The amendment consists of -1) increasing the general office use by 1030 sq. ft. to a total of 3440 sq. ft., and 2) increasing the wholesale establishment use by 658 sq. ft. to a total of 4522 sq. ft., and 3) adding 1688 sq. ft. of mezzanine space, 1800 Shelburne Road. COMMENTS Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the revised plans submitted on October 24, 2011 and have the following comments. Pursuant to Section 14.03(A)(6) of the Land Development Regulations, any PUD shall require site plan approval. Section 14.06 establishes the following general review standards for all site plan applications: The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. There is no new construction. Staff does not recommend any changes to the site owing to this application for a change in use. Chapter 14.06 of the South Burlington Land Development Regulations states the following: Parking: (a) Parking shall be located to the rear or sides of buildings. Any side of a building facing a public street shall be considered a front side of a building for the purposes of this subsection. (b) The Development Review Board may approve parking between a public street and one or more buildings if the Board finds that one or more of the following criteria are met. The Board shall approve only the minimum necessary to overcome the conditions below. (i) The parking area is necessary to meet minimum requirements of the Americans with Disabilities Act; (ii) The parking area will serve a single or two-family home, CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING (iii) The lot has unique site conditions such as a utility easement or unstable soils that allow for parking, but not a building, to be located adjacent to the public street; (iv) The lot contains one or more existing buildings that are to be re -used and parking needs cannot be accommodated to the rear and sides of the existing building(s), or, (v) The principal use of the lot is for public recreation. (c) Where more than one building exists or is proposed on a lot, the total width of all parking areas located to the side of building(s) at the building line shall not exceed one half of the width of all building(s) located at the building line. Parking approved pursuant to 14.06(B)(2)(b) shall be exempt from this subsection. (d) For through lots, parking shall be located to the side of the building(s) or to the front of the building adjacent to the public street with the lowest average daily volume of traffic. Where a lot abuts an Interstate or its interchanges, parking shall be located to the side of the building(s) or to the front adjacent to the Interstate. Parking areas adjacent to the Interstate shall be screened with sufficient landscaping to screen the parking from view of the Interstate. The majority of the site is pre-existing. Therefore, subsection (b)(iv) applies. There is no additional construction and therefore the application does not meet a threshold to warrant the movement of what parking already exists. 3,440 sq. ft. of general office use will require 12.04 parking spaces. 3,426 sq. ft. of retail use will require 17.13 parking spaces. 4,522 sq. ft. of wholesale use will require 2.26 parking spaces. Therefore, a total of 32 parking spaces are required. The plans show 31 spaces. Therefore, the applicant is seeking a parking waiver of 1 space, or 3.1 %. Staff fully supports this parking waiver. The site is located directly adjacent to well -established public transportation corridor. 1. The Board grants a parking waiver of 1 space or 3.1 %. Section 13.01(G)(5) requires that bicycle parking or storage facilities are provided for employees, residents, and visitors to the site. A bicycle rack is shown on the plans. Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. There are no changes proposed to the height of the existing building. CITY OF SOUTH BURLINGTON 4 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. There are no changes proposed to the existing building. Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. There are no changes proposed to the existing building. In addition to the above general review standards, site plan applications shall meet the following specific standards as set forth in Section 14.07 of the Land Development Regulations: The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not find the reservation of any additional land is warranted as part of this application. Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). The plans show a proposed dumpster, adequately screened. Landscaping As there is no new construction, there are no additional landscaping requirements. Lighting CITY OF SOUTH BURLINGTON 5 DEVELOPMENT REVIEW BOARD DEPARTMENT OF PLANNING & ZONING Pursuant to Appendix A.9 of the Land Development Regulations, luminaries shall not be placed more than 30' above ground level and the maximum illumination at ground level shall not exceed an average of three (3) foot candles. Pursuant to Appendix A.10(b) of the Land Development Regulations, indirect glare produced by illumination at ground level shall not exceed 0.3 foot candles maximum, and an average of 0.1 foot candles average. Other- Traffic The change in uses is estimated to generate an additional 5.43 pm peak hour vehicle trip ends. The applicant will be required to pay traffic impact fees based on this increase. COMMENTS Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the revised plans submitted on September 15, 2011 and have the following comments. SITE PLAN REVIEW STANDARDS Pursuant to Section 14.03(A)(6) of the Land Development Regulations any PUD shall require site plan approval. Section 14.06 establishes the following general review standards for all site plan applications: The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. There is no new construction. Staff does not recommend any changes to the site owing to this application for a change in use. Chapter 14.06 of the South Burlington Land Development Regulations states the following: Parking: (a) Parking shall be located to the rear or sides of buildings. Any side of a building facing a public street shall be considered a front side of a building for the purposes of this subsection. (b) The Development Review Board may approve parking between a public street and one or more buildings if the Board finds that one or more of the following criteria are met. The Board shall approve only the minimum