DECISION AND FINDING OF FACT
On the 24th day of March, 1997, the South Burlington Zoning Board
of Adjustment heard testimony regarding a variance application of
Charles DesLauriers for 8/34 Sherry Road.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findinas of Fact
1) The area in question zoned R-4 District.
2) Section 25.00 Area, density & dimensional requirements.
Minimum lot size 9500 square feet and 80 foot frontage.
Maximum density four (4) units per acre.
3) The land in question is part of the Glendale Park subdivision
approved and developed in the 1950's.
4) Parcel in question contains 17,572 square feet with 146.3 feet
of frontage. Proposed subdivision creates two (2) lots
containing 8,786 square feet per lot with 73.1 feet of
frontage.
Conclusion
1) Glendale Park developed with similar size lot (average lot
size 70'x 120').
2) Hardship created by others, entire area developed by others,
land in question owned by appellant's family in the 1950's.
3) Hardship created by recent court ruling dealing with merger of
existing small lots.
4) Creation of one lot and developed with a duplex would affect
the general character of the area, single family more in
keeping with the neighborhood.
5) Re -construction of Dorset Street (installation of new drainage
system) provides for a better use of the land in question.

6) Drainage to adjoining properties should improve. Surface
drainage will be properly engineered.
Based upon the findings and conclusion setforth above, the Zoning
Board of Adjustme hereby grants the applicant request to
subdivide a lot in o wo single family lots located at between 8/34
Sherry Road. A
