Dear Carl:
Thank you for your letter of March 3, 2008. 1 visited the subject property on Friday,
March 7rh and took the enclosed photo. As you can see from the photo, the light bulbs
project below the shields on all the fixtures resulting in the source of the light being
visible from the street. This fixture violates Section 13.07, Exterior Lighting, of the South
Burlington Land Development Regulations.
Therefore, all building mounted lights on the building must be modified or replaced to
comply with the requirement that these lights be downcasting and shielded. Please let
me know your timetable for bringing these lights into compliance.

Re: Exterior building lights at 1830 Shelburne Rd
Dear Ray,
I received your letter of February 15'h and I examined the fixture in question. As
you can see from the photographs, the 50-watt metal halide bulbs are considerably shorter
than the protective globes surrounding them. Therefore, I believe they meet the
requirements; the bulb does not project below the bottom of the fixture shade. I checked
with the manufacture and they do not make a shorter globe. We could remove the
protective globe so nothing projects below the shade, but I think we would find an
increase in foot-candles along with a decrease in the level of safety and anti -vandalism
protection. Let me know what you decide.

Subject: Convenience Store Located at 1830 Shelburne Road in the City of South
Burlington, Vermont.
I reviewed your memorandum to me dated August 30, 2005 regarding the reconstruction of
the existing convenience store referenced above. I understand the original building was
constructed and was used as a convenience store with eight gas pumps prior to June 1,
1970. You demolished the original building and constructed a new convenience store on
the former foundation using the existing sanitary sewer and water services: The numbers
of gas pumps remain the same and the use of there -constructed building remains the same
as the pre -June 1, 1970 use including no on -site food preparation or on -premise public
seating.
We have a practice identified as "Reconstruction of buildings or structures that are not
single family residences on their own lots" that provides guidance on projects such as
yours. The guidance states that no permit is required for a building that was voluntarily
removed and reconstructed provided;
A. that such reconstruction is accomplished within two years;
B. it is reconstructed on the same footprint;
C. it does not result in any increase in design flow;
D. there are no changes in the operational characteristics of the potable water
supply or the wastewater disposal system; and
E. there has been no other change to the building, lot, potable water supply, or
wastewater system that would otherwise require a permit under these rules.

Therefore based on your memo, I concur no Wastewater System and Potable Water Supply
Permit is required for the re -construction of the convenience store. Please note that this
letter does not relieve the landowner of complying with all rules and regulations
administered by the City of South Burlington, the Department of Health and the Division
of Fire Safety for reconstructing the building.

This project, consisting of demolition of a pre-existing restaurant and construction of a new
convenience store (no food service) with two islands of gas pumps, on a pre-existing 0.69 acre lot,
served by municipal water and wastewater services, located off Shelburne Road in South Burlington,
Vermont is hereby approved under the requirements of the regulations named above, subject to the
following conditions.
l . This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Department of Environmental Conservation, Water Supply
Division - telephone (802) 241-3400, the Department of Labor and Industry - telephone
(802) 828-2106 or (802) 658-2199, and local officials prior to proceeding with this project.
2. The project shall be completed as shown on the following plans prepared by J. Tyler Hart,
P.E. of Dubois & King, Inc. which have been stamped "approved" by the Wastewater
Management Division:
Project No.: B116897P1 "S.B. Collins - Short Stop, Convenience Store"
Sheet 1 of 2 "Civil Proposed Site Plan" dated August 2000 revised May 23, 2001; and
Sheet 2 of 2 "Details" dated May 23, 2001.
The project shall not deviate from the approved plans without prior written approval from
the Wastewater Management Division.
3. No alterations to the building other than those indicated on the approved plan or Water
Supply and Wastewater Disposal Permit, which would change or affect the exterior water
supply, or wastewater disposal, or the approved use of the building shall be allowed without
prior review and approval from the Division of Wastewater Management.
4. The Wastewater Management Division now reviews the sewage and water systems for public
buildings under 10 V.S.A., Chapter 61 - Water Supply and Wastewater Disposal Permit.
By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations,
with this permit.

