Please be advised that the District Environmental Commission
has received a request to extend the construction completion
date on previously approved Land Use Permit #4CO588-1 to
February 28, 1991. The permit now requires that
construction be completed by February 28, 1989. This
permit specifically extends the construction completion date
for the previously approved 32 room and one apartment
addition with related parking, site improvements and
municipal water and sewer to the existing Lakeview Motel
located off of Route 7 in South Burlington, Vermont.
Any party can request that the commission hold a public
hearing on this proposal by notifying this office, Essex
Environmental Office, 111 West Street, Essex Junction,
Vermont not later than February 9, 1989. If no request for
a hearing is filed, the District Environmental Commission
will consider issuing a permit amendment extending the
construction completion date as requested by the permittee.

I am optimistic that we can increase the flow to the Bartletts Bay Sewage
treatment plant to allow John to proceed with at least part of his proposed
motel expansion. This of course is contingent upon approval of the state.
I have no objection of issuing him a permit to proceed with the construction
of the foundation only,this construction season if he wants to take that chance.

Enclosed please find a revised application form for application
#4CO588 filed by John Wycoff of 1860 Shelburne Road, South
Burlington, Vermont and Richard Farnham Associates of Box 149,
Hinesburg, Vermont for the construction of a 32 room and an
apartment addition with related parking, site improvements and
municipal water and sewer to the Lake View Motel located off
Route 7 in South Burlington, Vermont.
This revised application requests that the District Commission
issue partial findings under all criteria of 10 V.S.A., Sec.
6086 (a) with the exception of subcriterion 1 (B). This
application came to hearing before the District Commission on
June 13, 1984. This hearing was recessed pending the receipt of
additional information. All additional information has been
submitted with the exception of evidence of municipal treatment
plant capacity and a Certification of Compliance. On August 17,
1984 the District Administrator, Division of Protection, Agency
of Environmental Conservation, issued a Certification of Non-
compliance because the Bartletts Bay treatment plant does not
have the capacity available to service the sanitary wastes this
project will generate.
At the request of. the applicant the Commission continued the
hearing in recess while the applicants developed their position.
The applicants have now determined that the issuance of partial
findings would be in their best interest.
The Commission will grant the request for partial findings, if
no objection from any party is received by October 31, 1984.

This project, consisting of the addition of 32 rooms to the
Lakeview Motel, an existing 11 room motel located on U.S. Route 7
in South Burlington, Vermont with proposed increased municipal
water supply use and municipal sewage disposal does not comply
with the rules stated above for the following reasons:
(1) The Environmental Protection Rules, Chapter 4, Public
Buildings, states that adequate means of sewage disposal
shall be provided. Due to the lack of capacity at the
Bartletts Bay treatment plant, the project cannot be
approved by the Permits Section of the Agency of
Environmental Conservation at this time.

I. INTRODUCTION
On May 22, 1984 an application for an Act 250 permit was
filed by Richard Farnham Associates of Box 149, Hinesburg,
Vermont and John Wycoff of 1860 Shelburne Road, South
Burlington, Vermont for a project generally described as the
construction of a 32 room and apartment addition with related
parking, site improvements and municipal water and sewer to the
existing Lake View Motel located off of Route 7 in South
Burlington, Vermont. The tract of land consists of 1.4 acres
with 1.4 acres involved in the project area. The tract of land
and existing motel is owned by John Wycoff and the expansion is
to be completed by John Wycoff and Richard Farnham Associates.
Under Act 250, projects are reviewed based on the 10 criteria of
10 V.S.A., Sec. 6086 (a) 1-10. Before granting a permit, the
Board or District Commission must find that the project complies
with these criteria and is not detrimental to the public health,
safety or general welfare.
Decisions must be stated in the form of findings of fact and
conclusions of law. The facts we have relied upon are contained
in the documents on file identified as Exhibits #1 through #28,
and the evidence received at a hearing held on June 13, 1984.
At the end of the final hearing, the proceeding was
recessed pending submission of additional information.
On August 17, 1984 the District Administrator, Division of
Protection, Agency of Environmental Conservation issued a
Certification of Non -Compliance because the Bartletts Bay
Treatment Plant does not _ha_ve__capacity available to service the
sanitary wastes this project will generate. The Commission
informed the applicant that this would result in a denial of the
application by the Commission. At the request of the applicant
the Commission contflued.___th____hearing in recess while the
applicants developed their position. On October 17, 1984 the
Commission notified all parties that the applicant had submitted
a revised application which'requests that the District
Commission issue partial findings under all of the criteria of
10 V.S.A., Sec. 6086 (a) with the exception of subcriterion 1 (B).
Because no party entered any objection the Commission now issues
its partial findings in this case.

