HomeMy WebLinkAboutSP-96-0000 - Decision - 1800 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Roger & Karen Howard to convert a 9,700 square foot retail building to marine sales and service, 1800 Shelburne Road. On the 22nd day of October, 1996, the South Burlington Planning Commission approved the request of Roger & Karen Howard for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of converting a 9,700 square foot retail building to marine sales and service. This building was approved on 9/14/82. The ZBA on 9/23/96 granted the applicant a conditional use permit for the proposed use. 2. This property located at 1800 Shelburne Road lies within the C2 District. It is bounded on the north by Harbor View Road, on the south and east by a car wash and car care center, and on the west by Shelburne Road. 3. Access/circulation: Access is provided by a 24 foot curb cut on Harbor View Road. No changes proposed. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 21.6% (maximum allowed is 30%). Overall coverage is 61.4% (maximum allowed is 70%). Front yard coverage along Shelburne Road is 1.3% and along Harbor View Road is 53.5% (maximum allowed is 30%). The front yard coverage along Harbor View Road is an existing situation which will not be made worse by this application. Setback requirements are met. 5. Parking: A total 20 parking spaces are required and 32 spaces are available including two (2) handicapped spaces. A bike rack will be provided as required. Staff recommended that the angled spaces along Harbor View Road be changed to perpendicular spaces. 6. Landscaping: There is no minimum landscaping requirement, based on building costs, for the project. The site is well landscaped and no additional landscaping is recommended. 7. Traffic: ITE estimates the existing retail use to generate 46.6 vte's during the P.M. peak hour and the proposed use to generate 31.8 vte's. This represents a 14.8 vte or 31.8% reduction in traffic generated. 1 8. Sewer: No additional allocation needed. 9. Dumpster: A screened dumpster storage area will be provided. 10. Lighting: Exterior lighting consists of: --- one (1) 150 watt high pressure sodium light mounted on the east side of the building. --- one (1) floodlight mounted on the north side of the building. The existing floodlight should be replaced with a downcasting shielded fixture or modified to the City Planner's satisfaction prior to occupancy so as not to cast light beyond the property line. Details of the replacement fixture should be approved by the City Planner prior to permit issuance. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Roger & Karen Howard to convert a 9,700 square foot retail building to marine sales and service, 1800 Shelburne Road, as depicted on a plan entitled, "Howard Cove Marine, Inc, 1800 Shelburne Road, South Burlington, VT, Site Plan," dated 8/22/96, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plans shall be revised to show the changes below and shall require approval of the City Planner. Three (3) copies of the approved revised plans shall be submitted to the City Planner prior to permit issuance. a) The plan shall be revised to change the angled spaces along Harbor View Road to perpendicular spaces. A note shall also be added which indicates that the spaces along Harbor View may also be used for boat display area. b) The plan shall be revised to show one larger area where boats may be displayed in the Shelburne Road front yard. This area shall be located at least 50 feet from the Shelburne Road right-of-way. 3. The parking spaces along Harbor View Road shall be striped as perpendicular spaces as shown on the approved revised plan prior to occupancy. 4. Any new exterior lighting shall be downcasting shielded fixtures so as not to cast light beyond the property line. Any 2 d change in lighting shall be approved by the City Planner prior to installation. The existing floodlight located on the north side of the building shall be replaced with a downcasting shielded fixture or modified to the City Planner's satisfaction prior to occupancy so as not to cast light beyond the property line. 5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 6. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the building. 7.
