.
Mrs. Maher said she felt they should discuss the entire triangle.
Mr. Ellis proposed continuing the discussion of last week with respect to
the Lamplough property, but extend it to the whole property under 1-a and 1-b.
Attention was called to the new revised format prepared by the City Planner
to replace the check list which had been used at the last meeting.
Mrs. Krapcho said the issue was really whether there was a need to change
the adjoining property, that the Commission should be looking at the larger
land use. She said she did not agree that all the parcels within the triangle
should be zoned the same way, or that the same land use would be found.
Mr. Wessel asked if they wished to do the 'whole triangle first for land use,
with the findings to be based on that.
Mr. Ellis said he felt that point 2 would need a discussion of zone, but
Mrs. Krapcho disagreed with that.
Mrs. Maher, referring to the Kinutes of May 6, asked if Mr. Hall and Mr.
Towne had been contacted to be present at this meeting, and also asked about
traffic figures to be supplied by the developer.
Mr. Levering said he had only dealt with marketing information as contained in
his letter of May 12 to the City Planner. Mr. Lamphere was to be responsible
for the first six questions asked by the Planner and this had been taken care
of by a letter from Mr. Lamphere to Mr. Mitchell.
It was assumed by the Commission that Mr. Mitchell had been called away before
receiving Mr. Lamphere's communication, or before he had time to do anything
with it, as copies had not been given to the Commission.
Mrs. Maher referred to the memo from Mr. Mitchell dated May 6, 19?5, saying
she felt some of the figures to be way off in regard to the optimum carrying
capacity of Williston Road.
Mr. Levering said he was impressed by'the additional volume the traffic ex-
perts said Williston Road would be able to takei they were told by the experts
that if they wished to hire them they could fix the traffic problem.
Chairman Wessel recommended deferring the traffic discussion until the next
meeting when Mr. Mitchell would be there.
Mr. Wessel then recommended using the new set of criteria and running through
again the consideration under 1-a as it concerned the whole area.
Discussion then took place on whether the classification considered inappro-
priate for the Lamplough property was equally inappropriate for the whole
triangle.
Mrs. Krapcho felt the suggested 20-80 split would essentially bring total
commercial to the area that borders on Patchen Road because the 20% is optional.
Mrs. Maher felt the land to be good for a mix of commercial and residential,
doesn't have to be 100% either way, and should be a more flexible zone.

The parcel in question contains approximately 174 acres
located at the southerly end of Shunpike Road. With the exception
of a strip of land located on the easterly side and to a depth
of 100 feet, the entire parcel is in the Industrial District.
The homestead and large barn (100' depth) are zoned in the R-4
District. Note that lots 1, 2, 3 and 4 are in two different
districts. Lots 3 and 4 as shown are developed, containing
the Willis homestead and out -buildings.
A 10.1 acre parcel as shown (property of Dr. H. P. Brown)
has been set off for agricultural purposes.
Lot 5, containing 18.1 acres, is within the area proposed
for a new road and will front thereon.
Lot 6, containing 110 acres, is to be purchased by G.B.I.C.
Lot 7, a remaining parcel adjacent to the homestead, contains
30 plus acres with no development planned at this time.
With the exception of lot 5 all lots are existing lots.
The area 100 feet from the center line of Muddy Brook along
the easterly boundary (Williston -South Burlington town line) is
zoned C.O. District. The area 100 feet from the center of Potash
Brook on the western boundary is zoned C.O. District.
Soil conditions:
Lot 6: Vergennes clay, 2% to 6% slopes.
Lot 7: Adams & Windsor loamy sands 0% to 5% slopes.
Lots 1, 2, 3, 4 and 5, mixed soils, Adams and Windsor loamy
sands, Hinesburg fine sands and Belgrade and Eldridge soils.
Lot 6 will be subdivided by G.B.I.C. under a different plan.
The general character of the area has been agricultural with
single family dwellings on both the east and west side of Shunpike
Road.

Listed below for your consideration are my comments con-
cerning the proposed subdivision.
1- The Sn i S in the pro -posed ubuiv�lUlare Of Vdr1o15�i
types. The most expensive association, Vergennes
clay, is located on Lot 6. The applicant states
that it is proposed to use the existing municipal
sewer and water system, therefore, I do not foresee
any environmental problems arising from the use
of the clay soil for development purposes.
2- The topography of the site at its highest elevation
is approximatelY3601 near Shunpike Road and drops
down to approximately 3201 on the western edge.
Overall the site is fairly level with the most
pronounced slope of over 12 percent occurring in
close association with the proposed road. I can
foresee no topographic constraints for any proposed
development.
3- The purpose and intended use of the subdivision for
industrial sites is in conformance with the goals
and objectives of the Master Plan.
I-- The dedication of the 601 right-of-way is in con-
formance with the subdivision regulations.
5- The proposed layout of the dedicated right-of-way
should be checked by the City Engineer with respect
to its location and alignment with the proposed
industrial park access road.
6- Because of the larger size of lots 5, 6 and 7 these
will probably be further subdivided for industrial
uses in the future.
7- An assessment of the impact on the surrounding areas
is difficult to make at this time because we are
looking not at any specific development proposed,
but rather at a 7 lot division. Some general

comments, however, can be made concerning general industrial
utilization of the land and its effects on the surrounding
area.
The one concern that I have is with respect to the
residential cluster existing along Shunpike.Road. Increased
traffic, especially truck traffic would undoubtedly impact
this area. The implementation of the proposed access road
and its utilization as the main road into the park would
diminish the impact on this area.
The area is largely open and rural in character and has
an airport approach cone to the west of the site. Since no
other development has occured in the area, other than the
residential structures, I can foresee no detrimental
effect resulting from the ultimate implementation of industrial
activities. Transportation considerations can be worked out
with the implementation of the access road_