6. A copy of the approved plans and this permit shall remain on the project during all phases
of construction and, upon request, shall be made available for inspection by State or local
personnel.
WATER SUPPLY
7. The project is approved for water supply by connection to the South Burlington municipal
water system as depicted on the approved plans. No other means of obtaining potable water
shall be allowed without prior review and approval by the Wastewater Management
Division.
8. The installation of the water line extension shall be inspected by a professional engineer
registered in the State of Vermont who shall report in writing prior to occupancy, that the
work has been completed in accordance with the approved plans. The engineer's report shall
include, but not be limited to, the results of all leakage tests performed on the water line and
review of the pipe in the trench before covering, and the disinfection of all water pipes.
9. The connection of a sprinkler fire suppression system to a public drinking water supply
system shall require the installation and maintenance ofback flow prevention devices which
conform to the standards acceptable to the Department of Labor and Industry.
WASTEWATER DISPOSAL
10. The project is approved for connection to the Bartlett Bay municipal wastewater treatment
facility as depicted on the approved plans. The project is approved for a maximum of 1300
gallons of wastewater per day. No other method of wastewater disposal shall be allowed
without prior review and approval by the Wastewater Management Division, and such
approval will not be granted unless the proposal conforms to the applicable laws and
regulations.
11. A professional engineer, registered in the State of Vermont, is to generally supervise the
construction of the sanitary sewer line extensions and, upon completion of construction, the
supervising engineer is to submit to the Wastewater Management Division a written
certification stating all construction has been completed in accordance with the stamped
approved plans. The engineer's certification is to be submitted to the Division prior to the
occupancy of any unit and the certification shall include, but not be limited to, the results of
all leakage testing performed on each segment of the sanitary sewer extension as described
in the Environmental Protection Rules, Chapter 1, Appendix A.

12. A clean -out shall be constructed on the sanitary sewer service line and the supervising
engineer shall inspect the clean -out and report in writing to the Division that the clean -out
was provided.

1. If the City issues the necessary building and --oning
permits to Jolley for the gas station/convenience store, and it
begins construction of the same in accordance with those permits;
and
2. If all or any part of the improvements constrUCted by
jolley is/are ultimately disallowed by a final decision of the
Vermont Environmental Court or, on appeal therefrom, by a
decision of the Vermont Supreme Court, or by any agreement
between the parties settling tha present appeal; and
3. if Jolley removes any and all disallowed improvements
within one hundred twenty (120) days from the date of any final
decision, or the effective date of any settlement agreement, then
this obligation shall be void; otherwise the same shall remain in
full force and effect, and so much of the penal sum shall be paid
to the City as is necessary to reimburse it for any and all costs
incurred to remove or obtain the removal of any disallowed
improvements, including any attorneys' fees incurred in
connection therewith.
IT IS HERESY expressly understood and agreed that the
liability of the Surety for any and all claims hereunder shall
in no event exceed the amount of this obligation as herein
stated.

A product called Roundup will be used on the three islands specified
in the design one week before work is to begin. The area after one week
will be raked and debris disposed of. Topsoil will be spread in the third

Mr. Poger asked about the adequacy of drainage and the potential
for erosion. Mr. Boisvert replied there were occassional blockages
in the spring, but nothing that would impinge on the house sites.
Mr. Page replied that there were no steep slopes and little or no
erosion occurring in the vicinity.
Mr. Woolery moved that the South Burlington Planning Commission
approve the final plat of Maurice Boisvert for a 1 lot subdivision
as depicted on a plan entitled "Proposed Subdivision for Maurice
Boisvert" and accompanying plan for sanitary sewer extension, drawn
by Trudell Consulting Engineers, dated 4/30 and 6/15/79, subject to
the following stipulations:
1. A private road and waiver agreement shall be executed.
2. The final plat for recording shall depict building envelopes
and be recorded within 90 days.
3. A municipal sewer easement shall be extended across the
full frontage of lot 2.
4. The public sewer shall be extended per the plans submitted;
a bond in an appropriate amount shall be posted.
Mr. Jacob seconded the motion. Mr. Poger asked Mr. Page to explore,
with the City Attorney, the usefulness of requiring building envelopes
to be shown on final plats that are to be recorded.

