STIPULATIONS AND/OR FINDINGS OF FACT
CHAMPLAIN OIL CONVENIENCE STORE AND GAS STATION
For the Site Plan application of Champlain Oil Company for a convenience
store and gas station on land owned by Dr. Bernard Barney on Shelburne Road,
as depicted on a plan entitled "Ethan Allen Mart, Site Development - Plot
Plan", last revised 4/25/80yprepared by Graphic Services:
Stipulations:
1. A landscaping bond of $1,200 shall be provided prior to issuance of the
building permit.
2. Entrance and exit centerlines shall be aligned with entrances to Pauline's
Kitchen and to Lakeview Motel respectively. A revised site plan indicating
these changes shall be submitted.
3. This approval expires in six months.

Dear Mr. Wamsganz:
Please be advised that site plan approval #SP-18-02 issued to you on 1/10/18 to replace four
(4) trees removed without approval became null and void on 7/16/18. This approval became
null and void due to noncompliance with condition #4 of said decision which required that a
zoning permit be issued for the approved site plan amendments within six (6) months of the
date of the decision or the approval would become null and void.
Therefore, you must resubmit a site plan review application for this project. Should you have

I'll need a budget for the cost of purchasing and installing the new shrubs and does the plan include the new type of
bicycle parking spaces as required by the attached? The new regs. require you to install one (1) inverted "U" rack to
meet the 50% requirement or you could install two (2) racks and comply with 100% of the requirement. If you do 50%
now, you will be required to install the remaining 50% the next time the property comes in for review. Other than that,
it looks OK.

Tree Appraisal for Shell Gas Station 1855 Shelburne Rd. South Burlington, VT
The following is an appraisal for the 4 Norway Maple Trees located at the south edge of the property
line just off the parking lot beneath the overhead utility lines. This appraisal was completed using the
formula outlined in 'The Guide for Plant Appraisal' Ninth Edition.
The appraisal used a diameter of 8 inches for each of the four trees as measured at 4.5 feet above the
ground which is the standard for such appraisals.
Replacement Cost of each tree (RC)=$1,200 *This represents the planted price for a 4 inch diameter
tree
Base price per square inch value of a tree (BP) = $75
Adjusted trunk area of each tree, (ATA) = 50 Sq. inches
Adjusted trunk area of a 4 inch diameter replacement tree = 13 Sq. inches
Species Rating for Norway Maple (SR) =20, Invasive species
Location rating (LR) = 65
Condition rating (CR) = 40
Value= (RC + ((BP x (ATA — ATR)) x SR x CR x LR
Value = (1200 + ((75 x (50 —13)) x .20 x .40 x .65 = $207 per tree x 4 trees = $828
Notes: Species rating is predetermined by a regional committee. The condition rating and location rating
of these trees is based on my observations during my site visit. An excavation around the base of each
tree using a hand tool revealed the presence of girdling roots that will lead to the premature decline and
death of these trees, (see attached photos). It is highly likely that more extensive girdling roots would be
exposed if a full root collar excavation were to be completed. The trees also show a pattern of declining
and weak new growth over the past several years. These factors greatly influenced the condition rating.
The location rating took into account the fact that the trees were planted in an area that results in a
direct conflict with overhead utilities. Each of these three ratings are expressed as a percentage as
dictated for use in this formula.
Recommendation for replacement:
Based on my assessment of the site and the available space, as well as the relative value of the existing
trees I would recommend planting 5 'Ivory Silk' Japanese Tree Lilacs at 2 inch diameter evenly spaced
through this area to replace the Norway Maples when they are removed. This tree is relatively low
maintenance and is free of any serious pest or disease problems. Its mature height is less than 25 feet so
it will not interfere with the overhead utilities in the future. This species is also tolerant of road salt
which is a potential concern in this area. They will grow to provide screening from the adjacent property
equal to the screening currently provided by the Norway Maples. (See attached information on this tree)

We will be cutting the trees next week.(we will leave the firewood) We will grind stumps in the spring at the time of
planting. We will plant Viburnums, 'Miss Kim' lilac, and Hydrangea. We will plant these in four groups of three. We can
determine the location of the planting in the ROW in the spring.

