HomeMy WebLinkAboutSP-00-57 CU-00-26 - Decision - 1800 Shelburne Road#SP-00-57 & CU-00-26 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan application 9SP-00-57 and conditional use application 4CU-00-26 of Michael Koper to convert a 9,700 square foot building used for marine sales and service to auto and marine sales and service use, 1800 Shelburne Road. On the 5th of December, 2000, the South Burlington Development Review Board approved the conditional use application under Section 26.05 and site plan application under Section 26.10 of the South Burlington Zoning Regulations of Michael Koper based on the following findings: 1. This project consists of converting a 9,700 square foot building used for marine sales and service to auto and marine sales and service use. 2. The owner of record of this particular property is Burlington House, Inc. 3. This property located at 1800 Shelburne Road lies within the Commercial Two District. It is bounded on the north by Harbor View Road, on the south and east by a car wash and car care center, and on the west by Shelburne Road. 4. Access/Circulation: Access is provided by a 24 foot curb cut on Harbor View Road. No changes were proposed. 5. Coverage/setbacks: Building coverage will remain 21.6% (30% max) and total coverage will remain 48.9% (70% max). Front yard coverage along Shelburne Road is 1.3% and along Harbor View Road it is 53.5% (30% max). The front yard coverage along Harbor View Road is an existing situation and no changes are proposed. The boat and car display areas have been taken into account in factoring the coverages. 6. Parking: A total of 20 parking spaces are required and 27 spaces are being provided. Two handicapped spaces and a bike rack are also provided. The previous approval of this property approved parking spaces and boat display areas. The parking spaces should be striped and the boat/car display area should be striped as a no parking area. There are currently boats being displayed in parking spaces and cars parked in the display areas. 7. Landscaping: There is no minimum landscaping requirement based on building costs for this project. The site is well landscaped and no additional landscaping was recommended. 8. Traffic: This property is approved for 31.8 P.M. peak vehicle trip ends (vte's). ITE estimates that zero additional P.M. peak vte's will be generated by the proposed use. 9. Sewer: No additional allocation is needed. 10. Dumpster: A dumpster storage area is depicted on the plans. The dumpster storage area should be screened on three sides. 11. Lighting- No changes are proposed. All lights must be downcasting and shielded. Any changes to the lighting should be approved by staff. 12. Conditional Use Criteria: The proposed use complies with the stated purpose of Commercial Two District to encourage "general commercial activity". The proposed use will not adversely affect: a) the capacity of existing or planned community facilities. No affect expected. b) the character of the area affected. No affect expected. c) traffic on roads or highways in the vicinity. The proposed use is estimated not to create additional traffic. d) bylaws in effect. The proposal is in conformance with the zoning regulations. e) utilization of renewable energy resources. There is no utilization of renewable energy resources to be affected. f) general public health and welfare. No adverse affect expected. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves site plan application #SP-00-57 and conditional use application #CU-00-26 of Michael Koper to convert a 9,700 square foot building used for marine sales and service to auto and marine sales and service use, 1800 Shelburne Road, as depicted on a plan entitled "California Cars & Howard Cove Marine, Inc. 1800 Shelburne Road South Burlington, VT", dated 10/9/00, with the following stipulations: 2 All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the change in use will generate zero additional vehicle trip ends during the P.M. peak hour. 3. All lighting shall be downcasting and shielded fixtures. Any change to approved lights shall require approval of Administrative Officer prior to installation. 4. The parking spaces shall be striped and the boat/car display area shall be striped as a no parking area prior to obtaining a Certificate of Occupancy/Compliance. 5. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the newly converted space. 6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the Zoning Regulations or this approval is null and void. 7.
