South Burlington Development Review Board Meeting Participation Guidelines The Development Review Board (DRB) presents these guidelines for the public attending Development Review Board meetings to insure that everyone has a chance to speak and that meetings proceed smoothly. The DRB is a Quasi -Judicial Board that oversees the approval of development projects within the City. It is made up of citizens appointed by the City Council. The role of the DRB is to hear and review applications for development under the applicable regulations. The DRB can only approve applications that comply with the applicable bylaw or state law, and the board can only levy conditions that are permitted under the bylaw. By the same token, if a project meets the applicable bylaw criteria, the DRB is bound by law to grant the approval. 1. The Board asks that all participants at meetings be respectful of Board members, staff, applicants and other members of the public present at the meeting- 2- Initial discussion on an agenda item will generally be conducted by the Board and the applicant. As this is our opportunity to engage with the subject, we would like to hear from all Board members first. After the Board members have discussed an item, the Chair will open up the floor for public comment. Please raise your hand to be recognized to speak and the Chair will try to call on each participant in sequence. 3. Once recognized by the Chair, please identify yourself to the Board. 4. If the Board suggests time limits, please respect them. If the MUNICIPALITY files with the BANK a statement that the DEVELOPER is, in the judgment of MUNICIPALITY, in default under the terms of this Agreement, the BANK shall pay monies from said escrow fund to the MUNICIPALITY, in the amount(s) requisitioned by the MUNICIPALITY to complete the Improvements and satisfy the requirements in this Agreement. 6. The MUNICIPALITY will promptly submit to the DEVELOPER a copy of such statement as it files with the BANK. The consent of the DEVELOPER to payments by the BANK to the MUNICIPALITY shall not be required or solicited. The BANK shall incur no liability to the DEVELOPER on account of making such payment to the MUNICIPALITY, nor shall the BANK be required to inquire into the propriety of any claim by the MUNICIPALITY of default on the part of the DEVELOPER or into the use of such funds by the MUNICIPALITY in completing such Improvements. 7. The MUNICIPALITY shall not file with the BANK a statement of default until ten (10) days after notice has been sent by it to the DEVELOPER by certified mail, return receipt requested, setting forth its intention to do so. 8. All monies released by the BANK to the MUNICIPALITY pursuant to Paragraph 4 shall be used by the MUNICIPALITY solely for the purpose of performing obligations imposed upon the DEVELOPER by that portion of this Agreement upon which the DEVELOPER is then in default. Any work to be performed by the MUNICIPALITY pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the MUNICIPALITY with its own work force and equipment or shall be accomplished in such a manner as in the judgment of the MUNICIPALITY shall accomplish the work most expeditiously and economically. 9. If monies are released by the BANK to the MUNICIPALITY pursuant to Paragraph 4 and it shall later develop that a portion of the released monies are surplus to the MUNICIPALITY=s needs, any such surplus shall be returned by the MUNICIPALITY to the BANK to be held and distributed by the BANK pursuant to the terms of this Agreement. 10. The BANK shall not refuse or delay to make such payments to the MUNICIPALITY when requested by the MUNICIPALITY by an appropriate statement, and DEVELOPER will not interfere with or hinder such payments by the BANK to the MUNICIPALITY. 11. This Agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the Warranty Period set forth in Paragraph 2. 12. This Agreement shall not only be binding upon the parties hereto, but also their respective heirs, executers, administrators, successors, and assigns. 13. In the event that DEVELOPER furnishes MUNICIPALITY with an Irrevocable Letter of Credit, in form and substance satisfactory to MUNICIPALITY, as replacement security for the funds escrowed hereunder, and the MUNICIPALITY concludes that it is beneficial to the MUNICIPALITY to do so, the MUNICIPALITY may release the funds escrowed by this agreement and accept the Letter of Credit, provided the BANK reconfirms, in writing its commitment to the terms and conditions contained herein. 