Low to medium height shrubs were added to the front of the proposed building and parking lot (refer to drawing D-2313 for plant material species and locations). In addition, Mr. Allocca has agreed to turn off the Acura sign light, and to reduce the intensity of the parking lot lights between the hours of 10:00 p.m. to 7:00 a.m. However, we wish to leave 3-4 parking area lights on for security reasons at the back and sides of the building. Other Business Mrs. Lafleur brought to the Commissions attention a question on the Allocca approval. Mr. Llewellyn explained that the New Jersey architects had considered the mezanine part of the footprint and it had never been considered in trip end cal- culations. Mrs. Lafleur said the overlay zone allows 61 trip ends, and with the mezzanine the development will produce 61.1. The contribution to the Shelburne Rd. Intersection Improvement Fund will be increased. Mrs. Hurd moved that the Planning Commission approve the amended site lan application of Frank Allocca for construc- tion of a 13,350 sq. ft. automobile dealership at 1795 Shelburne Road as depicted on a plan entitled "Frank Allocca Property - Site Plan, Fassetts Bakery, lot 2� Shelburne Road" prepared bv Fitzpatrick -Llewellyn, dated September, 1987, stamp dated October 5, 1987 with the following stipulations: 1. The property is zoned Commercial Two and this is a conditional use. Zoning Board of Adjustment approval is required. Access: The plans show access from a shared 24 foot wide curb cut with lot #3 to the north. Mr. Allocca also owns lot #3. Circulation: Circulation is available on the northern and western side of the building. Parking: Twenty parking spaces are required in addition to vehicle storage and display areas. The plans show 95 spaces. Landscaping: A $12,500 plan is required. The plans show approxi- mately $9000. Revised plans should be submitted to me prior to permit. The building covers 18% of the lot. Total lot coverage is 69.9%. Traffic: The 1.24 acre parcel is in traffic overlay zone 5 and permits 61 trip ends. The proposed use will generate 45 trip ends according to the applicant. This number is confirmed by ITE. A $1155 contribution to the Shelburne Road intersection improvement fund is required based on the 45 trip ends. Other: This property is in the path of the proposed South Burlington Southern Connector ramp. Although this should have no bearing on your decision, it is important to know. A review by Heindel and Noyse is required. The Commission should decide whether to review that study when it is available or whether to allow the City Manager's review as a conditional of approval. See Bill Szymanski's and Chief Goddette's comments. 4) BERARD, 73 ETHAN ALLEN DRIVE Allan Berard proposes to construct a 2400 square foot addition to the existing 2400 square foot building at 73 Allen Drive. The property is zoned Industrial -Commercial and the building is used for Allans Excavating Company. Access: Access does not change from the existing driveway. ALLEN BERARD, ETHAN ALLEN DRIVE I do not see a problem with this addition. 5) FRANK NAEF, 1908 AIRPORT PARKING Only problem I see at this time is the driveway around the property does not meet code for access of emergency equipment and I do not feel it would be approved by the State. 1 STATE OF VERMONT DISTRICT ENVIRONMENTAL COMMISSION #4 RE: Frank Allocca Application #4C0339-6 RD#2, Box 1179A Findings of Fact and Chester, NJ Conclusions of Law and Order, 10 V.S.A., Chapter and 151 (Act 250). Fassetts Bakery c/o Peter Bouyea 1805 Shelburne Road South Burlington, VT I. INTRODUCTION Application #4C0339-6 was filed by the above referenced applicants to construct a 13,350 square foot commercial building on Lot #2 of a previously approved 3 lot commercial subdivision located off of Route 7 in South Burlington, Vermont The tract of land consist of 1.24 acres located off of Route 7 in South Burlington, Vermont owned in fee simple by Fassetts Bakery and held under option by Frank Allocca. Under Act 250, projects are reviewed based on the 10 criteria of 10 V.S.A., Section 6086(a) 1-10. Before granting a permit, the District Environmental Commission must find that the project complies with these criteria and is not detrimental to the public health, safety or general welfare. Decisions must be stated in the form of findings of fact and conclusions of law. The facts we have relied upon are contained in the documents on file identified as Exhibits #1 through #38 and the evidence received at a hearing held on February 22, 1988. The hearing was recessed pending the submission of additional information. The hearing was adjourned on March 4, 1988 upon receipt of the information and completion of Commission deliberation. Parties to the application who attended the hearing are: The Applicant by Lance Llewellyn. The Chittenden County Regional Planning Commission by Craig T. Leiner. Page 2 Findings of Fact #4C0339-6 Entry of Appearance and Pre Hearing Comments by Fred Emigh of the Agency of Environmental Conservation were entered into the record. 