Parties to this application who attended the hearing are:
The Applicant by John W. Wycoff and Douglas Viehmann;
The Vermont Public Service Department by David Lamount.
The Entry of Appearance and Pre -Hearing Comments filed by
Dana Cole -Levesque, of the Agency of Environmental
Conservation were entered into the record.
In making the following findings, we have summarized the
statutory language of the 10 Criteria of 10 V.S.A., Sec.
6086 (a) .
SECTION 6086(a) (1) WATER AND AIR POLLUTION:
The Commission finds that this project will not result in undue
air or water pollution This finding depends on and is
supported by the findings noted under the subsections of this
criterion.
SECTION 6086(a) (1) AIR POLLUTION:
The Commission finds that this project will not result in undue
air pollution. This finding depends on and is supported by the
following:
1. There will be no process emissions, noxious odors or noise
pollution from this project (Exhibit #3).
2. The existing building will be continued to be heated
with an oil fired system. The new apartment, office
and motel rooms wi 11 be heated with gas fired units and
air conditioned with electric units (Exhibit #3 as
revised by #22 and #23)
3. Upon completion of this project there will be 47 parking
spaces installed on the project site which will not result
in undue air pollution (Exhibit #2 and #13).
SECTION 6086(a) (1) (A) HEADWATERS:
The Commission finds that this project is not in a headwaters
area as defined by this section because the project site is
located in an urban area and is presently developed (Exhibit
#3) .

SECTION 6086(a) (1) (C) WATER CONSERVATION:
The Commission finds that this project utilizes the best
available technology for water conservation in motel buildings.
The finding depends on and is supported by the following:
4. Water conserving plumbing fixtures including low -flush
toilets, flow -restricted faucets and low -flow showerheads
have been specified for these motel rooms (Exhibit #3 and
testimony of applicant) and the Commission will require that
the applicants maintain these fixtures.
SECTION 6086(a) (1) (D) FLOODWAYS
The Commission finds that this project will not be located in
any floodway or floodway fringe because there are no bodies of
water located within the vicinity of the project (Exhibit #3).
SECTION 6086(a) (1) (E) STREAMS:
The Commission finds that there are no streams located in the
vicinity of this project (Exhibit #3).
SECTION 6086(a) (1) (F) SHORELINES
The Commission finds that this project will not be located on
any shoreline.
SECTION 6086(a) (2&3) WATER AVAILABILITY & IMPACT ON
EXISTING SUPPLY:
The Commission finds that there is sufficient water available to
meet the needs of this project and that this project will not
place an unreasonable burden on an existing supply. This
finding depends on and is supported by the following:
5. This motel addition will utilize an additional 6,600 gallons
per day of water. The Commission accepts the letter from
the Foreman of the Shelburne Water Department (Exhibit #8)
as evidence that there is sufficient water available and
that the project will not restrict nor encumber present
users.

