This letter is in follow up to our conversation last week- in regards to Iighting options for
our sales lot. In consultation with '� - Glen Ghostlaw and Mr. Michael Burke of Green
>iourtain Power, we have reached are agreement for our lighting needs and arc writing
you as you requested to obtain approval from the South Burlington Zoning board. 1 have
included a sketch of the whereabouts of the lighting positions for your review. There will
be no additional poles installed at this time as we will use the newly installed poles from
the road construction of Route 7 , and the current pole at the edge of our lot already- The
lights will be the "cobra" style light as per South Burlington Zoning and installed by
Green Mountain Power. There will be two lights installed on the pole in front of the
dealership p.r zoning regulations of thirty feet in height or below, and one light on our
current pole at the edge of the interior lot, again per zoning regulations.

ease it has always been to work with. the Zoning Board.

This project, consisting of eliminating a failed on -site wastewater disposal system and connecting to
the municipal sewer an existing auto dealer with 11 employees served by an existing municipal water
service located off Shelburne Road in the City of South Burlington, Vermont, is hereby approved
under the requirements of the regulations named above subject to the following conditions.
GENERAL
1. This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Department of Labor & Industry — telephone (802) 828-2106 or
(802) 879-2300 and local officials prior to proceeding with this project.
2. The project shall be completed as shown on the following plans which have been stamped
"approved" by the Wastewater Management Division:

3. The project shall not deviate from the approved plans in a manner that would change or affect
the exterior water supply or wastewater disposal systems, building location or the approved
use of the building, without prior review and written approval from the Wastewater
Management Division.
4. The conditions of this permit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be
responsible for the recording of this permit and the "Notice of Permit Recording" in the South
Burlington Land Records within thirty, (30) days of issuance of this permit and prior to the
conveyance of any lot subject to the jurisdiction of this permit.
5. The Wastewater Management Division now reviews the water and wastewater disposal
systems under 10 V.S.A., Chapter 64 — Potable Water Supply and Wastewater System Permit.
6. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose of
ascertaining compliance with the Vermont environmental and health statutes and regulations.
7. A copy of the approved plans and this permit shall remain on the project during all phases of
construction, and upon request, shall be made available for inspection by State or local
personnel.

8. No penult issued by the Secretary shall be valid for a substantially completed wastewater
system until the Secretary receives a certification from a designer or the installer, signed and
dated, that states:
"I hereby certify that, in the exercise of my reasonable professional judgment, the
installation -related information submitted is true and correct and the wastewater
system was installed in accordance with the permitted design and all penmit
conditions, was inspected, was properly tested, and has successfully met those
performance tests."
9. The project is approved for wastewater disposal by the construction of a connection to the
municipal wastewater treatment facility as depicted on the approved plans. The project is
approved for a maximum of 149 gallons of wastewater per day. The Wastewater
Management Division shall allow no other method, or location of wastewater disposal without
prior review and approval.