necessary to overcome the conditions below. (i) The parking area is necessary to meet minimum requirements of the Americans with Disabilities Act, (ii) The parking area will serve a single or two-family home; (iii) The lot has unique site conditions such as a utility easement or unstable soils that allow for parking, but not a building, to be located adjacent to the public street, CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING (iv) The lot contains one or more existing buildings that are to be re -used and parking needs cannot be accommodated to the rear and sides of the existing building(s); or, (v) The principal use of the lot is for public recreation. (c) Where more than one building exists or is proposed on a lot, the total width of all parking areas located to the side of building(s) at the building line shall not exceed one half of the width of all building(s) located at the building line. Parking approved pursuant to 14.06(B)(2)(b) shall be exempt from this subsection. (d) For through lots, parking shall be located to the side of the building(s) or to the front of the building adjacent to the public street with the lowest average daily volume of traffic. Where a lot abuts an Interstate or its interchanges, parking shall be located to the side of the building(s) or to the front adjacent to the Interstate. Parking areas adjacent to the Interstate shall be screened with sufficient landscaping to screen the parking from view of the Interstate. The majority of the site is pre-existing. Therefore, subsection (b)(iv) applies. There is no additional construction and therefore the application does not meet a threshold to warrant the movement of what parking already exists. 2,410 sq. ft. of general office use will require 9 parking spaces. 3,426 sq. ft. of retail use will require 18 parking spaces. 3864 sq. ft. of wholesale use will require 2 parking spaces. Therefore, a total of 29 parking spaces are required. The plans show 33 spaces. However, staff has concerns about three of these spaces and recommend they be removed as parking spaces. One is inaccessible, one blocks a door, and one could be removed to facilitate access to the proposed dumpster. These will be identified at the hearing. 30 spaces would remain which is sufficient to meet the needs of the proposed uses. 1. The plans should be revised to remove the three spaces identified by staff. Section 13.01(G)(5) requires that bicycle parking or storage facilities are provided for employees, residents, and visitors to the site. A bicycle rack is shown on the plans. Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. There are no changes proposed to the height of the existing building. Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. CITY OF SOUTH BURLINGTON 4 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. There are no changes proposed to the existing building. Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. There are no changes proposed to the existing building. In addition to the above general review standards site plan applications shall meet the following specific standards as set forth in Section 14.07 of the Land Development Regulations: The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not find the reservation of any additional land is warranted as part of this application. Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). The plans show a proposed dumpster, adequately screened. Landscaping As there is no new construction, there are no additional landscaping requirements. Lighting Pursuant to Appendix A.9 of the Land Development Regulations, luminaries shall not be placed more than 30' above ground level and the maximum illumination at ground level CITY OF SOUTH BURLINGTON 5 DEVELOPMENT REVIEW BOARD DEPARTMENT OF PLANNING & ZONING shall not exceed an average of three (3) foot candles. Mr. Dinklage said the applicant is not joining the properties as a PUD and that the other property would still have legal uses that would generate traffic, so this is a specious argument. Mr. Seaver, attorney for the applicant, said the contract with Spillanes prohibits the property from being used for gas sales. Mr. Belair said the regulations do not allow transfer of traffic credits form one property to another. Section 19.10 of the South Burlington Zoning Regulations (attached) requires site plan approval for any new use, change in use, or expansion of use. The Planning Commission has determined that a change in use occurs when there is a change from one permitted or conditional use category to another permitted or conditional use category (e.g. retail business to hotel). The Commission has determined that an expansion of use occurs when one of the following is met: 1. An addition to a building is proposed whereby there is an increase in building square footage, or 2. There is a change in business within a specific permitted or conditional use category which results in greater traffic genera- tion, sewer usage or increased parking space requirement. An example of this situation would be a change from a "quality" restaurant to a "high -turnover" restaurant. High -turnover res- taurants tend to generate a significantly greater amount of traffic during the peak hour and, therefore, is considered to be an expansion of use. In regards to the Portland Glass building, this building was approved by the Commission in 1982 for retail and wholesale sales of glass, metal, frames, glazing, and related products. Mr. Burgess said the traffic analysis talks about gas customers but does not mention ATM users. He felt the ATM users were not people stopping for gas on the way home but were people going for that specific purpose, especially students from the UVM dorms. Mr. Alexander said they think most will be combination trips and are included in the 79 trips. Mr. Burgess did not agree. He felt the students from the dorms would come just for the ATM. He said it would not be hard to tell when the ATM users are coming from. He felt there would be too many people making left turns when they leave to get back to UVM. Ms. Scannell reminded the Commission of the Comprehensive Plan and specifically the Land Use section which states the city's intention to protect neighborhoods from commercial encroachment and traffic problems. Ms. Bull noted this is at least the 5th time the plan has been seen by the Commission and there have been all kinds of different traffic