14B Parties were admitted under the following Criteria: 1. Rita and Al Reyes were admitted under Criterion 8 (Aesthetics). II. FINDINGS OF FACT In an effort to expedite the permit process, the Commission prior to taking evidence with regard to the ten Criteria of 10 V.S.A., Section 6086(a), and the Parties agreed that the Applicant had met its burden with respect to Criteria 1(Air), 1(A) Headwaters, 1(C) Water Conservation, 4 Soil Erosion by introducing the application into the record. Parties, therefore waived the issuance of written findings concerning these Criteria. The following written findings are limited to Criterion 1(B) Waste Disposal, Criterion 5 Traffic, Criterion 7 Municipal Services, Criterion 8 Aesthetics, and Criterion 9(F) Energy Conservation. SECTION 6086(a) (1) WATER AND AIR POLLUTION: The Commission finds that this development will not result in undue air pollution. This finding depends on and is supported by the findings noted under the subsections of this criterion: SECTION 6086(a) (1) (B) WASTE DISPOSAL: The Commission finds that this development will meet applicable Division of Protection Regulations and will not result in the injection of waste materials or harmful or toxic substances into groundwater or wells. This finding depends on and is supported by the following: 1. The proposed buildings will generate a total of gallons of sanitary waste per day. 2. A Public Building Permit has been issued for the development (PB-4-1430, Exhibit #35). Page 3 Findings of Fact #4C0339-6 3. Stormwater from the paved drive and parking areas, roofs and green spaces will pass through the grassed swale to the west of the site. The pre -development peak discharge in Barlett Brook is 202.28 cfs, the post -development peak discharge is 200.99 cfs, therefore there is no increase in peak discharge in Bartlett Brook (Exhibit #23). 4. A Stormwater Discharge Permit has been applied for by the Applicant (Testimony of Mr. Llewellyn). 5. The use of the building will use, generate and store oil which will be stored above ground as indicated on Exhibit #38 (Testimony of Mr. Allocca). 6. There will be no underground fuel storage tanks of any size on the site (Testimony of Mr. Allocca). 7. The floor drains in the inside of the building are connected to a grit/oil separator prior to discharge into the municipal sewer system (Exhibits *15 and #37). The Commission will require that prior to commencement of construction the Permittee shall file a Discharge Permit for stormwater with the District Environmental Commission. In addition, due to the increase in peak run-off from the site which will be passing through the grassed swale to the west of the site, the Commission will require that the swale be adequately stabilized to handle the projected increase in flow without erosion and shall retain the right to schedule hearings and to evaluate and impose additional conditions with respect to stabilization until the bank is fully stabilized. Finally, all catch basins on site should be sumpad and hooded to maximize the retention of particulate matter as well as oils and greases and curbing should not be installed on the downgradient edge of paved areas but rather sheet flow off the paved areas to the adjacent grass buffer strips (particularly to the west). Grit/Oil Separators require regular maintenance and inspection to be effective, therefore the Commission will require that the separators be inspected and if necessary cleaned at least 4 times per year. Finally, the Commission will require the Permittee to file an application with the Waste Management Division for notification of hazardous wastes. Page 4 Findings of Fact #4C0339-6 SECTION 6086(aJ_(5) TRANSPORTATION: The Commission finds that this development will not cause unreasonable congestion or unsafe conditions with respect to transportation. This finding depends on and is supported by the following: 8. Entrance to the development is from Route 7 and will share the access with the adjoining lot (Lot #3) (Exhibit #11). 9. There will be an estimated 463 average weekday vehicle trip ends; 38 am peak hour vehicle trip ends and 45 pm peak hour vehicle trip ends (Exhibit #11). 10. An intersection capacity analysis indicated the Level of Service at the northbound left -turn and Shelburne road at "C" L.O.S. and the eastbound left and right turns at the access point to be "E" L.O.S. (Exhibit #11). 