The Sites Management Section (SMS) has received the Underground Storage Tank (UST) closure report which outlines the
subsurface conditions for the above referenced site. The fieldwork was conducted by Griffin International, Inc. on June 2,
1999. The report is dated June 8, 1999 and summarizes the degree and extent of contamination encountered. The USTs
removed include:
UST #1 - 1,000 gallon motor oil (closed in -place)
UST #2 - 1,000 gallon waste oil
During the site activities, screened soils had concentrations up to 68 parts per million (ppm) as measured by a
photoionization detector (PID). The peak PID readings were measured at depths of 4 feet below ground surface (fbgs) in the
excavation. Approximately 2 cubic yards of excavated soil were stockpiled on -site due to the presence of PID elevated
headspace readings. The limits of soil contamination were not defined. Contaminated soil was used for backfill at the
conclusion of the UST removal program.
Two soil samples from the limits of excavation were submitted for laboratory analysis. No VOC's were detected above
laboratory limits using EPA 8260. The results for TPH via EPA 8015 were not submitted.
Site soils consisted of gravel. Groundwater was not encountered at a (maximum) depth of approximately 5 fbgs.
The Mountain View Mitsubishi was inspected for sensitive receptors. The possible receptors potentially affected include
groundwater, basements of adjacent buildings, and soil.
Based on the report information, the SMS has determined additional work is necessary to determine the severity of
contamination. Due to possible contamination to nearby receptors, the SMS requests that Pecor Auto Sales retain the services
of a qualified environmental consultant to perform the following:
❑ Further define the degree and extent of contamination to the soil.
❑ If appropriate, determine if the airspace beneath the site and site adjacent building(s) (e.g. basements) has
been impacted by the release using a PID. Wall and floor construction and susceptibility to vapor migration
should be noted. PID measurements should be made in cracks and/or joints likely impacted. If the airspace
has been impacted, SMS requests confirmatory sampling and laboratory analyses be performed using EPA
Method TO-2.
❑ Determine the degree and extent of contamination, if any, to groundwater. A sufficient number of
monitoring sites should be installed to adequately define the severity of site contamination. Analyze
groundwater samples for TPH and BTEX. At sites proximal to water supply sources, determine the
hydrologic relationship of the contaminated area to the water supply source. Pumping influences should be
considered in the evaluation.
Assess the potential for contaminant impact on sensitive receptors. Base this update on all available
Regional Offices - Barre/Essex Jct./Pittsford/Rutland/Springfield/St Johnsbury
information and include basements of adjacent buildings, nearby surface water, any proximal drinking water
sources, wetlands, sensitive ecologic areas, outdoor or indoor air, sewers, or utility corridors. Sample and
analyze any at -risk water supplies for BTEX, TPH and MTBE compounds.
❑ Determine the need for long-term treatment and/or monitoring that addresses groundwater contamination.
❑ Develop a plan to treat and/or monitor the stockpiled soils. The soils must remain located in an area such
that they have a low potential to impact nearby receptors. The soils must also remain properly encapsulated
in plastic. The plan should demonstrate that child and public access to the soils is sufficiently
restricted. If the soil pile is located in an area subject to public activity and where public access is
unrestricted, the soil pile should be surrounded by fence. The fence should be no less than 3 feet in height
and of durable construction;
❑ Submit a summary report that outlines the work performed, as well as provides conclusions and
recommendations. As appropriate include analytical data; a site map showing the location of any potential
sensitive receptors, stockpiled soils and monitoring or sample locations; an area map; detailed well logs; and
a groundwater contour map.
❑ With the Workplan or Expressway form, please submit a site location map at an approximate scale of
1:24000 showing the location of the site. Please include a scale, a north arrow, the SMS site number, and a
citation of the source map. The purpose of this map is to enable the SMS to enter the site location into a
Geographical Information Systems database.
❑ Submit remaining soil sample analyses.
Please have your consultant submit a preliminary work plan and cost estimate or a site investigation expressway notification
form within fifteen days of your receipt of this letter, so it may be approved prior to the initiation of onsite work. Enclosed
please find a list of consultants who perform this type of work as well as the brochure "Selecting Your UST Cleanup
Contractor," which will help you in choosing an environmental consultant.
Based on current information, the underground storage tanks at Mountain View Mitsubishi are eligible for participation in the
Petroleum Cleanup Fund (PCF). You must provide written proof to the SMS that you hold no other applicable insurance in
order to receive reimbursement from the PCF. The owner or permittee must pay for the removal and/or repair of the failed
tank(s), and for the initial $10,000.00 of the cleanup. The fund will reimburse the tank owner or permittee for additional
eligible cleanup costs of up to $1 million. All expenditures must be pre -approved by the Agency or performed in accordance
with the "Site Investigation Guidance" expressway program. Please refer to the enclosed guidance document titled,
"Procedures for Reimbursement from the Petroleum Cleanup Fund' for additional information concerning the PCF.
The Secretary of the Agency of Natural Resources reserves the right to seek cost recovery of fund monies spent at the
Mountain View Mitsubishi site if the Secretary concludes that Pecor Auto Sales is in significant violation of the Vermont
Underground Storage Tank Regulations or the Underground Storage Tank statute (10 V.S.A, Chapter 59).

Automaster Motors on Shelburne Road. The proposed addi-
tion does not meet the 75' set -back requirement from the
road right-of-way. The lot size is in excess of 80,000
square feet, which is the minimum size allowed in a Bus-
iness Planned Developement. (BPD) zoned district. Auto -
master presently parks approximately 90 cars on the site.
This number appears to be more than adequate in meeting
the minimum off-street parking requirements. Therefore,
it appears that the only variance required is for the 75'