figures. She asked what could be believed. Mr. Burgess noted that the project traffic numbers all come from the applicant. Mr. Alexander said the earlier numbers were based on a larger store and more fueling positons which generate more traffic. Ms. Bull said that at the June 3 Zoning Board hearing, the applicant estimated 119 peak hour trip ends with the same size building (900 sq. ft.). She said the overlay zone is there to protect the community from too much traffic. She asked that it be adhered to. She also noted that the Commission had allowed the additional trip ends based on the 4th lane onto Spear Street which is no longer part of this plan. Mr. Atherton said he is totally opposed to the plan. He is concerned with student use of the ATM which would be a dangerous situation. Mr. Burgess said the land is zoned commerical and there will be a commercial use there. The question is the best use. Mr. Teeson asked the rationale for dropping the 4th lane on Spear Street. He said the Commission felt that was an improvement. He felt that without it there was a "shortcut" situation to avoid the traffic light. Site plan application -Portland Glass, Inc., for a 9600 sq. ft. building on lot 1 of the Bartlett property on Shelburne Road Mr. Spitz noted that this was the first lot for the LTH development. It was discovered recently that they will need conditional use approval by the Zoning Board, so they will have to seek that approval after this hearing. Mr. Kim Morrow, representing Portland Glass, said the building would be 80' x 1001, with a retail area of 40' x 80'. The lot will be gravelled. About 25' away from the building there will be a small swale for drainage, which will go into an existing Swale. The company expects 1 semi per week and has shown a jag in the parking lot for easier access to the building for these trucks. Mr. John Larkin, of LTH, was told there would have to be a temporary turnaround where the new main road ends. The Commission also felt the jag in the parking lot for truck access should have the shape changed slightly. Mr. Morrow, of Portland Glass, said they did not do much retail business - they need storage area since they do a lot of construction work. Szymanski, City Manager Re: Portland Glass 1) Proposed "Town Road" should be built at least beyond the entrance with a temporary turnaround. 2) Site drainage incomplete. It should be intercepted by proposed street system. 3) Street curb to be across entrance drive. Memorandum Next week's agenda Items 9/10/82 Page 2 Private streets have never before been approved for a single- family development (except for the temporary approval at Meadow - wood at Spear). This concept will only work if the land is in single ownership as proposed. We may have to explore legal options for stipulating new maintenance responsibilities if ownership changes. Even if private ownership of streets is approved, they may have to be designed to allow for future public maintenance. A usable precedent is the ring road in the Stonehedge Development which includes a 24 foot wide paved street with 3 foot shoulders on either side, all constructed to City standards, plus a reduced setback (5' in Stonehedge, perhaps 10' here) from a 60' wide right-of-way. Sidewalks should be considered. Also, off street parking spaces may have to be shown on the plan. Landscaping requirements also should be similar to a condominium development. Utilities also will be critical in determining the feasibility of this project. Many questions on water pressure, sewer flow, etc. cannot be fully answered until engineering review as part of the final plat procedure. 5) Claussen's Application is for use of an existing building (previously a gas station) on a portion of the Pappas property on Shelburne Road. Mid- way Oil's application for a gas station and convenience store at this location was turned down last October (see enclosed minutes). Traffic volume has been difficult to evaluate because of the seasonal nature of the business. I hope to have additional information prior to Tuesday's meeting. This may also affect parking requirements. Pappas's property has four curb cuts (2 for the restaurant and 2 for this building) within 250 feet of road frontage. Several of those curb cuts should be consolidated. 6) Portland Glass Application is for an 80'xl20' building for the storage and sale of glass, metal, and related products. The uses must also be approved by the Zoning Board under conditional use review. The building will be located on Lot 1 of LTH's Bartlett Property development. The access is 250' from Shelburne Road as stipulated. Customer traffic is expected to be very low. Also, there are a total of 14 employees, 8 company trucks, and deliveries 2-4 times per week. This should not be a heavily traveled site. I still need further information on the extent of cut and fill operations. Also, the size of the culvert under the driveway should be checked. Box 82 Montpelier, Vermont 05602 Dear Mr. Morrow, I recieved the application for Portland Glass, Inc., today and have several comments: 1) In the final plat approval for the LTH Subdivision it was stipulated that the dgiveway entrance for this lot be 250' from Shelburne Road rather than the 200' as shown. 2) South Burlington's landscaping formula requires that 3% of the construction cost of a building be devoted to new plantings. In this case, you must provide 95400 of new landscaping (installed cost of trees and shrubbery). Size, type, and location of new plant- ings must be indicated. 3) If I read your plans correctly, loading docks will be on the side of the building facing Shelburne Road. This will certainly not be the best 1pyout from an aesthetic standpoint, and I wonder if you have considered any alternatives. 4) You shall give an indication of how many employee and cus- tomer parking spades will be required and where they will be located. Please also indicate where company vehicles will be parked, if any. 5) Also, please indicate what types of trucks will be used. If services are to be accommodated, I question whether there is suf- ficient loading and back-up room and also whether they will be able to negotiate the turn at the entrance to the property. 6) Your finished contours seem to indicate a very steep parking lot in one area. I would suggest more detail, preferably 2 foot contours, to show more clearly how grading of the parking areas will be handles.