Site plan review, addition of diesel pumps and parking lot to
Shelburne Road Getty Station
Mr. Barlow located the site on a slide and described the proposed
layout. In response to a question, he said the diesel pumps are to be
located to the rear of the building to provide ample circulation for
diesel fuel customers, especially trucks, and to prevent,confusion in
pumping the wrong type of fuel. Mr. Mona expressed concern over the
proximity of the Allen Road curb cut to Shelburne Road, as did Mr. Poger
and Mr. Ewing. A lengthy discussion ensued over the potential for
obstructions to the Allen Road approach to the intersection caused by
traffic entering or exiting the Getty north curb cut. It was the con-
sensus thatA'proposed location was acceptable because it was as far
east as the Lake Champlain Motors curb cut, where no access problems
have been experienced. The applicants stated they are going to phase
out the auto body repair business, remove the stored automobiles, and
generally clean up the site.
Mr. Woolery moved that the South Burlington Planning Commission
approve the site plan proposal of Robert Cross, to add a diesel fuel
pump island and a .44 acre circulation area, as depicted�on a plan
entitled "Site Plan Shelburne Road Getty Station", drawn by Knight
Consulting Engineers, dated 6/25/79, subject to the following
stipulations:
1. All work shall be done in conformance with the City Engineer's
recommendations (memo of 7/19/79).
2. Landscaping shall consist of salt tolerant deciduous trees
to be planted in either of the 2 grassed island (but outside of
the clear sight triangle) in an amount of a least $1,000.
3. The necessary bonds shall be posted prior to issuance of a
land development permit.
Mr. Levesque seconded the motion, which passed 6-0, with Mr.
Mona abstaining.
Site plan review for revised access to Farrell Distribution Corporation

Mr. Methot presented the plan. The access point is being re-
located easterly to avoid conflicts with a power pole and a trans-
former, and because of the owner's preference for;'curving entrance drive.
Mr. Woolery moved that the South Burlington Planning Commission approve
the revised site plan of Farrell Distributing Corporation, as de-
picted on a plan entitled "Site P1an...Distribution Center..." drawn by
Wiemann Lamphere architects, dated 4/24/79 revised 5/2/79 & 6/26/79,
subject to all the previously imposed stipulations.
The motion was seconded by Mr. Ewing and passed unanimously.

Informal review of proposed final plat for Colony Office Park
Messrs,Milot and Gagne showed the Commission a plan which had
been revised as a result of meeting with Treetops homeowners.
Building #2 had been moved further west, and its upper parking lot
lenghtened and reoriented. The Commission felt the plan was an over-
all improvement over the previous one, but did have some concern over
P�the grading at the east edge of the rear parking lot,)finished grade of
the upper parking lot for building #2, and`!measures to assure the perman-
ency of the wooded buffer area.
Other Business
On a motion by Mr. Mona and second by Mr. Ewing, the Commission
voted to send the reworded memo on Chappell's conditional use app-
lication to the City Council.

#2 Boisvert Final Plat - The plan is unchanged from the last
meeting; all is copascetic.
#3 etty Station Site Plan - The addition of new diesel fuel
pumps ana- a hacre paved circulation area to the rear of the
existing building is proposed. Access and circulation are
adequate, provided Bill Szymanski's recommendations are followed
(see memo enclosed). I would like to see some new plantings in-
cluded in the plan because the entire front yard is paved. However,
it will be difficult to locate any landscaping in the front yard
due to existing layout and circulation patterns. The required amount
of landscaping is $1461.
#4 Farrell Distributing Revised Site Plan - A relocation of the
approved entrance point 100' to the east is proposed. Parking,
access, and circulation remain excellent. Some modification of the
planting plan will be necessary.
#5 Colony Office Park - Following a meeting with Treetops residents,
the proposed office buildings have been relocated. Before preparing
detailed engineering plans, the developer would like to get the
input of the Commission on this new arrangement.
#6 Other Business
The City Council will hold a meeting exclusively for
Comprehensive Plan review on Monday, July 30th.
I am researching the issue of street lighting; I hope to be
able to report to you sometime in August on this.
A draft position memo on the Chappell conditional use applicatic
is enclosed,for your review and comment.
Also enclosed is a proposed schedule for completing the review
of the Comprehensive Plan.

It has come to my attention that Jolley Associates has replaced the canopy lights at 977
and 1830 Shelburne Road. Please be advised that exterior lighting is regulated by the City
under the site plan review process. Any change to anything regulated by the site plan
review process must be approved through that process. Since you have not obtained site
plan approval for these lighting changes, you are in violation of the zoning regulations.