SECTION 6086(a) (4) SOIL EROSION & THE CAPACITY OF THE LAND
TO HOLD WATER:
The Commission finds that it must require additional measures
regarding soil erosion by condition to insure that undue erosion
should not result and that the land area to be covered by
pavement and buildings will not increase runoff significantly.
This finding depends on and is supported by the following:
6. The project site is sloped. The easterly slope of the
property will be cut away for the construction of a parking
lot as depicted on Exhibit #13.
7. Temporary soil erosion controls are depicted on Exhibit #13.
They consist of staked haybales and slope scarification.
8. Permanent erosion controls consist of seeding and mulching,
landscaping and the stormwater system (Exhibit #3).
9. The applicant has not specified the area in which excess cut
material will be placed. Therefore, the Commission will
require that the applicant receive approval for any
deposition area.
SECTION 6086(a) (5) TRANSPORTATION
The Commission finds that this motel addition will not cause
unreasonable congestion or unsafe conditions with respect to
transportation. This finding depends on and is supported by
the following:
10. Site distances at the access of the existing driveway
onto Route 7, which will be improved, are 2000 feet to the
north and 100 feet to the south. The design speed of
Route 7 is 40 miles per hour. The estimated traffic from
the motel, upon completion of the addition, will be 90
trips per day (Exhibit #5).
11. The 11 parking spaces are adequate for the demands of the
project (testimony of applicant).
SECTION 6086 (a) (6 & 7) EDUCATIONAL & MUNICIPAL SERVICES:
The Commission finds that this motel addition will not place
an unreasonable burden on the ability of the municipality to
provide educational, municipal or governmental services. This
finding depends on and is supported by the following:

12. The Commission finds that impact on educational services
does not apply to this project because occupancy of these
motel units will be daily and weekly rentals only (Exhibit
#5) .
13. The South Burlington Fire Chief and Police Chief have
stated that the services of their departments can be
provided to this project (Exhibits #5, #6 and #25). The
City of South Burlington has allocated this project
treatment plant capacity (Exhibit #7).
SECTION 6086(a) (8) AESTHETICS, SCENIC BEAUTY, HISTORIC
SITES & NATURAL AREAS:
The Commission finds that this motel addition will not have an
undue adverse effect on the scenic or natural beauty of the
area, aesthetics, historic sites, or rare and irreplaceable
natural areas. This finding depends on and is supported by
the following:
14. Historic sites, necessary wildlife habitat and rare and
irreplaceable natural areas will not be affected by this
project (Exhibit #5).
15. The project will be landscaped as outlined on Exhibit #14.
The applicants have agreed to continually maintain the
landscaping as approved. The South Burlington Planning
Commission has required that the applicant post a $13,000.
landscaping bond (Exhibit #4).
16. Exterior lighting will consist of pole mounted lights,
building mounted lights and soffit lighting. All pole and
building mounted fixtures will be downshielded. All
fixtures will have concealed light sources (Exhibit #3).
17. The exterior of the building additions will be constructed
as depicted on Exhibit #15 and will have white stained
clapboard, earth toned asphalt shingles, a building
overhang and shutters on the second story windows (Exhibit
#3 and #14 and testimony of applicant).
18. The sign will be located and constructed as outlined on
Exhibits #13 and #11 and will be lighted from ground
mounted lights except for the vacancy sign which will be
backlit (Exhibit #3 as revised by applicants' testimony).
The Commission will require that all lighting be directed
only onto the face of the sign and will prohibit
backlighting except for the "vacancy" sign item.

19. All power and utility service will be located underground
from the existing pole into the building (Exhibit #13).
SECTION6086(a) (9) CONFORMANCE WITH THE CAPABILITY &
DEVELOPMENT PLAN:
The Commission finds that this project conforms to the
capability and development plan. This finding depends on
and is supported by the findings noted under the
subsections of this criterion.
SECTION 6086(a) (9) (A) IMPACT OF GROWTH:
The Commission finds that the municipality will be able to
accommodate the total growth that will result from this
project. This finding depends on and is supported by the
following:
20. The City of South Burlington has identified no undue
burdens on any facilities or services, has allocated
treatment plant capacity and the Planning Commission has
approved the project (Exhibits #7 and #4).
SECTION 6086(a) (9) (B) PRIMARY AGRICULTURAL SOILS:
The Commission finds that the soils on this parcel cannot be
considered primary agricultural soils because this 1.4 acre
parcel is not of a size capable of supporting or contributing
to an economic agricultural operation.
SECTION 6086(a) (9) (C) FOREST AND SECONDARY AGRICULTURAL

