HomeMy WebLinkAboutVR-96-0000 - Decision - 0036 Sherry RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 25th day of March, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of William and Pamela Foley, 36 Sherry Road. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findinas of Fact 1) The area in question is zoned R-4 District. 2) Section 25.00 Dimensional requirements requires a minimum front yard of thirty (30) feet. 3) The applicant is requesting a waiver to twelve (12) feet. A proposed 16 x 19' deck will be constructed to within eighteen ! (18) feet of the front yard. 4) The property is developed with a 20'x 40' single family dwelling. The existing setback being thirty-four (34) feet. 5) The lot contains 70 feet of frontage and 120 feet of depth. Conclusion 1) The property was developed seventeen (17) years ago. 2) The deck is designed to provide access to elderly parents. Present front steps are difficult to access due to narrow steps. 3) The deck is designed to use existing walkway in same location. 4) The proposed deck is twelve (12) feet wide and steps are four (4) feet wide. 5) The lot size restricts reasonable use of a deck or porch without a variance to front or side of structure. 6) Addition will enhance the property.
