HomeMy WebLinkAboutVR-95-0000 - Decision - 0019 Sherry RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 23rd day of October 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Jonathan & Suan McLean, 19 Sherry Road. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) Area in question zoned R-4 District. 2) Section 25.00 Area, density and dimensional requirements required a minimum side yard of ten (10) feet and a rear yard of thirty (30) feet. 3) Section 3.10 Boundaries Conservation/Open Space District, minor streams fifty (50) foot set -back from centerline of stream. 4) Existing land development, 24'x 34' single family, one story dwelling. 5) Lot size 75'x 92' approximately 7000 square feet. 6) Proposed addition 24'x 30' two story attached garage with 720 square feet of living area. Conclusion 1) Existing dwelling cement block construction. Structure will not support a second story addition. 2) Structure has no basement, additional living area must involve an addition. 3) Applicant's desire to stay in neighborhood and needs additional living area. 4) Existing house is smallest within the Sherry Road neighborhood. 5) Hardship not created by applicant, property developed in 1950's. 6) Similar additions within neighborhood, proposed addition would not affect the character of the area. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to construct a 241x 30' two story attached garage with 720 square feet of living area, loca�e t 1 ad.