1.1. The Applicant has contacted the Location and Environmental Engineer at the Agency of Transportation regarding southern terminus of the proposed South Burlington Conector Highway (Exhibit #29). 12. The Location and Environmental Engineer at the Agency of Transportation concludes that the degree of impact, if one exists, cannot be determined (Exhibit #29). 13. A letter of intent has been issued by the Agency of Transportation for access onto Route 7 (Exhibit #28). The Commission agrees with the conclusions of the traffic report which indicates that unsignalized intersections in urban areas at local streets with arterial streets often experience operational problems of acceptable gaps for minor street traffic. In such cases, L.O.S. "E" is often encountered on the minor street approaches. Improvements of the intersection are usually not warranted until conditions on the minor street approach drop to L.O.S. "F". SECTION (a) (7) MUNICIPAL SERVICES: The Commission finds that this development will not place an unreasonable burden on the ability of the municipality to provide municipal or governmental services. This finding depends on and is supported by the following letters from the police and fire department (Exhibits #24 and #26). Page 5 Findings of Fact #4C0339-6 SECTION 6086(a) (8) AESTHETICS, SCENIC BEAUTY, HISTORIC SITES AND NATURAL AREAS: The Commission finds that the development will not have an undue adverse effect on the scenic or natural beauty of the area, aesthetics, historic sites or rare or irreplaceable natural areas. The following depends on and is supported by the following: 14. The terrain on the site slopes slightly to the west and contains open fields with the primary cover consisting of grass (Exhibit W . 15. A revised landscaping plan has been designed to complement the proposed building in addition to providing screening and bank stabilization (Exhibit #33 and #34). Primary plant materials include Austrian Pine, Honeylocust, Birch and Cherry. Several varieties of deciduous shrubs and ground covers have been included in the design to serve as foundation and understory plantings. The placement of several large trees in the front of the building is designed to soften the visual impact of the dealership and the adjacent car wash to passing motorists on Route 7 (Exhibit W . 16. Maintenance of the proposed landscaping and site improvements will be by the Owner (Exhibit #1). 17. Lighting on the plan will be both wall and pole mounted. The lighting source will be concealed so that the illumination will be contained in the area to be illuminated (Exhibits #1, #13). 18. Between the hours of 1.0:00 pm and 7:00 am, the parking lot lights will be turned off, except for 4 parking lot lights in the rear for security reasons (Exhibit 433). 19. There will be two signs identifying the dealership. The first sign will be a free standing sign. It will stand fifteen feet tall and will be 10' x 3' in dimensions. Illumination will be internal with red acrylic letters mounted on a coated aluminum non -transparent backing (Exhibit #1 and #14). i Page 6 Findings of Fact #4C0339-6 20. The sign on the building facade will occupy a maximum area of 78 square feet as allowed by the City sign ordinance. It will be red acrylic letters mounted on a coated aluminum non transparent backing and match the free standing sign, however will not be illuminated (Exhibit #1 and testimony of Mr. Allocca). 21. The Acura sign will be turned off between the hours of 10:00 pm and 7:00 am. 20. The materials used in the construction of the building consist of glass, a champagne metallic color material known as Alucobond, and a ready mixed varigated stone material (Testimony of Mr. Allocca). 21. The building elevations are depicted on Exhibit #20. The Commission will require that the Acura sign will be turned off during the hours of 10:00 pm and 7:00 am and that the parking lot lights will be turned off, except for 4 parking lot lights in the rear of the building for security purposes. SECTION 6086 a t9) (F) ENERGY CONSERVATION: The Commission finds that the planning and design of the development does reflect the principals of energy conservation and does incorporate the best available technology for the efficient use of recovery of energy. This finding depends on and is supported by the following: 22. The building will be constructed to at least provide a level of insulation equivalent to the standards outlined in ASHRAE 90:80 (Testimony of Mr. Llewllyn). 