Site plan application of Stewart Ruth to operate 900 sq. ft. of an existing 4140 sq. ft. building as wholesale bakery use, 1880 Shelburne Rd. Mr. Ruth located his site as the back 1/4 of the building. Mr. Weith noted the plansmMt the requirements of both S. Burlington and Shelburne. He added the plan should show the location of the bakery. The loading dock should be removed from the plan. Ms. Peacock moved the Planning Commission approve the site plan application of Stewart Ruth for operation of a 900 sq. ft. bakery within a 4100 sq. ft. commercial building as depicted on a plan entitled "Greer's Drycleaner, Site Plan, Shelburne Vermont," pre- pared by Civil Engineerinq Associates, Inc. and dated November. 1984, last revised 1/3/85. with the followina stipulations: 1. The plan shall be revised prior to permit to show the following a) the portion of the building to be utilized_by the bakery. and b) the removal of the loadina ramp which neither exists currently nor will be constructed. 2. The rear parking and loadinq area, which is currently obstructed by a chain across the drive shall remain open at all times. 3. A revised plan addressinq the above stipulations shall be submitted to the City Planner for approval_ prior to issuance of a permit and/or occupancy _of_the building. 4. A building permit, if required, shall be obtained within 6 months or this approval_is__null and void. Mr. Burgess seconded. Motion passed unanimously. 7. Discussion of Section 18.112, "Height of Structures," of the 5outn buriingto Mr. Weith recommended measuring from the lowest point of precon- struction grade to the hiahest point of the building with the added provision that would allow the Zoning Board to approve as conditional use residential structures up to 45 ft. measured the same way. Other criteria must be met as well: utilization of topoqraphy and relation to other existing and proposed structures, not detracting from scenic views, allowing retention of additional green space to enhance appearance of the property. Members liked the proposal but wanted an addition that there be no 4 full story structures.