The Commission finds that the soils on the site do not qualify
as forestry or secondary agricultural soils because this 1.4
acre parcel is not of a size capable of supporting or
contributing to a commercial forestry operation or an economic
agricultural operation.
SECTION 6086(a) (9) (D & E) EARTH RESOURCES & EXTRACTION
OF EARTH RESOURCES:
The Commission finds that, as no earth resources have been
identified on this site, this project does not involve the
interference with nor extraction of earth resources (Exhibit
#3) .

SECTION 6086(a) (9) (F) ENERGY CONSERVATION:
The Commission finds that the planning and design of the
motel addition reflects the principles of energy conservation
and incorporates the best available technology for the
efficient use or recovery of energy. This finding depends on
and is supported by the following:
21. The motel addition will be constructed with an insulation
"R" factor of at least R-22 in the walls and at least R-43
in the roof or cap. Additional measures to conserve
energy include double -glazed windows and insulated steel
exterior doors (Exhibit #3).
22. The motel addition will utilize individual gas fired
through wall units and will be air conditioned with
electric units (Exhibits #22 and #23).
SECTION 6086(a) (9) (H) COSTS OF SCATTERED DEVELOPMENT:
23. The Commission finds that this motel addition will be
constructed on a parcel which contains an existing motel.
SECTION 6086(a) (9) (J) PUBLIC UTILITY SERVICES:
The Commission finds that utility service is available to
this project, that an excessive or uneconomic demand will not
be placed on such facilities or services, and that the
provision of such services has been planned on the basis of a
projection of reasonable population increase and economic
growth as evidenced by the letter from Green Mountain Power
Corporation (Exhibit #26).
SECTION 6086(a) (9) (K) DEVELOPMENT AFFECTING PUBLIC
INVESTMENTS:
The Commission finds that this project will not unnecessarily
endanger the public investment or materially jeopardize
function of Vermont Route 7 or the Vermont Electric Power
Company right-of-way. The applicant has agreed to modify the
landscaping as requested in Exhibit #10 and the Commission
will incorporate such into a permit condition.
SECTION 6086(a) (9) (L) RURAL GROWTH AREAS:
The Commission finds that this project is not located in a
rural growth area as defined by the statute.

SECTION 6086(a) (10) CONFORMANCE WITH THE LOCAL OR
REGIONAL PLAN:
The Commission finds that this project conforms to the
local plan as evidenced by the letter from the South
Burlington Zoning Administrator (Exhibit #4).
CONSTRUCTION ON COMPLETION S& EXPIRATION DATES:
The applicant has requested that the Commission assign this
permit a thirty year expiration date, which will coincide with
the expected minimum useful life of this building and the
Commission will grant this request.
III. CONCLUSION OF LAW
Based upon the foregoing Partial Findings of Fact, it is the
conclusion of this District Environmental Commission that the
project described in the application referred to above, if
completed and maintained in conformance with all of the terms
and conditions of that application, will not cause or
result in a detriment to public health, safety or general
welfare under the criteria described in 10 V.S.A. SEC.6086
(a), with the exception of criteria 1 (B). The Commission
will offer the applicants a one year period in which to
meet their burden of proof with respect to this
subcriterion.
IV. ORDER
Based upon the foregoing Partial Findings of Fact and Conclusions
of Law, these Findings shall remain in effect until November
1985.