23. The bulding will be heated using the Heated -Rapid -Air concept (Testimony of Mr. Allocca). Page 7 Findings of Fact #4C0339-6 CONCLUSIONS OF LAW Based upon the foregoing Findings of Fact, it is the conclusion of this District Environmental Commission that if the project is completed and maintained in conformance with all the terms and conditions of that application, and of Land Use Permit #4C0339-6, will not cause or result in a detriment to public health, safety or general welfare under the criteria described in 10 V.S.A., Section 6086(a). This should include work on the Williston Rd. eastbound approach that may be necessary for the southbound lane to operate properly. 2. Applicant shall facilitate with the City and others con- struction within 1-1/2 years after opening of Phase II of a second left turn lane on westbound Williston Rd. at Dorset St 3. Applicant shall facilitate with the City and others con- struction of a new on -ramp (westbound to northbound) at Interchange 13, with ramp to open within 3 years with right, right, right signing. 4. Prior to obtaining a building permit for Phase II, the applicant shall obtain an air quality permit from the Agency of Environmental Conservation. 5. There is no change to the conditions of final and revised final plat approvals in the motions of January 13, 1987, April 22, 1985, and February 19, 1985. Mr. Burgess seconded the motion. Mr. Khouri said their track record should be considered. They have spent more voluntarily than by mandate. Mr. Belter said he would like to know exactly what someone is going to contribute and felt something more substantial should be worked out before there is a vote. Mr. Khouri suggested tabling the motion until acceptable language is agreed upon. Water Conservation - Water will be used for domestic purposes and car washing. Based on expected wastewater flows we estimate the average daily demand to be 500 gallons per day with a peak demand calculated at 35 gallons per minute using the fixture unit method provided in the Environmental Protection Rules. The owner will use flow restricting devices in the toilet and wash facilities provided with the project. Water service will be provided by the South Burlington municipal water department. A 12" water main is located on the eastern side of Shelburne Road with a b" line extending beneath the roadway to a hydrant on the west side of Shelburne Road. A 2 112" service connection (from the b" line) will provide water to the building. A letter requesting service has been sent to the South Burlington water department, and a response is included. 4. Soil Erosion - The soils on the site are mapped by the Soil Conservation Service as Vergennes clay. Typically, the Vergennes series is moderately well drained and the hazard of water erosion is moderate when preparing the land for seeding. Consistent with the Vermont Handbook for Soil Erosion and Sediment Control, specific site -related measures have been incorporated into the site plan. These measures consist of silt fences along the perimeter of the filled area and hay bales in the drainage ways to contain soil erosion. Sheet 1 and 5 of the enclosed plans detail the placement and maintenance of the required controls. The permanent erosion cotrol methods will include the establishment of a vegetative cover as depicted on the enclosed landscape plan. Roadway and parking areas will be paved, the storm drain outfalls will be rip -rapped and all swales over 5% in grade will be stone lined. 5. Traffic - The project is located on the west side of U.S. Route 7 in South Burlington. Access to the parcel will be from a single curb cut on Route 7 to an access drive shared with Lot #3. Application has been made to the agency of transportation regarding a highway access permit. The average daily traffic both north and south on U.S. Route 7 is 28,380 vehicle trip ends. The speed limit is 35 miles per hour with the sight distances in excess of 440' which is a safe stopping distance for an average running speed of 40 miles per hour. The enclosed traffic study by FitzPatrick-Llewellyn concludes that this project will not have an adverse impact on the existing traffic conditions in the area, at the present time or in the future. 7. Municipal Services - The Project will require the services of the South Burlington Police, Fire, Water and Sewer Departments. The proposed site plan has been reviewed by the respective departments prior to receiving City approval on October 10, 1987. Enclosed are copies of the Planning Commission approvals. 