It was found by the Agency of Natural Resources that this conditional use will not result in any undue, adverse effects to the protected functions of the significant wetland located at 2383 Shelburne Road in South Burlington, Vermont. Description of soils in the wetland and buffer zone (from Soil Conservation Service soil surveys or site investigations): The soils in the wetland are poorly drained silty clay loam. They have been somewhat disturbed in the past, with a scattering of fill from shallow drainage ditches that were cut through the wetland. The buffer soils are ditch spoil from a larger ditch dug along the eastern edge of the parking lot that was likely cast onto the wetland many years ago. Part of the buffer zone is also comprised of fill soils at the northern edge of the existing parking lot. e. Check the characteristics of the wetland which apply: flooded most of the time standing water during at least part of the growing season water impounded by beavers ✓ soils are saturated during at least part of the growing season dry most of the year f. Description of buffer zone: The buffer zone is made up of ditch spoil and fill at the edge of a parking lot. The part of the buffer zone that will be impacted by the proposed project is primarily mowed lawn along the northern edge of the existing parking lot. 13. Describe in detail all work that is proposed within the wetland or buffer zone, including erosion control measures referencing attached plans where appropriate. The project includes the construction of a 108 square foot concrete pad to support three utility cabinets for the antennas. This concrete pad will be placed on a gravel area of approximately 300 square feet (20 by 15 feet). Additional support apparatus such as an electrical transformer and telephone pedestal will be installed adjacent to this area. Electrical cable will be buried in a trench from the edge of U.S. Route 7 to the electrical transformer. A twelve foot wide by approximately 70 foot long driveway will be constructed to provide access to the site for periodic maintenance and repair. Erosion control will be achieved by the use of standard erosion control practices including the mulching of all exposed soils as soon as the construction is completed. We propose to allow the native vegetation to revegetate the site, instead of attempting to introduce new plantings into this area. The work area will be kept to the minimal size necessary to complete the installation work. The proposed improvements to the site are shown on the attached Site Plan. 14. Before this section is completed it will be necessary to determine for which functions the wetland in question is significant. The functional criteria for evaluating a wetland's significance are described in Section 5 of the Vermont Wetlands Rules. The Vermont Wetland Evaluation form is available through the Wetlands Office to help determine which functions may be significant. Demonstrate how the project as proposed will avoid any adverse impacts on each of the functions. Refer to plans and other attached documents as necessary. Note: Where "N/A" is provided beside a listed function, it means that the function is not provided by the wetland in the project area, therefore, the project will not have any adverse impact to the listed function. a. Water storage for flood water and storm runoff: N/A b. Surface and ground water protection: The wetlands at this site provide the function of surface and groundwater protection. This function is provided primarily through the filtering of surface water flow through the dense vegetation in this wetland. As the water flows slowly through the vegetation, silt is deposited on the ground surface and on the plant stems, and excess nutrients are removed from the infiltrating water by root uptake. To minimize the potential for adverse impacts to this function, silt fences will be installed prior to construction around the edges of the work area to retain silt and to minimize damage by excessive equipment travel adjacent to the work area. Demonstrate by narrative and reference to plans that the following mitigation measures have been used to achieve no undue adverse impacts to the protected wetland functions. a. Can the proposed activity practicably be located on an upland portion of the site or on another site owned, controlled or available to satisfy the basic project purpose? (Explain): No. The site itself is virtually all wetland with the exception of a narrow deposit of ditch spoil that is not large enough to support the equipment needed for the project. This particular site is needed to satisfy the requirements of this project, as described in the attached letters, previously provided to the wetlands office as requested by Ms. April Moulaert. b. Demonstrate how all practicable measures have been taken to avoid or minimize adverse impacts on protected functions, including project redesign or project scale back. As the attached letters describe, this project has been planned to minimize wetland impacts while at the same time attempting to meet the stringent siting and engineering requirements for successful construction of this type of communications antenna. The project team has carefully evaluated the potential for using other sites and for redesigning the work at this site, and for many reasons has concluded that the proposed location and configuration of equipment is the best balance for minimizing environmental impacts and for achieving the goals of the project. This project proposes only approximately 1,500 square feet of wetland impact, in a wetland that is within a power line right-of-way, which means that the wetland vegetation is managed on an ongoing basis to maintain the right-of- way. C. For wetlands that have been disturbed, what steps will be taken to restore impacted functions (e.g. plantings, seeding, mulching exposed soil, removal of fill, etc.) Any areas of temporary disturbance will