HomeMy WebLinkAboutSP-86-0000 - Decision - 1805 Shelburne Road (4)FINDING OF FACT STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Finding of Fact, application of Harry Curth, RD #2, Box 84, Vergennes, Vermont 05491 for construction of a 2924 square foot drive -through car wash at 1805 Shelburne Road, (lot #1 of the Fassetts Bakery three lot subdivision). On the 22nd of April, 1986, the South Burlington Planning Commission denied the request of Harry Curth for site plan approval under. the South Burlington Zoning Regulations based on the following findings: 1) Failure to conform with Section 12.30 which limits the maximum size of a use in a Commercial-2 district according to the traffic standards of Section 17.00. 2) Failure to conform with sections 17.30 and 17.301 which specify the definitions and standards in determining the permitted size of a use in a traffic overlay zone, as follows: a) The applicant's proposed car wash at 1805 Shelburne Road is in Traffic Overlay Zone 5; b) The maximum permited peak hour traffic volume is 45 trip ends per 40,000 square foot lot; or 65 trip ends for this 57,495 square foot lot. c) The institute of Transportation Engineers projects 132 trips per facility during the peak. hour on the adjacent street. d) The applicants data showed 46 trip ends during the peak hour at an Essex Junction facility and 76 at the Seaway Car Wash in South Burlington. The proposed facility can handle 80 trip ends per hour due to the physical capacity of the facility. e) Level of service for north bound left turns into the facility will operate at "C" . For exiting , traffic, the level of service will be "F" for northbound and "C" for south bound right -turn with a two lane exit driveway. f) The level of service at the nearest signalized inter- section (Green Mountain Drive/Bartlett Bay Road) Shelburne Road is "D". Therefore, the Planning Commission denies this application for exceeding the traffic overlay standard of 65 trips ends, and the level of service C standard of Section 11.504 and since none of the provisions of Section 17.50 for increased traffic volumes in the Overlay Zone apply.
