Re: Findings of Fact, site plan application of Beverly F. Willis for reapproval of a seven (7) lot subdivision
plat originally approved on 5/13/75, Kimball Avenue and Shunpike Road.
On the 23id day of June, 1998 the South Burlington Planning Commission approved the request of Beverly
Willis for final plat approval under Section 204 of the South Burlington Subdivision Regulations based on
the following findings:
1. This project consists of the reapproval of a seven (7) lot subdivision plat approved on 5/13/75. The
approved plat was not endorsed in writing by the Planning Commission and was recorded on November 14,
1975. Consequently, the approved plat was not recorded within the 90 days mandated by State Statutes. The
purpose of this application is to legitimize the recorded plat to cure any question regarding the lawful existence
of these lots within the subdivision that have the same boundaries as shown on the 1975 plat. The sketch plan
was reviewed on 5/26/98.
2. Once this plat is approved, the Chairman should sign and stamp the recorded plat and a legal document
should be recorded which describes the Commission's action.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat
application of Beverly Willis for the reapproval of a seven (7) lot subdivision plat approved on 5/13/75,
Kimball Avenue, as depicted on a plat entitled, "Proposed Subdivision for Laurence H. Willis So. Burlington,
Vermont," prepared by Willis Engineering Associates, Inc., dated 10/2/75. This approval is to officially
approve the plat recorded in map volume 105, page 39 of the South Burlington Land Records subject to the
following stipulation:
1. The Chair or Clerk of the Planning Commission shall stamp and sign the plat recorded in map volume 105,
page 39 of the South Burlington Land Records within 90 days or this approval is null and void. Prior to the
Chair or Clerk of the Planning Commission stamping and signing the recorded plat, a legal document shall be
recorded which explains the Planning Commission's action regarding this approval. This legal document shall
be approve by the City Attorney prior to recording.