be regraded to restore original grades and mulched with clean straw. Topsoil will be stockpiled separately and replaced to promote rapid reestablishment of vegetation from existing root material. If surficial soil material must be scraped to prepare the area for the gravel and concrete pads and the driveway, the excess soil will be removed from the site and disposed at an upland location. It will not be pushed into wetland or buffer areas on the site. 16. Wetland compensation (creating replacement wetlands) is a measure to mitigate adverse impacts on protected functions that will only be possible in rare cases for specific functions (see Section 8.5c of the Vermont Wetland Rules). If a compensation plan is part of this proposal, demonstrate by narrative and reference to plans how the steps in Section 8.5c (1) - (7) will be met. This project encroaches approximately 65 feet beyond an existing parking lot into a wetland that is within an existing power line right-of-way. The total proposed wetland impact is only approximately 1,500 square feet (0.034 acres). A drainage ditch and its spoil occupy a significant portion of this site, and an eighty-three foot tall utility power is currently located within the project area. We believe that this project will not result in an undue adverse impact to the wetlands or wetland functions in this area. Therefore, we do not propose any compensatory measures as part of this Conditional Use Determination Application. DISTRIBUTION 17. Submit the original request for conditional use determnation to the Wetlands Office, Division of Water Quality, 103 South Main Street, 10 North, 2nd Floor, Waterbury, Vermont 05671-0408. Notification of receipt will be sent to the applicant once a complete application has been received by the Wetlands Office. 18. After receiving notification of completeness from the Wetlands Office, send a complete copy of the application to the Town Clerk and Regional Planning Commission. Ms. Moulaert: As the Site Acquisition Specialist for IWO, I have been instructed to locate sites that take advantage of existing structures, thereby eliminating the need to build new towers. There are few areas in the country where wireless carriers are working cooperatively with utility companies, and this is an excellent opportunity to make the most efficient use of existing utility towers The ultimate necessity for a Sprint PCS antenna site is to be above the tree line, in a line of sight with the objective coverage area. To provide coverage to Route 7 north and south in Shelburne and South Burlington, the ideal candidate would be the Velco pole on the west side of Shelburne Road. However, this pole sits very close to the 2-lane Route 7. Our installation might jeopardize any future plans to widen the road, and the proximity to passing cars might pose a threat to IWO's equipment. Also, the City of South Burlington has strict visual impact regulations on proposed facilities on the west side of the road, in order to protect the Lake Champlain view -shed. From a radio -frequency coverage perspective, the next best candidate is Velco Pole # 48. There are no other existing structures in the area that provide the necessary elevation. It is my opinion that the Velco Tower # 48 provides an excellent opportunity for a minimally obtrusive antenna application because it is off the road a fair distance and is obstructed from the road's view by buildings and trees. Furthermore, by placing the equipment as close as possible to the base of the tower, visual impact will be minimized. If you have any questions, please don't hesitate to call me. Moulaert, PWS - District Wetlands Ecologist RE: WO #: 2916.449C IWO Site #: NE43XC449C VELCO Transmission Line Tower #48 Building Roof Top Structural Analysis Dear April: July 23 2001 Independent Wireless One (IWO) has contracted Tectonic Engineering Consultants, P.C. and Pyramid Site Acquisition Services to perform the required engineering and leasing services respectively, for the permitting and construction of the subject telecommunication site. The objective of this search ring was to provide telecommunication coverage along Route 7 (North into South Burlington and South into Shelburne). After extensive market research, Pyramid Site has exhausted all other possible candidates in the nearby vicinity. As a last resort and in order to comply with our client's requirements, Pyramid Site has concluded that the subject tower will provide a strategic vantage point for the IWO Vermont telecommunication build. Throughout the past four (4) months, Pyramid Site and Tectonic Engineering have performed numerous visits to the subject site to determine the most practical and feasible telecommunication design. IWO has selected a standard three (3) cabinet ground mounted base station configuration. This equipment is typically mounted on a concrete pad place on grade. A separate power protection cabinet is installed on a ground -mounted support post adjacent to the concrete pad. Coaxial cables connect the base station equipment to telecommunication antennas mounted at the top of the subject pole. A 15' x 20' fence surrounds the IWO ground equipment. Draft Draft Equipment power and telephone requirements are provide by local utility companies. Underground and/or overhead wires are used, on a site -by -site basis, to connect the IWO equipment with the utility source. The base of the tower is located in a wetland area and is approximately 40 feet from the edge of a parking lot for a nearby dry cleaning business. The closest power and telephone source is located on a utility pole adjacent to Route 7. In order to minimize potential wetland impacts, we have engineered numerous base station equipment locations. Below are possible scenarios. - Equipment located in the parking lot or closer to the dry cleaners: a. Added coaxial cable length between base equipment and tower would require larger diameter cables and an extensive cable bridge. This cable bridge would require multiple support posts (approximately 6 — 8) installed into the wetland area- b. Since the coaxial cables will be connected to antennas, they will need to be mounted to the tower. The use of larger diameter cables will increase the overall stress on the tower. The tower may need to undergo significant structural modifications to support the added weight. A larger base width tower and/or sub -grade foundation may be required. c. Overall 15' x 20' equipment compound would take away from the business parking spaces and be in direct view of the public. d. The parking lot does not provide a practical means to route utilities. Pavement will need to be removed in select locations to route the utilities underground, while the use of overhead utilities may interfere with existing overhead wires and foliage. 