In response to your letter of June 13, John Wyckoff has made the
following decisions and we enclose all pertinent information.
The heating system will be individual gas fired through wall
units with electric air conditioning as described in the enclosed
literature from Suburban Manufacturing Company. These units will
be mounted flush on the outside and will present a 16" X 24"
grill to the street at each unit. The fuel will be natural gas.
The gas company will bring their line to the meter from their
main on the east side of Route 7.
Also enclosed is a copy of the letter requested in item D of your
letter, from the engineering department of Green Mountain Power
Company. Mr. Wyckoff will be sending, under separate cover, the
letters requested in item B & C concerning So. Burlington sewer
capacity and the fire hydrant requested by the So. Burlington
Fire Chief.

service for the proposed 31 unit expansion of the Lakeview Motel
on U.S. Route 7 in the City of So. Burlington, Vermont.
Under the existing Vermont Public Service Law, Green Mountain
Power Corporation is required "to furnish reasonably adequate
service, accommodations and facilities to the public."
Historically, the company has been able to anticipate
customer's requirements, and has provided the necessary facilities
for added loads. It is our intention to continue this policy in
accordance with applicable Public Service Board regulations.
Assuming the project is approved by the necessary agencies,
Green Mountain Power Corporation will cooperate in every way to
provide safe, adequate and reliable electrical service, when it is
needed.
Details concerning service size and location, scheduling,
costs, etc., should be discussed with Mr. C. C. Quinn of the

Re: Sewer capacity for Lakeview Motel
Dear Mr. Wyckoff:
As the result of a meeting with the State Agency of Environmental
Conservation, Department of Water Resources, we find that the
Bartlett Bay treatment plant is at capacity. The Agency is not
prepared to issue any Act 250 permits until the issue of sewer
capacity is resolved.
Due to the fact that you have just recently applied for your
Act 250 permit, the City is unable to provide you with any capa-
city for sewer at this time. A year ago would have had different
results regarding sewer capacity. Because of this problem, the
City has created a waiting list of which you are first in line.
This means that when 6,000 q.p.d. of sewer is freed up you will
be notified and that capacity will be allocated to you.
Until that time we will honor your approval expiration date, once
the sewer is freed up and you are so informed your permit will
expire within six (6) months from that date.

Dear Mr. Ward:
The So. Burlington Planning Commission granted approval of my
application for the construction of an additional thirty three
(33) units at the Lake View Motel last September 22, 1983. Your
letter stated that the approval expired after six (6) months.
The purpose of this letter is to request an extension of the
approval. As you know, I did obtain a building permit to remodel
the apartment in the motel, to add an additional unit and to put
in a swimming pool. These projects have either been completed or
are very near completion.

I have also engaged Richard Farnham Associates to do the detail
design and drawings for the expansion. This work should be done
by the end of March. Upon the completion of the drawings, we will
submit an application to the Agency of Environmental
Concervation; ACT-250. It will probably be many months before
their approval is granted. I have obtained, as required by
ACT-250, letters of approval from So. Burlington Fire Chief, So.
Burlington Police Chief, So. Burlington Sewerage Commissioner
and Vermont Electric Power Co., Inc. I also have requested and am
awaiting letters of approval from the Water Commissioner and
Green Mountain Power Corp.
My plans are to complete the design and drawings as quickly as
possible and then to immediately proceed to obtain the required
approvals. I plan to start construction in October 1984, build
over the winter and complete the project in the Spring of 1985.
Starting in October allows me sufficient time to obtain the
necessary approvals and get through the busy season for the
Motel.
I request that you approve an extension sufficient to achieve the
plans described above. Thanks!

certain provisions within the City's zoning regulations a permit can be
extended if a reasonable amount of objective evidence to pursue the further-
ance of the project is presented.
Your request for an extension is granted, however, a permit should be re-
quested for construction of the additional units no later than June 22, 1984,
that permit would expire six (6) months from date of issuance.
If for some reason you have not started by the expiration date, the entire
project would be subject to a complete review by the Planning Commission.