14. BANK as Escrow Agent. (a) As escrow agent hereunder, BANK, acting in such capacity, shall have no duties or responsibilities except for those expressly set forth herein. (b) DEVELOPER shall indemnify and hold harmless BANK against any loss, damage or liability, including, without limitation, attorney=s fees which may be incurred by the BANK in connection with this Agreement, except any such loss, damage or liability incurred by reason of the gross negligence or willful misconduct of BANK. It is further understood by DEVELOPER that if, as the result of any disagreement between it and any other party or adverse demands and claims being made by it or anyone else upon BANK, or if BANK otherwise shall become involved in litigation with respect to this Agreement, DEVELOPER agrees that it shall reimburse BANK on demand for all costs and expenses, including, without limitation, attorney=s fees, it shall incur or be compelled to pay by reason of such dispute or litigation, including reasonable compensation for time expended in connection with any such dispute or litigation. (c) DEVELOPER shall indemnify and hold harmless MUNICIPALITY against any claim, loss, damage or liability, including, without limitation, attorney=s fees which may be incurred by or brought against MUNICIPALITY in connection with this Agreement, except any such loss, damage or liability incurred by reason of the gross negligence or willful misconduct of MUNICIPALITY. (d) BANK, acting as such, shall not be liable to anyone by reason of an error or judgment, a mistake of law or fact, or for any act done or step taken or omitted in good faith, and this provision shall survive the termination of this Agreement. (e) At the time the last of the escrowed funds are released and disbursed by BANK in accordance with this Agreement, BANK shall be discharged from any obligation under this Agreement. (f) In accordance with the provisions above, BANK may rely upon and shall be protected in acting upon any statement, instrument, opinion, notice, request, order, approval or document believed by it to be genuine and to have been signed or presented by the proper party or parties. 15. Substitution or Resignation of BANK. BANK reserves the right to withdraw from this Agreement and cease serving as escrow agent hereunder at any time by giving ten (10) days written notice thereof to the DEVELOPER and MUNICIPALITY. Upon notice of resignation by BANK, DEVELOPER agrees to find within ten (10) days of such notice a replacement escrow agent acceptable to MUNICIPALITY. BANK agrees to deliver the escrowed funds then held by BANK to such replacement escrow holder and notify all parties hereto. BANK shall thereupon be released from any and all responsibility or liability to the parties hereto. If the DEVELOPER fails to appoint a replacement escrow agent within such ten (10) day period, BANK shall petition any court having jurisdiction for the appointment of a successor escrow agent or for instructions as to the disposition of the documents and moneys held by it under this Agreement. Associate Planner Cathyann LaRose, City Arborist Craig Lambert, and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the plans submitted on June 5, 2007 and have the following comments. The applicant has requested the following changes to landscaping: 1. Delete the westernmost 3" diameter maple tree along Allen Road (is on approved plans but has not been planted). 2. Delete the easternmost 3" diameter locust tree along Allen Road (is on plans but has not been planted). 3. Revise the specifications for the remaining two locust trees along Allen Road to permit the planting of trees between 21/2" to 3". 4. Eliminate the two 2" diameter maple trees on the north side of the building which are dead or dying. Staff has conducted a site visit with the City Arborist and advises the following in response to the request. In response to request numbers 1 and 2. The City Arborist agrees that the locations shown on the plans are not appropriate locations for the maple and locust trees as specified by the applicant. The City Arborist also agrees that the maple trees on the north side are indeed dead. However, the City Arborist has stated that there is ample space in the southwestern portion of the lot, along Allen Road, to replace the four trees specified in numbers 1, 2, and 4 above. The applicant may work with the Arborist to determine a species which will be appropriate (limited height due to overhead power lines). He would not support an allowance to simply plant less trees. He would support waiving two trees if the applicant were to plant appropriate shrubs around the air conditioning pad at the southeast corner of the building. If shrubbery is chosen, appropriate levels of new fill shall be added to support the new shrubs. This is a small space and so would be an financial advantage to the applicant over replacing all four trees trees. 1. The applicant shall work with the Arborist to install at least two trees on the property to replace those that were never planted or are dying. The values shall be similar to the trees which have not been planted. If only two trees are planted, then the applicant shall also install appropriate shrubbery around the air conditioning pad at the southeast corner of the building. If no shrubbery is installed, four new trees shall be planted. Species selection shall meet the approval of the City Arborist and Planning Staff. The plans should be revised accordingly. Staff recommends approval of the request to reduce caliper size for the locust trees along Allen Road. CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING The applicant has requested the following changes to the site plan which are not related to landscaping: 1. Add an extra line to the parking lot striping in the southwest corner of the parking lot. It s in existence but is not shown on the plans. 