2. Equipment located at the base of the tower: a. Coaxial cable length would be at a minimum. Smaller cables will significantly reduce additional tower stress and overall cable bridge length. Only one cable bridge support post will need to be installed into the ground. b. The concrete pad, used to mount the base station equipment, will be placed on gravel sub -base. Approximately 110 square feet of gravel sub- base will be required. c. A 12' wide gravel access drive will be installed between the parking lot and IWO equipment compound. An existing culvert near the edge of the parking lot will be lot to facilitate the proposed 12' wide access drive. Approximately 250 square feet of gravel access drive will be required. Draft Draft Based on the scenarios presented above, we recommend locating the IWO equipment compound at the base of the tower in lieu of the parking lot. This location will minimize wetland, aesthetic, and cost while maximizing the effectiveness of the subject telecommunication equipment. Further more, it is our opinion, that by locating the equipment at the base of the tower, the risk of significant tower and IWO equipment modification is drastically reduced. This project includes the construction of an approximately 70 foot long driveway to access a site that will be developed to support equipment and utilities necessary for the operation of cellular communication antennae that will be installed on the existing utility tower. There will be no buildings, sewage disposal, human occupancy or other intensive uses of the site. The project includes the construction of a 108 square foot concrete pad to support three utility cabinets for the antennas. This concrete pad will be placed on a gravel area of approximately 300 square feet (20 by 15 feet). Additional support apparatus such as an electrical transformer and telephone pedestal will be installed adjacent to this area. Electrical cable will be buried in a trench from the edge of U.S. Route 7 to the electrical transformer. A twelve foot wide by approximately 70 foot long driveway will be constructed to provide access to the site for periodic maintenance and repair. The wetlands in this area occupy approximately 5 acres (This area appears to have been larger in years past, but filling from residential and commercial activities surrounding this wetland has reduced it to its present size.), predominantly surrounded by developed land. A multi -unit residential housing complex is located south of the wetland, a soft drink bottling and/or distribution facility is located to the east and northeast, a paved parking lot for a dry cleaner is immediately west of the wetland, and a road is located north of the wetland. A small wooded area separates the wetland from the road to the north. The total proposed wetland impact is approximately 1,500 square feet (0.034 acres). The impact area is located immediately east of the paved parking lot for the dry cleaner. Most of this wetland is within the VELCO right-of-way. The vegetation is periodically cut or managed with herbicides, further removing the wetland from its natural state. The area that will be included in this project is essentially all wetland, with the exception of a small area that was filled when ditching of the area was completed. It appears that the ditching work occurred at least 20 years ago. The main ditch runs along the west edge of the wetland, separating it from the paved parking lot. A smaller lateral ditch can be seen running through the wetland diagonally from the main ditch. The dominant vegetation in the project area includes dogwood, several sedge species, cattails, sensitive fern, willow species, goldenrod species, and horsetail. The soils in the wetland are poorly drained silty clay loam. They have been somewhat disturbed in the past, with a scattering of fill from shallow drainage ditches that were cut through the wetland. The buffer soils are ditch spoil from a larger ditch dug along the eastern edge of the parking lot that was likely cast Wetland Evaluation Report - VELCO Pole #48, South Burlington, Vermont November 2001 Wheeler Environmental Services Page 2 onto the wetland many years ago. Part of the buffer zone is also comprised of fill soils at the northern edge of the existing parking lot. The wetlands at this site likely provide two functions. One function is that of surface and groundwater protection. This function is provided primarily through the filtering of surface water flow through the dense vegetation in this wetland. As the water flows slowly through the vegetation, silt is deposited on the ground surface and on the plant stems, and excess nutrients are removed from the infiltrating water by root uptake. The effectiveness of this function is reduced by the ditching that has occurred in this wetland. Channelization of the surface water flow into ditches reduces the opportunity for the wetland to filter sediments and excess nutrients. However, the urban development surrounding this wetland makes this fnnction more significant due to increased urban stormwater runoff