RE:Findings of fact, application of Harry Curth, RD#2, Box 84,
Vergennes, Vermont 05491 for construction of a 2924 square foot
drive -through car wash at 1805 Shelburne Road, (lot #1 of the
Fassett's Three lot subdivision).
On the 6th of May 1986, the South Burlington Planning Commission
denied the request of Harry Curth for site plan approval under
the South Burlington Zoning Regulations based on the following
findings:
1) The applicant failed to conform with Section 12.30 which
limits the maximum size of a use in a commercial -two district
according to the traffic standards of Section 17.00.
2) The applicant failed to conform with Sections 17.30 and .301
which specify the definitions and standards in determining the
permitted size of a use in a traffic overlay zone and Table III
which established the procedure for determining this as follows:
a) The permitted size of a use on any lot in a traffic
overlay zone shall be based on the size of the lot, the size
of the projected peak hour traffic volume of the use and the
permitted peak hour traffic volume for the traffic overlay
zone in which the lot is located.
b) The applicant's proposed car wash at 1805 shelburne Road
is in Traffic Overlay Zone 5.
c) The maximum permitted peak hour traffic volume is 45
trip ends per 40,000 square foot lot, or 65 trip ends for
this 57,495 square foot lot.
d) The Institute of Transportation Engineers ITE TRIP GEN-
ERATION, July, 1984, projects 132 trip ends per facility
during the peak hour on the adjacent street. There is no
indication of the sizes of the car washes studied to obtain
this data.
e) The applicant's data showed 46 trip ends during the peak
hour at an Essex Junction facility and 76 at the Seaway car
wash in South Burlington for an average of 61 trip ends.
These counts were taken during separate seasons (winter and
summer) and the high and low seasons were averaged to
achieve the 61 trip ends. Car wash facilities typically
experience the peak operation during the winter months.
f) The proposed facility can handle 40 cars per hour (80
trip ends) due to the physical capacity of the drive -through
facility.

g) The applicant incorrectly used the average trip
generation rate during the peak period of the adjacent
street trafic (54) rather than the peak hour of the genrator
during the adjacent street traffic (61).
h) The applicant stated that the average trip genration
will not exceed 65 vehicle trip ends during the peak period
on Shelburne Road. (letter of May 1, 1986)
i) The level of service for north bound left turns into the
facility will operate at level of service "C". For exiting
traffic, the level of service will be "F" for northbound and
"C" for south bound right turns with a two lane exit
driveway.
j) The level of service at the nearest signalized
intersection(Green Mountain Drive/Bartlett Bay
Road/Shelburne Road is "D".
Therefore the Planning Commission denies this application for
exceeding the traffic overlay standard of 65 trip ends and the
level of service "C" standard of Section 11.504 since none of the
provisions of section 17.50 for increased traffic volumes in the
Traffic Overlay Zone apply.
Furthermore, this is denied since according to Section 17.30 the
peSM-INur volumes should be used, not the average of the summer
peak an�l the winter low figure.