8. Aesthetics - The terrain on the site slopes slightly to the west and contains open fields with the primary cover consisting of grass. A landscape plan has been designed to complement the proposed building in addition to providing screening and bank stabilization. Primary plant materials include Austrian Pine (6'-7' B & B), Honeylocust (3"-3-1/2" caliper), Birch (10"-12" B & B), and Cherry (2-1/2" - 3" caliper). Several varieties of deciduous shrubs and ground covers have been included in the design to serve as foundation and understory plantings. The placement of several large trees in the front of the building is designed to soften the visual impact of the dealership and the adjacent car wash to passing motorists on Route 7. Refer to the landscape plan (#D-2313) for additional information. Maintenance of the proposed landscaping and site improvements will be by the Owner. The City of South Burlington has required a $14,000 landscaping bond be posted prior to the issuance of a building permit. Lighting as shown on the plan will be both wall and pole mounted. The lighting source will be concealed so that the illumination will be contained in the area to be illuminated. We have enclosed catalog sheets for the lighting type to be used, and the locations are specified on the Site Plan. As currently proposed there will be two signs identifying the dealership. The first will be a free standing sign called a ground pylon. It will stand fifteen feet tall and will be 10'x 3' in dimensions. Illumination will be internal with red acrylic letters mounted on a coated aluminum non -transparent backing. The sign on the building facade will occupy a maximum area of 78 square feet as allowed by the City sign ordinance. This Project is to develop Lot #2 of a previously approved commercial subdivision as a 9,•750 square foot auto dealership. Access onto Shelburne Road will be shared with Lot #3, which is located immediately to the north of this parcel. Lot #3 had received state and local approvals to construct a retail building on it, but those approvals have expired and the lot remains undeveloped. We understand that there are no plans at the present to develop Lot 03. An estimate of the traffic generation of this proposed use was developed through the use of trip generation rates compiled by the Institute of Transportation Engineers. Specifically, Land Use Category 841 - New Car Sale was used to estimate this Project's vehicular trip generation. Table 1 presents the results of those calculations. The design hour represents the 30th highest hourly traffic volume on an annual basis. That volume (DHV) is used as a design parameter and to evaluate the sufficiency of roadways and intersections. In urbanized areas, such as this, the DHV typically occurs during a weekday P.M. peak hour. Because both adjacent street traffic and this Project's trip generation are anticipated to peak concurrently, the capacity analysis was performed using projected P.M. peak hour volumes and directional patterns during that period. Projected 1990 design hour volumes were obtained from a report entitled "Traffic Systems Management Study, JHK & Associates, July 1987". Table 2 outlines the results of the intersection capacity analysis. Detailed calculations are included as Appendix A. TABLE 2 1990 DHV LEVELS OF SERVICE L.O.S. D conditions. Arterial streets (Shelburne Road) however, are generally designed to maintain L.O.S. C. Unsignalized intersections of local streets with arterial streets often experience operational problems because of high major street traffic flows and the corresponding lack of acceptable gaps for minor street traffic. In such cases, L.O.S. E is often encountered on the minor street approaches. Improvement of the intersection, in the form of channelization and/or lane use controls, is usually not warranted until conditions on the minor street approach drop to L.O.S. F. Future improvement of traffic conditions in this immediate area include several projects. The first, scheduled for construction in the forthcoming months, is the installation of traffic signals at Allen Road and Pine, Haven Shore Road, both to the south of this Project. The impact of those signals will be to increase the number and lengths of gaps in northbound traffic on Shelburne Road at this location. For the most part, that is a short-term improvement which will have limited impacts on traffic flow conditions. The third project i,s to widen Shelburne Road in this immediate area to four lanes with a median. This is a long-term project which is presently in the planning stages. It is likely not to see construction until 1992 or later. Its impact on traffic conditions at this location will be to eliminate all left -turning traffic both on Shelburne Road and on the minor street approach. Analysis of future traffic conditions, after completion of the third project described above, indicates that the Level of Service encountered by traffic exiting this access onto Shelburne Road will be L.O.S. A. Based on the above analyses, it is our conclusion that this Project will not create a significant adverse impact on existing traffic conditions in this immediate area.