that likely flows into this wetland. The second function is wildlife habitat, which is provided in those parts of the wetland that are more heavily vegetated by woody vegetation. A variety of bird species and small mammals likely utilize this wetland for foraging for food and for nesting. The vegetation in this area provides an area of cover that allows for protection and may also serve as a travel corridor. The immediate area of the project, where soils will actually be disturbed to construct the driveway and supporting utilities. does not provide these functions to the degree that other parts of the wetland do. This area is immediately adjacent to a large ditch, so water flow through this part of the wetland is mostly channelized. It is also adjacent to the paved parking lot and occupied by the existing utility tower, so wildlife habitat value is diminished to some degree. To minimize the potential for adverse impacts to the wetland surrounding the work area, silt fences will be installed, prior to construction, around the edges of the work area to retain silt and to minimize damage by excessive equipment travel adjacent to the work area. Since this area is already occupied by the existing utility tower and adjacent to the paved parking lot, and since the project will not increase the normal traffic of people or vehicles into this area, the limited function of wildlife habitat in the project area will not be reduced. The wildlife habitat provided by the larger wetland will not be adversely impacted because the project will not increase noise or human activities to an appreciable degree. Given that the wetland is currently located in an urban setting, the placement of these antennae and supporting structures will not substantially change the character of the site. Under Federal regulatory review, this impact is considered so small as to not require any notification to the regulatory agency (U.S. Anny Corps of Engineers) responsible for reviewing projects that impact wetlands. This project is approved without notice under the Vermont General Permit Category A. Based on the existing conditions of the wetland and surrounding area, and the limited scope of the proposed project, we do not believe that the project will result in any undue adverse impact on the wetland. Calculations are set forth in Table 2, which also compares worst -case RF power density at the location of a hypothetical IWO/Sprint PCS 'critical receptor' situated below the tower with applicable FCC limits on maximum allowable exposure. As scenarios 1 and 3 in Table 2 indicate, up to three 79010 transmitters operating simultaneously generate power densities within the FCC standard of 1.0 mW/cm2 as near as 5 cm below the antennas. The above scenarios assume the antennas are driven maximally, by 16-watt power sources, and that they transmit horizontally. In contrast, scenario 2 assumes that a single 79010 antenna transmits downward, toward the critical receptor. Power densities still remain within the allowable limit at a distance as close as 91 cm from the critical receptor. Finally, in scenario 4, from one to three 79010 units transmitting downward generate power densities within the allowable limit at a distance as close as 158 cm (5.2 feet) from the critical receptor. Setting The surrounding land use is Commercial. Within the study area, the topography ranges in elevation from approximately 100' AMSL (Above Mean Sea Level) to approximately 400' AMSL. Methodolo On May 10, 2001, Tectonic Engineering Consultants, P.C. conducted a field investigation for the purpose of evaluating the views associated with the proposed co - location installation. Conditions were sunny, approximately 70' with low winds. The study area consisted of a one (1) mile radius from the project site. Process: Photographs of the existing structure from the view points noted were taken with a 35mm Canon EOS camera using a 55mm focal length lens. Photographs that contain simulated views (#1, 5 & 10) of the proposed installation were produced by first photographing the existing power pole and then scanning the photos into digital images on a computer. Digital images of the site photos and the proposed equipment were then merged and manipulated through the use of the image editing software, "Adobe PhotoShop 6". With this process the installation is scaled to the correct size. The composite is printed out directly on a color printer, producing the final image. The simulations depicted in this report utilized white colored antennas. This is done strictly for illustration purposes. Conclusion: The proposed addition of Independent Wireless One's equipment on the existing 83' tall power pole at 2382 Shelburne Road, will not have a significant impact on the existing views of this structure. However, the City's public/private roadway policy requires a public roadway for roads serving; 4 or more separate lots. This subdivision would create the 5th lot. Additionally, the 7/28/87 approval for the 2 lots to the west stipulated when another lot is subdivided, the private road mustbe brought up to City standards and turned over to the Cit- . The property is adequately land- scaped. 7) SECTION 18.112L HEIGHT OF STRUCTURES Well, I have -.ken another stab at. this "Height of Structures" thing . Rs, y<:u l,:.iow, it has been difficult coming up with wording that addresses everything the Planning Commission wants to accom- plish and' at the same time covers all situations. There is always going to be a few cases where the existing topography or site conditions are a little screwy and, as a result, preclude the ordinance from adequately enforcing the desires of the City. So, how do we implement the desires of the City for all situa- tions? A major concern of mine is complexity and time. I do not want to see this regulation get so complex that it becomes very difficult to enforce and unnecessarily takes up a lot of staff time and resources.