SEPTEMBER 20, 1983
Request of O'Brien Brothers Agency, Inc., Mr. Daniel J. O'Brien for extension
of the expiration date for the Cardinal Woods Extension off Hayes Avenue
Mr. Belter rejoined the Commission at this time.
It was noted that the Commission had recieved a letter from Mr. O'Brien
on this matter. The Commission has in the past given one extension if significant
progress has been made on the building of a project. Mr. Ward noted that this
project only had preliminary approval. It was noted that the Commission had
never given an extension of a preliminary approval, only of a final plat.
- Mr. O'Brien said there were a lot of units on the marked and it did not
make sense to spend a lot of money on a final plat at this time. He wanted
the extension to preserve his sewer allocation.
Mr. Mona felt there was a conflict between Section 204.1 of the Subdivision
Regulations and the dewer policy. Mr. Poger disagreed. /Mr. Mona suggested that
the City Attorney look at the two and give the Commission a reading on it. Mr.
Poger felt that the applicant could submit a final plat up to 18 months after
the preliminary, but if he wanted to save his place in the sewer allocation line,
he needed to submit it within 6 months. He saw no conflict there. Mr. Poger
ruled that, from his understanding of the regulations, the applicant had to
submit a final plat by November 11 in this case in order to retain his sewer
allocation standing. If he does not do so, he loses his place in line, but not
his rights for final plat review. He did, however, direct the Planner also to
check with the City Attorney on this issue.
Mr. Poger did not want to set a precedent here. If an extension is granted
in this case, sewer capacity could be tied up for up to 3 years. He felt one
reason for the sewer policy was to grant sewer space to those ready to build.
It was suggested that Mr. O'Brien be granted more time to get his final
plat ready. That would allow the Commission time to receive a legal opinion.
Mr. Poger felt the issue was clear and he did not want to grant an extension.
Mr. Burgess moved that the Commission grant Mr. O'Brien an extension until
January 11, 1984 and Mrs. Maher seconded the motion. Mr. Burgess stated that
it should be understood that this was a temporary extension until legal advice
is received. When a final determination is made, if Mr. O'Brien comes back in
that will not be considered a second extension.
The motion carried with Mr. Poger and Mrs. Hurd voting no and Mr. Mona
abstaining because he did not feel this was necessary.
Site Plan review of application by Lakeview Motel, 1860 Shelburne Road for
construction of an additional 33 unit motel
Mr. John Wyckoff said he had just bought the motel, which now contains
10 units and an apartment. There are 19 parking spaces in front. They
want to expand by filling in the back corners of the building to make it
rectangular and by adding a second story over part of the building. A swimming
pool would also be added, and more parking put in behind the building, for 51
spaces and 43 units. Traffic would be one-way around the motel, indicated by
signs and arrows on the pavement. Drainage will be into a culvert on the
adjoining Pauline's Kitchen lot. There will be 90 trips in and 90 out, Mr.
Wyckoff estimated. Mr. Ward noted that the landscaping proposed did meet the
dollar requirements. Mr. Wyckoff said there might be a change in the landscaping
plan to preserve the view of the land, and he was told that if there were a
change, he would have to bring in a revised plan. The Fire Chief has not seen
the plan. Mr. Wyckoff said he would like storage areas for trash and equipment
like lawnmowers at the rear corners of the parking lot to be added.