2. Add an air conditioning pad outside the north west corner of the building.. It s in existence but is not shown on the plans. 3. The metal posts in the parking lot near the southeast corner of the building have never been removed even though the site plan reflects that they will. The applicant wishes to leave the posts. 4. The chain link fence on the outside of the southeast corner of the building is now open to the south. The site plan denotes that it is fully enclosed. The applicant wishes to leave it open to the south as it encloses only an air conditioning unit on a concrete pad. Staff is agreeable with all of these requests. There are other old items included on the plans which should be updated to reflect current conditions. This includes such language as "proposed striping" and "building mounted light to be removed". These notes should be removed as the striping is in existence and the building mounted light appears to have already been removed. 2. The plan shall be revised to depict the changes which have occurred since the plan was last updated, including notations regarding proposed striping and removal of building -mounted lights. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. (t) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the South Burlington Land Development Regulations: CITY OF SOUTH BURLINGTON 4 DEVELOPMENT REVIEW BOARD DEPARTMENT OF PLANNING & ZONING (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). No changes to the existing buildings are being proposed as part of this application. This site was reviewed for all of these standards in 2006. There are no proposals for changes in use or new construction. Staff finds that these criteria are being met and does not find a need to elaborate on each detail. Delete the westernmost 3" diameter maple tree along Allen Road. There is no sign that this tree was ever planted and planting it now in the designated area would be very close to a storm sewer grate and a utility pole. 2. Delete the easternmost 3" diameter locust tree along Allen Road. Although the site plan indicates that there is plenty of space, planting the tree in the indicated location places it very close to an existing utility pole. This tree was inserted in substitution for a locust tree in the northwest corner of the lot that appears never to have been planted and represented a de facto increase in the number of trees actually on the lot. 3. Revise the specifications for the remaining two locust trees along Allen Road to permit the planting of trees of between 21/2" to 315 . These are the types of trees that are presently available, are approximately 16' tall and will be adequate substitutes for the dead maple trees. 4. Eliminate the two 2" diameter maple trees on the north side of the building. Both of these trees are dead or dying. Trees in that area are shaded by the building on the south and by the pine trees on the Champ Care Care Center on the north. In addition the soil is very wet (the dead trees roots are clearly rotted). It is very unlikely that any tree will grow in that area. Non -Vegetation Related Amendments 1. Add an extra line to the parking lot striping in the southwest corner of the parking lot. Appears to have been added in parking lot striping but never reflected on the site plan. 2. Add an air conditioning pad outside the north side of the building near the west corner. An extra air conditioner was added during the renovations necessary for the present use, and a pad was built to receive it, but the site plan was not amended at that time to reflect the additional pad. 3. The metal posts in the parking lot near the southeast corner of the building have never been removed, while the existing site plan says that they will be removed. These posts are so close to the building that they pose no hazard to traffic going behind the building. 4. The chain link fence on the outside of the southeast corner of the building now is now open to the south. The site plan was not amended to reflect that that area is now no longer fully enclosed. Mr. O'Leary showed the path of stormwater which, he said, will bypass both of those ponds. The applicants will also have to create a pond on their property. Ms. Howley agreed this is a better plan, but she was still concerned with water runoff. Water now runs down into their yard and through their garages. She said the brook needs to be dug out so water doesn't go into their yard. Mr. Carlson asked if the sewer line can be moved to avoid cutting down trees. Mr. O'Leary said they are out of the Class 3 wetland now. He said he was willing to look at those trees and see what they can do. Mr. Carlson noted the original plan showed them coming in at an angle so the trees could be saved. Ms. Beard questioned the increase in traffic. Ms. LaRose said the project will generate 26 peak hour trip ends which is well within its limit of 45. She said there may eventually be a signal there. Mr. Wetzel asked what would happen if an interchange goes in there. Mr. O'Leary showed an alternate access. Mr. Bolton was concerned with traffic problems if the interchange