HomeMy WebLinkAboutCU-96-0000 - Decision - 1800 Shelburne Road0 STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 23rd day of September, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use application of Roger & Karen Howard, 1800 Shelburne Road, this meeting was also attended by Brian Waxler, agent for the property owner. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned C-2 District. 2) Section 13.20 Conditional uses requires approval by the Board of Adjustment for the proposed use, Section 26.05 applies. 3) The proposed use marine sales and service will occupy an existing 9,600 square foot structure. 4) This property is a corner lot located on Shelburne Road and Harbor View Road and contains 1.12 acres. 5) The former use of the property was Portland Glass. Conclusion 1) The proposed use complies with the purpose of the district. C-2 District provides for automotive type uses to include sales and service of boats. 2) Based on testimony a high volume day would be estimated at 12 to 15 customers, traffic generated should be less than the prior use. 3) Proposed use should not have any adverse impacts on municipal facilities. 4) Should have no impact on the essential character of the area. General character of area being automotive sales, car washes and light industrial. 1 Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to operate a marine sales and service to include outside boat display located at 1800 Shelburne Road. kna3,rman,l South Burlington Zon ng Board of Adjustment OCT 14 44Rs E