2. That the drainage concerns of the City Engineer be addressed and
approved prior to the start of construction.
3. That, the Fire Chief review the plan for the installation of necessary
fire hydrants.
4. That this ap2roval expire in 6 months.
Mrs. -Maher seconded the motion. Mr. Poger -o ed that the bond in #1 should
cover 3 seasons.
The motion carried unanimously.
Site plan review of application by Air Vermont, Burlington International Airport
for construction of a 100' a 104' maintenance hangar
Mr. Leonard Wing said primary access to the area would be from Williston
Road through the building 890 area. As a secondary access, they can use a road
through the Muddy Brook Industrial Park. The airport will keep this access
open this winter.
The building will be used to fix airplanes. 3 or 4 at a time will fit.
Mr. Wing said he would put finish contours on the plan and that excess material
will go into the old gravel pit. Seedlings will be planted. Mr. Wing said they
presently do their maintenance work in the old alert hangar, about 90, away
from this proposed location. Mr. Poger asked that the Commission be shown how
the rest of this area will be used (#5 in the City Manager's 9/16 memo on this
project). He did not agree that the Muddy Brook access should be the major one.
Mr. Ward felt there would be more activity in this corner of airport land, and
that later access might be a problem. Mr. Poger suggested that when the airport
came in to discuss the future of this area, they should be asked to talk to
the Muddy Brook Industrial Park owner to see if an agreement could be made.
Noise from the maintenance operation was discussed and Mr. Ward was asked
to check the Zoning Ordinance on this point. Mr. Schuele, who is on the city's
noise committee, asked that steps be taken to reduce noise before Mr. Wing came
back for final approval. Mr. Wing noted that this area was lower than the land
around it, and that did help keep the noise lower.
It was decided to make a site visit of this area, and Saturday,.September
24 at 10:30 am was chosen.
Mrs. Maher moved to continue the site -plan until October 11 at 7:30 pm at
City Hall. Mr. Mona seconded the motion and it passed unanimously.
Other business
Discussion with Gerald Milot of Sugartree_and the Winding Brook developers
Mr.`Milot said he had built his development deep in the woods to. get it
away from -the road. He was concerned about how Winding Brook's access -to Kennedy
Drive -would-affect his development and its private road. He asked that snow
fence be put<_up`to show the limits of construction so no more trees than necessary

3) Berard Drive, Ethan Allen Drive
1. A suggestion for improving the intersection of Airport Parkway, Ethan Allen
Drive and Shamrock Road is as follows:
Widen Airport Parkway to three lanes to accommodate left turns coming from the
direction of the Lime Kiln Bridge to the Air Guard Facilities, Country Club
Estates and Ethan Allen Drive. This would be done mainly along the east side of
Airport Parkway. Airport Parkway in the vicinity of this intersection would be
rebuilt and road superelevated to properly accommodate the design speed.
Ethan Allen Drive to intersect Airport Parkway as close to 900 as possible
with curve radii sufficient to accommodate large trucks and school busses.
Shamrock Road to intersect Ethan Allen Drive at about 900. Entire intersection
to include curbs to control encroachment. Intersection also to include signals.
Without a detailed survey and a preliminary layout it is difficult to determine
the additional land required however, an estimate of 20 feet appears adequate with
a stipulation that if not required it be deeded back to the adjacent owner.
5)/-7Cakeview Motel,'5helburne Road
1. Side drives must be constructed so that storm water from back area does not
drain on to adjacent property.
2. Storm drain pipe should be 12 inch .,with headwalls at outlets.
6) Air Vermont
1. Site was not visited because gates near guard hangar were closed. It appears
that the access from Muddy Brook Industrial Park is a better access and should
be considered as the main access to this proposed building.
2. Plan should show finish contours and site drainage.
3. It appears there will be excess material from the site work. The area of
disposal should be shown.
4. Earth cut slope shall be top soiled mulched and seeded.
5. There is still a considerable area left in the Airport Industrial zone, most
if not all owned by the airport at this location. Some planning should be done
especially for access and utilities for future development.
6. I question the adequacy of the water service even if it is only for domestic
use since it is an extension of a service to another building.