You may also consider planting 4 groupings of 3 shrubs in each grouping. Some suggestions would be Viburnums,(there
are many varieties to choose from), also 'Miss Kim' lilac, 'Diablo Ninebark, or'Tardiva' Hydrangea. Any of these would
be below the height limit at Maturity. You might consider mixing up some of these varieties to provide a variety of
color and flowering times. V.J.

I just talked with Bill. He said the 20' tree lilacs are too tall to be under the conductors, so they either
need to be located somewhere else on the property, or on the very outer edge of the ROW, or a lower
growing variety — let me know your thoughts on this. VELCO will be responsible for the purchase of 4
of the replacements (one -for -one). Also, Bill said he can leave the wood for Andrea, so just let us
know.

I just wanted to let you know you are free to cut the 4 norway maple trees at 1855 Shelburne Road and grind the
stumps. I met with VJ Comai from Bartlett Tree Experts and he put a valuation on the trees so I can do the permitting
with So. Burlington. He also recommended a replacement of (5) "Ivory Silk" Japanese Tree Lilacs. He said these will only
achieve a maximum height of 20' and never affect the VELCO line. I have two questions before you cut the norway
maples. Do you agree with VJ's choice for replacement and will VELCO participate in the replacement as we previously
discussed? Please let me know ASAP and also what the schedule is for cutting. Lastly, the store operator may want any
usable firewood left behind. She is copied on this email and will let you know. Thanks!

Mr. Ewing moved that the South Burlington Planning Commission approve the
final plat application of Emery Victory for a 2-lot subdivision on Victory Drive,

1. Parcel "B", as indicated on the final plat, is approved only as add -on
acreage to the adjacent Bishop lot.

Mr. Mona seconded the motion, and noted that if the land on Williston Road came in
for development, he would ask that one of the existing curb cuts be closed. Mr.
Victory felt that could be worked out.
The motion passed unanimously.
Mr. Thibault noted that he lived across the street from the proposed development
and he said there were covenants in the area allowing only single family homes.
Nor. Levesque told him that the Commission did not have jurisdiction over that.
Mr. Ploof also indicated that the covenants in question did not cover this land.
Mr. Victory said those covenants were removed when he bought the land..

Mr. Tony Cairns -discussed the landscaping plans. He said the building was
30' x 50'-
Mr. Ewing informed Mr. Cairns that even though his sign was shown on the plan,
the Commission was not approving anything to do with it. Mr. Cairns understood that.
Mr. Ewing asked why there were two curb cuts and was told that with a gas
station use it was very hard to get in and out without two cuts, particularly when
the station would service diesal trueks. Mr. hiring also noted that the two cuts
were each 40' wide and he asked what would prevent cars from going in and out of
both of them. Mr. Cairns noted that there would be signs and pavement arrows, but
he admitted that if a car wanted to go in or out the wrong way, he could not prevent it.
Mr. Cairns said it looked as if they would get water from across the street,
since the South Burlington water line does not come as far as this lot.
Mr. Mona asked about traffic and Mr. Cairns said the Council, in its hearings
on the use, had covered that. Mr. Spitz read a memo from Traffic Engineering
Associates dated February 25, 1980. The memo indicated that the traffic data
submitted was within the limits set by ITE and was acceptable. It also added that
much of the traffic for this use was already on the road, so there would not be a
significant impact here, and that sight distance was OK for a higher speed than that
posted. The memo felt that left turns would be minimal since the same services
were also in place on the other side of the road, and the only concern expressed
was for pedestrians crossing the road from the motel to go to the convenience store.
Mr. Cairns added that during heavy traffic periods in this area, it was almost
impossible!to make-lAit turns, so this use might actually alleviate the traffic
situation since gas and convenience items would be available on both sides of the
street and cars would not have to turn left to get either.
?"s. Cairns did not expect people to cross the road on foot for convenience
items when they could get the same items on the same side of the road, and he
added that the motel was closed uowyin the winter anyway. Hours for the business
will be 7 am to 11 pm.
Mr. Ewing asked how far it was from the Auto aster curb cut closest to this
property to the first entrance and was told it was about 67'. Kr. Cairns noted

