Re: Findings of Fact, application of Evergreen Investments, Inc.,
to amend a previously approved plan for a 11,284 square foot
general office building. The amendment is to convert 1980 square
feet of general office use to medical office use with the remaining
9304 square feet used for general office, 1820 Shelburne Road.
On the day of October, 1997, the South Burlington City
Planner approved the request of Evergreen Investments, Inc., to
amend a previously approved site plan under Section 26.10 of the
South Burlington Zoning Regulations based on the following
findings:
1. This project consists of amending a previously approved plan
for a 11,284 square foot general office building. The amendment
consists of converting 1980 square feet of general office use to
medical office use with the remaining 9304 square feet used for
general office use.
2. This property located at 1820 Shelburne Road lies within the C2
District. It is bounded on the north by a car wash, on the east by
a light manufacturing facility, on the west by Shelburne Road, and
on the south by Allen Road.
3. Access/circulation: Access is provided by a 30 foot curb cut
on Allen Road. No changes proposed.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverage is 24.7% (maximum allowed
is 30%). Overall coverage is 66.8% (maximum allowed is 70%).
Front yard coverage along Allen Road is 77.1% and along Shelburne
Road is 24.1% (maximum allowed is 30%). Front yard coverage along
Allen Road is existing and will not be made worse by this
application.
Setback requirements are met.
5. Parking: A total of 47 parking spaces are required and 52
spaces including three (3) handicapped spaces are being provided.
A bike rack should be provided as required under Section 26.253(b)
of the zoning regulations. The parking lot should be striped as
shown on the site plan prior to occupancy of the medical office
space.
6. Landscaping: The minimum landscaping requirement, based on
building costs, is $3000 which is not being met. Applicant is
seeking a $3000 credit for existing trees.
7. Sewer: The additional sewer allocation requested is 460 gpd
(includes 20% reduction allowed by State). The applicant will be
required to pay the per gallon fee prior to permit issuance.
8. Traffic: ITE estimates that the current use generates 37.2
vehicle trip ends (vte's) during the P.M. peak hour and the
proposed uses to generate 39.7 vte's or a 2.5 vte increase. The
applicant should be aware that the road impact fee is zero (0).
9. Dumpster: The dumpster storage area should be screened and the
type of screening noted on the plan.
10. Lighting: No exterior lighting changes proposed.
11. Other:
--- the chain link fence at the southeast corner of the building
must be removed in order to comply with minimum aisle widths.
--- the plan title box should be revised to note the correct scale
of 1" = 20'.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington City
Planner approves the application of Evergreen Investments, Inc., to
amend a previously approved plan for a 11,284 square foot general
office building. The amendment is to convert 1980 square feet of
general office use to medical office use with the remaining 9304
square feet used for general office, 1820 Shelburne Road, as
depicted on a plan entitled, "1820 Shelburne Road Site Plan,"
prepared by Lamoureux, Stone & O'Leary Consulting Engineers, Inc.,
dated 10/3/97, with the following stipulations:
1) All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2) The plans shall be revised to show the changes listed below and
shall require approval by the City Planner. Three (3) copies of
the approved revised plan shall be submitted to the City Planner
prior to permit issuance.
a) The site plan shall be revised to screen the dumpster and
note the type of screening proposed.
b) The site plan shall be revised to provide a bike rack as
required under Section 26.253(b) of the zoning regulations.
c) The site plan shall be revised to remove the chain link
fence, metal posts and wall mounted light fixture at the
southeast corner of the building.

d) The site plan title box shall be revised to note the
correct scale of 1" = 20'.
3) The City Planner grants a $3,000 landscaping credit for
existing trees.
4) For the purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Planning Commission estimates
that the change in use will generate 2.5 additional vehicle trip
ends during the P.M. peak hour.
5) The City Planner grants an additional sewer allocation of 460
gpd (this includes the 20% reduction allowed by State). The
applicant shall pay the per gallon fee prior to issuance of the
zoning permit.
6) Any new exterior lighting or changes to existing exterior
lighting shall consist of downcasting shielded fixtures. Any
change to existing lights shall require approval of the City
Planner prior to installation.
7) The applicant shall obtain a zoning permit within six (6)
months pursuant to Section 27.302 of the zoning regulations or this
approval is null and void.
8) The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to the
use of the medical office.
9) Any change to the site plan shall require approval by the South
Burlington Planning CommisSl)ii.on.