No additional information since preliminary plat approval July 13, 1983.
The issue of improving the intersection of Ethan Allen Drive, Shamrock Road
and Airport*Parkway still to be resolved by City Engineer and landowner. Some
question about who owns the land Mr. Berard or Mr. Belter.
Additional fire hydrants may be required by Fire Chief, he is on vacation
at this time.
Issue of contribution to the cost of improvements to Ethan Allen Drive to be
resolved by Planning Commission.
Suggest Mr. Berard's contribution be do the amount of $5,000, at a payment
schedule of $714.00 per lot and a final payment of $716.00, payments due prior
to issuance of a permit.
4) Daniel O'Brien
O'Brien Brothers Agency received preliminary plat approval for a 180 unit
planned development, entitled Cardinal Woods Extension on May 11, 1983, at which
final plat application would be due no later than November 11, 1983.
Mr. O'Brien is requesting an extension of this approval in order to preserve
his sewer allocation.
This is a 45,000 g.p.d. allocation. Normally one year extension has been
permitted with some type of building schedule. I suggest a schedule of no later
than spring of 1984 for the start of this project.
5) Lakeview Motel, 1860 Shelburne Road
Proposed addition of a 33 unit motel, existing 10 units.
The area in question is located in zone 5 which permits a maximum of 54
rooms per a 40,000 square foot lot, with 45 trips per peak hour, 90 is estimated
daily traffic.
The lot is question contains 60,000 square feet, all minimum and maximum
area and dimension requirements are conforming.
Parking and circulation is acceptable.

Landscaping proposed in the amount of $13,000 is conforming, performance
bond is required.
Chief Goddette should review this proposal upon return from vacation..
6) Air Vermont
The gravel access drive which connects with Palmer's Industrial Park should
be upgraded, (some parts of the road are sand base only) this road should be con-
sidered as the major access point to the area.
The proposed hangar will serve as the maintenance shop for Air Vermont, with
two shifts of about eight people working from the building, presently vehicular
access is from the Guard road opposite Plywood Ranch.
This hangar will be located in very close proximity to other hangars and
maintenance shops. The area is not landscaped and is not available to the general
public. Other than grassed areas no other landscaping should be necessary.
A existing sand embankment must be cut away a depth on approximately ten (10)
feet, the new slope (1 on 2) should be std'blized with a quick growing grass seed
and evergreen trees.

Recently we issued a Certification of Compliance for the above
referenced project. The initial increased sewage flows were
calculated on a maximum occupancy of 2 persons per unit for a
total of 3305 gallons per day. Once the flows were recently
approved from the Permits Section of the Division of Protection,
an increase of occupancy was requested from Mr. Wyckoff for a new
total of 5405 gallons per day.
This 5405 gallons per day total was what was recently approved by
the Permits Section for this project. If you would like a copy

State or Local personnel.
(3) No alterations to the existing building which would change
or affect the interior waste plumbing, water supply, or
wastewater disposal shall be allowed without prior review
and approval from the Agency of Environmental Conservation.
(4) The applicant is reminded that all plumbing material and
workmanship must meet the standards of the Environmental
Protection Rules, Chapter 9, Plumbing; the National Plumbing
Code; and the requirements of the Vermont Fire Prevention
Section of the Department of Labor and Industry.
(5) The Jacuzzi located on the lower level which will be
installed into an existing shower drain must discharge its
waste indirectly into a properly sized air gap device which
is properly vented.

a 32 room and one apartment addition with related parking, site improvements and
municipal water and sewer to the existing Lake View Motel located off of Route 7 in
South Burlington, Vermont.
Any party can request that the Commission hold a public hearing on this proposal by

12, 1988. If no request for a hearing is filed, the District Environmental Commission

To follow-up Mr. William Szymanski's letter dated August 29, 1984, and
subsequent telephone conversations, the following is our understanding of the
present situation concerning the Bartlett's Bay sewage treatment plant.
There is a reserve of 10,000 gallons per day present at the treatment plant.
However, there is a list of projects which have requested and received approval
for flows of approximately 70,000 gallons per day, which is much greater than
the 10,000 gallons per day reserve. If all of these projects are constructed
and hooked into the municipal sewage system, the treatment plant will exceed
its present design load.
This is why the Permit Section of the Agency of Environmental Conservation
cannot approve any additional increase in the near future.
Town officials and state personnel reviewing and permitting sewage treatment
plants may be able to answer any questions you may have in reference to plans
to alleviate the present problems. Please do not hesitate to call me in
reference to your application.