that the Automaster cut was seldom used, but Mr. Ewing felt that if a building
were ever put on that lot, that cut could create conflicting traffic movements
with the north curb cut for this property, especially in light of the amount of
traffic the Southern Connector would be dumping on Shelburne Road. He felt the
applicant was asking for two more curb cuts on a very busy road. Mr. Cairns did
not see any way to have only one cut if he was going to have diesal trucks. on the
lot. Mr. Nona agreed, but asked if the cuts could be moved south. Mr. Cairns
said he could not go much farther south because of the Velco lines.
Mr. Ewing asked if the cuts planned lined up with any cuts on the other
side of the road. Lining up curb cuts helps the traffic flow, he said. Mr.
Cairns replied that one lined up with a cut for Pauline's Kitchen. Mr. Ewing
wanted to see the other entrances shown on the plans.
Mr. Jacob, who was late because he was doing his democratic duty, arrived
at this point.
Mr. Cairns noted that he could push the two cuts closer in order to have
the south one line up with the motel cut. The Commission wanted to see where
the curb cuts on the other side of the road were and they wanted an effort made
to line these up, if possible.
Mr. Ewing asked if the entrances could be 20' wide, but was told that it
would be hard for trucks to swing in if they were.
Mr. Cairns showed Xr. Ewing the figures on traffic submitted to the Council.
Mr. Levesque wondered why the city needed another gas station. He felt that
no one was considering esthetics.
Mr. Ewing asked Mr. Cairns to give the Commission his actual estimate on how
many trips per day he expected for the use.
Mr. ?Mona moved to continue the review until next week at 7:30 pm at City
Hall. Mr. Walsh seconded the motion and all voted aye.
Other business
Mr. Mona asked about the Council's consideration of grandfathering Business
Park North on the proposed C1/C2 regulations. Mr. Spitz said the Council had asked
for a written opinion on that from the City Attorney. Mr. Jacob felt it was the
intent of the Commission to grandfather that development.
Mr. Mona moved to direct the City Planner to communicate with the Citv Attorney
concerning the discussion on lot 9 of Business Park North. The discussion was to
such detailed extent that the use of the property is well defined - it is going
to be a drive-in bank. Mr. Ewing seconded the motion, but he wondered if a time
limit should be imposed. He felt that in 15 years the Commission might not feel a
bank on that lot was appropriate. He noted that no site -plan approval had been
given for the lot in question. Mr. Spitz felt that perhaps a time limit could be
imposed and he also noted that there had been no formal motion made.
The motion passed unanimously.
Mr. Levesque asked about McDonald's parking lot and was told they had been
asked to provide a timetable for the changes. They have not finished work on the
rear parking lot yet.
Mr. Jan bL nnted__that the Zoning Board agenda included an item to put a bakery
in the - old Racine bu__ d ng_ off Williston Road. He felt this was a high traffic
generator and would defeat the purpose of interim zoning.
Mr. Ewing moved to direct the City Planner to draft a letter to the Zoning
Board askinr them to consider traffic in this area. ?`s. Jacob seconded the motion
and all voted aye.

f2 Victory 2-lot Subdivision. In conversations with Mr. Victory and with one
prospective purchaser of the rear portion of the property, it is clear that some
thought, although not finalized, has been given to the subdivision of the re-
mainder of the property. It would still be advisable for Mr. Victory to layout
on paper a general sketch of the most likely overall subdivision plan. This
sketch would not require approval at this time, nor would it have to bind the
landowner to the indicated layout. However, it would show where problems may be
encountered in future divisions and may indicate how such problems could be
avoided by proper layout at this time. For example, the unequal rear lines of
the three new lots on Victory Drive might have been avoided if all three lots
had come in at the same time.
#3(\ Champlain Oil. The application has been approved by the City Council and by
the Zoning Board. The Council made one stipulation that no gasohol with over 10%
alcohol be sold without prior Fire Chief approval. The Zoning Board granted a
variance to allow building on a 60,000 square foot lot but did not grant a
variance for required green space within the front yard setbacks.
The site plan does comply with the front yard green space requirement and
with all other setbacks. The two entrances have been approved by the City traffic
consultant. The State has yet to give its approval, but it has sent a letter
stating the plan will not interfere with the South Burlington Connector. Parking
spaces (8) are sufficient.
The Fire Chief has okayed the plan with the one stipulation on gasohol.
Final landscaping details should be submitted by Tuesday's meeting.
The City Manager has no comments on either application.