is built, and those problems would have to be dealt with via taxpayer money. Ms. Dufresne said they have no idea where the road will go. Mr. Belair said the State will have to come up with an alternate. Ms. Dopp asked if the entrance will be along the line with the existing entrance. Mr. O'Leary said it will slide a little to the south. He said there will be only one entrance on Hinesburg Rd. Public Hearing: Conditional Use Application #CU-06-03 of Fessou Enterprises for conditional use approval under Section 14.10, Conditional Use Review, of the South Burlington Land Development Regulations. The amendment consists of converting 9324 sq. ft. of space to personal instruction school DEVELOPMENT REVIEW BOARD 18 JULY 2006 (dance) use with remaining 1980 sq. ft. used for general office use, 1820 Shelburne Rd: Mr. Wilson located the building at the corner of Allen Rd/Shelburne Rd. They will convert the space into 3 dance studios (ballet) with some office and locker space. There will be no exterior modifications. Mr. Wilson showed the location of handicapped parking on the side where people enter from Allen Road. He also showed an area for snow storage. They require 19 parking spaces and are providing 37. The dumpster will be removed, and trash will be collected inside. It was noted that the original plan showed 5 locust trees in front of the building. The 5th one was never planted because the water line is on that spot. There is a 15-foot maple on the corner. Some unhealthy maples will be replaced along Allen Road. Mr. Belair suggested cross -hatching parking spaces not being counted. He also asked that another locust or other tree, 3-3.5 caliper, be planted somewhere on the site. Mr. Wilson said they would be happy to do that. The approval motion was amended as follows: Stipulation 3b was added to read: The plan shall be revised to show one additional 3-3.5" caliper Honey Locust Tree on the property. Stipulation #5 was amended to read: Prior to the issuance of a Certificate of Occupancy, the applicant shall replace the two dead trees along Allen Road and plant the new Honey Locust Tree. COMMENTS Associate Planner Cathyann La Rose and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the plans submitted on June 8, 2006 and have the following comments. Zoning District & Dimensional Requirements: There are no changes to the dimensional requirements as part of this application. . SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlinqton Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. No changes to the existing buildings are being proposed as part of this application. However staff finds that this criterion is being met. Given the proposed use of 1,980 square feet of general office space and 9324 square feet of personal instruction (with up to 6 employees), 19 parking spaces are required. The site plan depicts 52 spaces, including 3 spaces marked as handicapped accessible. There are more than enough spaces available for the proposed use. However, the handicapped spaces shown do not have the required 5 foot access aisles. The plans should be revised to stripe access aisles accordingly. 1. The plans shall be revised to depict access aisles of at least 5 feet in width for each handicapped parking space, in compliance with Section 13. 01I of the SBLDR. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. No changes to the existing buildings are being proposed as part of this application. Without tearing down the new building it would not be possible to relocate the parking. Staff feels that the parking layout presented is acceptable. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The height of the building will remain unchanged and below 35 feet. CITY OF SOUTH BURLINGTON DEVELOPMENT REVIEW BOARD DEPARTMENT OF PLANNING & ZONING (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. No changes to the existing buildings are being proposed as part of this application. 2. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. The proposed project does not involve any new exterior construction, so this criterion is not applicable. (t) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. The proposed project does not involve any new exterior construction, so this criterion is not applicable. Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the South Burlington Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. At this time, staff does not suggest providing additional accesses. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). The applicant is proposing to install a new 6 foot tall stockade fence to screen the existing dumpster; this should include fencing the south side of the dumpster. 3. The plans shall be revised to provide screening on the north side of the dumpster enclosure. (d) Landscaping and Screening Requirements As there is no building construction proposed for this site, there are no minimum landscaping requirements. CITY OF SOUTH BURLINGTON 4 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING Pursuant to Section 13.06(B) of the Land Development Regulations, the plans shall depict snow storage areas that will minimize the potential for run-off. No snow storage areas are shown on the plans. 