During discussion at that hearing, Agency Car Rental stated that no more than ten (10) vehicles could be on site at any one time. According to the plan of record, seven (7) vehicles would park along the easterly side of the rear parking lot and three (3) vehicles would park in the north westerly section of the front parking lot. As the result of an inspection of the Portland Glass/Agency Car Rental sites, it appears that you are violating the parking plan submitted to the Zoning Board of Adjustment. On this date, six (6) vehicles were parked in the front lot and a pick-up with car caddy was parking within the street right-of-way. As you are aware, the City has concerns regarding the parking of rental cars within areas designated for customer parking. Only three (3) vehicles are permitted within the front lot and no vehicle should be parked in the street. I would suggest that you police the parking for Agency Car Rental. Should you continue to violate, you could be subject to review by the Zoning Board of Adjustment. If you have any questions, please don't hesitate to call me. ZONING HOARD OF ADJUSTMENT FEBRUARY 24, 1992 The South Burlington Zoning Board of Adjustment held a meeting on Monday, February 24, 1992 at 7:00 p.m. at the City Hall Room, 575 Dorset Street. Members Present Maureen O'Drien, George Chamberland, Joe Randazzo, Stephen Kramer and Dennis Johnson Members Absent Fred Blais and Dan King Others Present Dick Ward, Zoning Administrator, Sid Poger, The Other Paper, Joe McGovern, Bill Rowell, Kathy Paskevich, Steve Abair, Christopher Tintle, D.J. Corbitt, John Kennedy and Tom Anderson Maureen O'Brien, Co -Chairwoman, heard the appeals and informed everyone that they needed four yes votes to have an appeal approved and they had the option of having their appeal heard at the next meeting. No. 1 Appeal of Portland Glass/Agency Car Rental Appeal of Portland Glass, Rick Lefebvre agent, seeking approval from Section 19.65 Multiple uses and Section 12.20 Conditional uses (automobile rental). Request is for permission to operate an automobile rental agency in conjunction with an existing auto and plate glass business d.b.a. Portland Glass located at 1800 Shelburne Road. Mr. Ward informed the Board that on 12/9/91 the Zoning Board of Adjustment granted Mery Brown of Plaza Investments a variance which allowed for Agency Car Rental to operate from 1350 Shelburne Road with a review after the termination of the lease (April 1992). The area is in the C-2 District. Section 12.20 Conditional uses, sub section 12.226 automobile rental. Section 19.65 MUltipla uses - sub section A - two or more uses in a principal building (Section 19.05) applies). Proposed use - Agency Rental Car (800 square feet and 10 parking car). Existing use automobile glass and plate glass sales and service. Building is 80' x120' -- 9600 square feet. Lot 200' x400' - 80,000 square feet. Mr. Joe McGovern addressed the following criteria for the conditional use. 1. The proposed use complies with the stated purpose of district C-L. 1 2. The proposed use will not adversely affect educational . facilities, the character of the neighborhood, the traffic on the roads, the bylaws in effect or the utilization of renewable energy resources. Mr. Ward asked what they will do if they have more than 10 cars. Mr. McGovern stated it is written in the lease that if they exceed 10 cars they will need to handle the situation quickly to reduce the cars to ten. Mr. Ward asked if they are going to do any outside maintenance like vacuuming, windshield washing and so forth. Mr. McGovern stated changing tires concerned him but light maintenance is okay. Mr. Ward asked Agency Car Rental if they will have a vacuum. Mr. Tintle replied they have an arrangement with Jiffy Lube to vacuum the cars and if there is a situation where they don't have a lot of time, they will vacuum the cars themselves. Mr. Ward asked if Agency Car Rental owned the used tires behind the building near the dumpster. Mr. Tintle stated he has no knowledge of the tires. Mr. Ward stated he was concerned with used tires around the building and the vacuum cleaner sitting in the snowbank. Mr. .� McGovern replied they will not pay for the removal of the used tires and they will monitor that situation closely. They need a vacuum because they use glass to repair the vehicles. As far as oil changes and tire changes, that will not be tolerated. Mr. Johnson asked Mr. McGovern if this is stated in the lease. Mr. McGovern stated the lease was not completed but he had informed his attorneys to include not being able to change tires. Changing the oil and vacuuming was not discussed with his attorneys. Mr. Tintle again stated he did not know where the tires came from. They have an arrangement with the service station to change tires and dispose of tires. They do not have the equipment or manpower to change tires. Mr. Kramer asked if Agency Car Rental has c,_Istomers that come and go. Mr. Tintle replied they deliver 75% of their cars. Only a small amount of their business come in the office. The appeal was granted unanimously.