2) Municipal Building. Several items have been addressed since last meeting.
Entrances to the high school across the street are now shown on the map.: The
northerly police and fire entrance is shown about ten feet off -center from a
high school entrance. Centering the access would result in a loss of a number
of parking spaces. Since the new access is not supposed to be for the general
public, centering is not crucial.
Options for the southerly entrance are still being explored. It will be
impossible to line up with the high school and to provide access to the adjacent
Hurley property with only one access point.
The number of parking spaces has been re-examined and appears sufficient
for any projected use of the municipal building. A more likely occurence is
that the municipal parking lot would be used for overflow high school parking.
Location and possible construction of a pedestrian walkway and crossing light
are being examined.
Layout of drainage improvementsjbutnot complete engineering details, should
be available for Tuesday's meeting.
One additional fire hydrant may be required.
On a municipal application such as this I would suggest that the Planning
Commission indicate the conditions that it feels are important for proper use of
the site. However, working out of details, such as for drainage, and deter-
mining timing of improvements, such as access to the Hurley property or a ped-
estrian crossing light, should be left to the City Council and Administration
based on budget and other considerations. I would recommend that site plan
approval need not be held up while the City works out such matters.
3) Champlain Oil , Information required from last meeting has not yet been
provided, b,it T PXn(-ct it to be available by Tuesday's meeting.
4) Stonehedge. At the end of the last meeting the Planning Commission requested
that a motion be prepared to support the Commission's ability to review the
appearance of the new units and their compatibility with existing units. The
only section that I believe may be utilitzed is one of the general standards
under which the Planning Commission shall evaluate any proposed Planned Unit
Development. (S,-, c. 12.002(A)(7)): "Will not have an undue adverse effect on
the scenic or natural beauty of the area, aesthetics, historic sites or rare and
ireplaceable natural area, and conforms to proposed pedestrian trail syste.:.."

building and to allow for connection to the adjacent Hurley property. The City
shall construct the connecting access and shall close the current access to the
Hurley property when and if traffic conditions warrant.
2. A second entrance to the municipal office parking lot shall be aligned with
the southerly entrance to the high school. The City shall install a pedestrian
crossing light near those entrances when traffic conditions warrant.
3. Landscaping and drainage details and access revisions shall be submitted.
4. Land shall be set aside for a sidewalk fronting on Dorset Street and a
sidewalk from the entrance of the municipal building to the street. A pedestrian
crossing line shall be painted and appropriate signing and lighting erected.
5. All above revisions will be noted on the plan of record.
Mr. Jacob seconded the motion and all were in favor.
Continuation of site plan review of application by Champlain Oil Company for a
convenience store and Ras station on land owned by Dr. Barney on Shelburne Road
at the Shelburne boundary
Mr. Cairns noted that the entrances across the street from this site had
been added to the plan and the motel lined up with this entrance. He said the
other question had been on the total per day traffic count, and he gave this
information to Mr. Poger, who said that the estimate was 200 cars per day.
Mr. Mona was concerned about creating another situation like Williston Road
if the Commission allowed more and more places on Shelburne Road which created
left turning traffic.
Mr. Jacob felt the City Council, in its interim zoning hearings, had covered
traffic and that the Commission should only be concerned with the interior layout.
Mr. Poger felt that if the Commission saw a safety problem, they should discuss
it, and if they did not, they should accept the Council's judgement.
Mr. Ewing noted that with 40' wide access points, the applicant could not
control people who wanted to go in and out the same access. Mr. Mona felt that
two curb cuts were appropriate for a gas station use, but he said that if the
pumps were removed, it would be better to have only one. Mr. Cairns said that
would be fine with him. He felt the only way to have control over the wide accesses
was with signs, and said he planned to erect lighted signs and have painted arrows
on the pavement. He went on to say that he believed, and so did the traffic
engineer, that having this station here might ease the traffic at that point,
because at heavy traffic times, people who need gas will be more inclined to buy
it on the side of the road where they do not need to make 2 left turns.
Mr. Levesque asked about turning the building the other way but he was told
they could not do that because of the Velco right of way.
Mr. Ewing moved that the South Burlington Planning Commission approve the
site plan application of Champlain Oil Company for a convenience store and gas
station on land owned by Dr. Bernard Barney on Shelburne Road, as depicted on a
plan entitled "Ethan Allen Mart, Site Development - Plot Plan" last revised
4 2 80 prepared by Graphic Services, subject to the following stipulations:

1. A landscaping bond of 41200 shall be provided prior to issuance_ of the
building permit.

Kitchen and to Lakeview Motel respectively. A revised site plan indicating these
changes shall be submitted.
3. This approval expires in six months.
4. The most northerly curb cut shall be closed after 6 months of non-use
of the fuel pumps.
Mr. Jacob seconded the motion.
The Commission felt that painted arrows on the pavement were needed to direct
traffic flow. They did not require lighted signs, but said the applicant was free
to erect them if he so chose. Mr. Cairns had no problem with painted arrows.
Whether or not to ask the applicant to construct a sidewalk was discussed.
Kr. Spitz noted that the right of way for the road was wide enough for one, but it
was noted that this was the last property in South Burlington and was south of the
proposed Southern Connector ramps. It did not seen that a sidewalk was needed.
The motion passed with Mr. Levesque voting no.
Continuation of revised final plat review of aDalication by the Glenwood
Coraoration of Cluster J 20 units of phase 2 of the Stonehedae development
Mr. Mona said that normally the Commission might reopen a hearing for the
admission of facts, and since they were ready to review whatever facts might be
presented to meet the requirements they had said could be conditions for approval,
he moved to reopen the public hearing. Mr. Ewing seconded the motion.
Mr. Ewing asked what facts Mr. Mona expected to hear and was told he expected
a proposal on how to do what the Commission wanted the developer to do.
Mr. Spitz noted that the City Attorney had felt that if the hearing was
reopened, interested parties should be allowed to comment, but discussion should
be limited to the new items introduced.
Mr. Poger opposed the motion because he felt the developer had not submitted
any new plans and Mr. Jacob agreed. Mr. Jacob felt the Commission was on dangerous
ground and he noted that in many meetings the Commission had said it could not
look at building design. He felt the Commission had listened to every complaint
voiced by the Stonehedge residents and that if they had grievances, the place to
discuss them was in the courts.
Mr. Mona said that at the last meeting he had made a suggestion as to how the
new housing could be blended in with the existing buildings such that the fears of
the residents would be minimized and so that, when the project was finished, there
would be common elements to the buildings. He felt that the discussions at the
last meeting lead the audience to believe that the Commission might review a
proposal tonight. Mr. Ewing pointed out ,that there was no evidence to show that.
Ys. Spitz said he had had a conversation with the applicant's representative and
that he had some drawings they were prepared to present regarding the issues
raised at the last meeting.
Mr. Poger asked if the applicant wanted the hearing reopened and !sir. Lisman
said that they had some drawings and they were present.
The motion on reopening the public hearing for the purpose of discussing
esthetics passed With Messrs. Poger and Jacob voting no.
Mr. Page putjthe drawings on the board. They showed front and right side
elevations._ iae Juilding siding runs vertically and diagonally on the buildings,
as opposed to being vertical elsewhere. Rr. Ding had visited the site and :chid
there were areas in the project where the siding ran different ways on the ::u-e
building. Yr. Page said the roof pitch here was 5:12 and elsewhere it is 6:12
or 8:12. These units have 1,010 sq. ft. and others have 12D0 sq. ft. of e ace.