4. The plans shall be revised to depict adequate snow storage areas. Lighting Pursuant to Section 13.07(A) of the Land Development Regulations, all exterior lighting shall be shielded and downcasting to prevent light from spilling onto adjacent properties and rights -of -way. The applicant has stated that there is no new lighting proposed as part of this application. CONDITIONAL USE CRITERIA Pursuant to Section 14.10(E) of the Land Development Regulations the proposed conditional use shall meet the following standards: 1. The proposed use, in its location and operation, shall be consistent with the planned character of the area as defined by the City of South Burlington Comprehensive Plan. Staff finds that the proposed use is consistent with the planned character of the area, as defined by the Comprehensive Plan. 2. The proposed use shall conform to the stated purpose of the district in which the proposed use is located. Staff finds that the proposed use is consistent this criterion. 3. The Development Review Board must find that the proposed uses will not adversely affect the following: (a) The capacity of existing or planned municipal or educational facilities. The proposed use will not adversely affect municipal services. (b) The essential character of the neighborhood or district in which the property is located, nor ability to develop adjacent property for appropriate uses. Staff finds that the proposed use is consistent with the character of the neighborhood. (c) Traffic on roads and highways in the vicinity. The exiting uses on the property were estimated to generate 39.7 PM Peak Hour trip ends as part of their last approval. The applicant has submitted a traffic study that estimates that the proposed uses on the property are estimated to generate 30 PM Peak Hour trip ends. Thus there is a decrease in the traffic generation for this property. (d) Bylaws in effect. There are no proposed changes to the building or other dimensional standards. In October 1997, the City of South Burlington approved a peak hour allocation of 40 vte/hour for this site. That was based on 1,980 sf of medical office space plus 9,300 sf of general office space. We understand that the 1,980 sf of medical office space is in fact presently being used as general office space. The ITE land -use category best fitting a dance studio such as this is #495 - Recreational Community Center. Using 9,300 sf of gross floor area results in a pm peak hour trip estimate of 15 vte/hour. As a check on that, we also calculated an estimate of the pm peak hour trips using your proposed weekly class schedule together with the projected number of students in each class. We found that the pm peak hour varies from day to day; with some days being 4:00 to 5:00 pm and other days being as late as 4:45 to 5:45 pm. Averaging the peak hour for each day, and including a 20% allowance for siblings and car-pooling, we calculated the average weekday pm peak hour trips to equal 22 vte/hour. That does not include any allowance for parents staying to watch their children, but assumes that all of the parents drop-off, leave, and then return later to pick-up. Mr. Bensen was dismayed to �ind that as a result of the recent zoning change he had been downzoned and 'he found it strange that if someone was going to build a garage to within 5' of his property line, the city would notify the affected property owner next door, but that if the city proposed to cut the value of someone's land, they were not notified of it. Ms. PoEer replied that the zoning change in question had been considered by the Commission and the _ Council over a period of 1 112 years and that there had been a lot of publicity about it. I's. Bensen felt he should have been notified. t Mr. Spitz said the C1 zone would allow some addition to the existing buildings, but not as much as future plank for the lot indicated. He noted that the lot had close to the amount of land required for a PCB and he suggested that Mr. Bensen combine with another property owner. :faking the road public was discussed. Yr. Mr. Spitz cautioned that even with 4 acres and 350' road fronts e, there were a lot of traffic standards to meet with a PCD and he was not sure the city would be receptive to accepting the existing street. Moore said that at an earlier time there had been some consideration of access to the building from the•,,j;orth, but that was not being considered now. The park- ing lot will not extend farther north than exists today on the east side. Some concern was expressed over the use changing from offices to retail, particularly after the Southern Connector was built, and this became a highly visible lot. Yx. Spitz said that if that happened, they could be required to return to the Commission. _ Mr. Farrell felt the Commission was selling short the idea of compact spaces. It was suggested that 1 compact space be eliminated from in front of the. building and one from the Allen Road side and that the rest be widened to 9' instead of 81. Mr. Ewing said that moving the entrance to the side of the building would help, and it was agreed that two more entrances would be added in the west wall. 2•r.