Nir. Ward told the Planning Commission that Mr. '".itchell had submitted his
verbal resignation to the City Manager on Friday but no formal letter of
resignation had been received because Mr. Mitchell had been called away
because of serious illness in the family. Mr. Ward said he believed the
resignation was to take effect in a month.
Subdivision hearing of Willis property, Shunpike Road
Mr. Ward distributed copies of a drawing of the property in question, and
explained the only lots to be created as new ones would be the homestead
lot, the barn and shed lot, and the 18 acre piece to the rear of that lot
which has been identified as #5. Lot #6 is under option to GBIC;#'T is across
the road with no plans for that piece in the immediate future. The property
lies in three different zones, R-4, indtistrial, and the Conservation District.
Also Muddy Brook and Potash Brook are involved.
Mr. Tigard stated the City Engineer has no problems with what is being proposed
right now.

foot right of way could be extended to 60 feet.
Mr. Ward said the City would rather have a 60-foot right of way when talking
about deeding a new road to the City, but in this case the road is already
existing and has been deeded.
Mr. Wessel agreed that the Planning Commission couldn't go back and do it all
over again.
Mr. Ewing asked about the shed being on the abutting property line, and Mr.
Ward said Mr. Willis owns both sides, that the barn and shed are in the R-4
District, the only way the barn could be used under the existing zone would
be if someone wanted to live in it.
Asked by Mr. Wessel to explain the subdivision further, Mr. Ward said the
subdivision has to be approved or Mr. Willis cannot deed the land. He said
GBIC has had some different thoughts and when Mr. Willis goes to Act 250
GBIC is going to ask for a deferral until such time as they are ready to
develop, but he understands they still want to exercise the option as far as
the Willis farm is concerned. He had hoped that Harry Behney would attend
this meeting.
Chairman Wessel asked about drainage ways and how the number of bridges
could be minimized.
Mr. Willis said the road is where it is so that it will line up topographically
as best suited for placement, and they had tried to get the best possible lay-
out of the road.
Mrs. Maher explained t t approving it as shown does not commit the Commission
to the ri ht-of-waeXas g y � is shown, because in the end the engineers have to
approve it.
Mr. Ward said the basic reason for the Willis subdivision is to allow the
etchange of land between Mr. Willis and GBIC. There has been some discussion
about dividing the 30 acre piece and possibly the 18 acre piece in the future.
Mrs. Krapcho asked if the Commission would see the plan again after the final
position of the road was approved.
Mr. Ward replied the Commission would see it with the GBIC subdivision, that
this is a subdivision by the Commission's standards but Mr. Willis has no
development thoughts on it at all; that was why he had hoped to have the GBIC
representative there.

Mrs. Krapcho asked if the Planning Commission would see another plan of
Mr. Willis's subdivision showing the precise location of the new road.
Mr. Ward said details such as road, water, sewer, etc. will all come later,
that this is a preliminary plan for a subdivision of the Willis farm.
Mrs. Maher moved that the Planning Commission approve the proposed subdivision
of the Willis property as shown_ on their plan dated 4 75 which indicates that
the land is zoned into three districts, some lots R-4, and some industrial,
and the remainder Conservation district.
Seconded by Mr. Levesque.
Motion approved unanimously.
Discussion on Lamplougt proper
Chairman Wessel said he would like to continue by partitioning the discussion
into two sections, but if the other members want to do it differently he
would go along with their wishes.
Mrs. Maher said she felt they should discuss the entire triangle.
Mr. Ellis proposed continuing the discussion of last wP.Pk wi*h
the Lamplough property, but extend it to the whole property under 1-a and 1-b.
Attention was called to the new revised format prepared by the City Planner
to replace the check list which had been used at the last meeting.
Mrs. Krapcho said the issue was really whether there was a need to change
the adjoining property, that the Commission should be looking at the larger
land use. She said she did not agree that all the parcels within the triangle
should be zoned the same way, or that the same land use would be found.
Mr. Wessel asked if they wished to do the whole triangle first for land use,
with the findings to be based on that.
Mr. Ellis said he felt that point 2 would need a discussion of zone, but
Mrs. Krapcho disagreed with that.
Mrs. Maher, referring to the Minutes of May 6, asked if Mr. Hall and Mr.
Towne had been contacted to be present at this meeting, and also asked about
traffic figures to be supplied by the developer.
Mr. Levering said he had only dealt with marketing information as contained in
his letter of May 12 to the City Planner. Mr. Lamphere was to be responsible
for the first six questions asked by the Planner and this had been taken care
of by a letter from Mr. Lamphere to Mr. Mitchell.
It was assumed by the Commission that Mr. Mitchell had been called away before
receiving Mr. Lamphere's communication, or before he had time to do anything
with it, as copies had not been given to the Commission.
Mrs. Maher referred to the memo from Mr. Mitchell dated May 6, 1975, saying
she felt some of the figures to be way off in regard to the optimum carrying
capacity of Williston Road.
Mr. Levering said he was impressed by the additional volume the traffic ex-
perts said Williston Road would be able to take; they were told by the experts
that if they wished to hire them they could fix the traffic problem.
Chairman Wessel recommended deferring the traffic discussion until the next
meeting when Mr. Mitchell would be there.
Mr. Wessel then recommended using the new set of criteria and running through
again the consideration under 1-a as it concerned the whole area.
Discussion then took place on whether the classification considered inappro-
priate for the Lamplough property was equally inappropriate for the whole
triangle.
Mrs. Krapcho felt the suggested 20-80 split would essentially bring total
commercial to the area that borders on Patchen Road because the 20% is optional.
Mrs. Maher felt the land to be good for a mix of commercial and residential,
doesn't have to be 100% either way, and should be a more flexible zone.
