District required setback- 150 feet ZONING BOARD OF ADJUSTMENT FEBRUARY 14, 1983 The South Burlington Zoning Board of Adjustment held a regular meeting on Monday, February 14, 1983 at 5:00 pm in the Conference Room, City Hall, 575 Dorset St. Members Present Everett Reed, Chairman; Alex Guyette, James Thibault, Fred Blais, John Dinklage, James McClary Member Absent Norman Campbell Others Present Richard Ward, Zoning Administrator; Marcel Beaudin, Robert Moore Appeal of Edward and Bernice Bayer Appeal of Edward and Bernice Bayer seeking a variance from Section 19.00, Non -conforming uses and strdctures of the Soutb Burlington Regulations. Request is for permission to demolish existing structures and replace with a single family dwelling containing 2,074 square feet on a lot containing 10,700 s uare feet with 51' of frontage. Dwelling to be located to within eighteen (18� feet of front yard and thirty seven feet of the Conservation Open space district, at 36 Brigham Road. Mr. Ward said the area was zoned R1 and that minimum dimensional requirements were a 1 acre lot, 120' frontage, 25' side yards, a 50' front yard, and a maximum coverage of 15%. The proposed side yards are 101. Existing setback from the CO zone is 37' and that is proposed to remain. Required setback is 150'. Total proposed coverage is 19.4%. Mr. Ward said the proposal was to remove all the structures on the lot now and replace them with a dwelling unit and attached garage. The are 4 structures on the lot: a summer cottage, bathhouse, garage, and storage building. Mr. Guyette said it looked like this would be an improvement. Mr. McClary noted that it did not look like the owner of the lot could acquire any more land to make his lot larger. Mr. Moore said he was the adjoining neighbor and supported the plan, along with his wife. They have reviewed the plans and feel this would be consistent with the neighborhood. The appeal was granted unanimously. Other business Building codes for the city were discussed. Minutes of January 24, 1983 The January 24, 1983 minutes were approved on a motion by Mr. Guyette, a second by Mr. Thibault and a unanimous vote. Burlington, VT 05401 Dear Sir: RECEIVED NO'V P, 8 1983 MANAGER'S OFI ICE CITY S(), PURLINGTON A retaining wall is presently being constructed adjacent to a brook which is a tributary of Bartlett's Bay on land now or formerly owned by Faigel in South Burlington, Vermont. Zoning Regulations preclude construction of retaining walls within 50 feet of a brook without a variance. The City of South Burlington issued such a variance on this retaining wall. The retaining wall being constructed is 10 feet closer to the edge of the brook than the older wood crib wall which was approximately 20 feet from the brook. Also, the new wall is being constructed of stone, a more permanent material. We are concerned citizens who have a vested interest in the construction of this wall and its affects upon the access to our beach. We believe that during periods of high water and storm run off the wall will cause increased erosion to our access. The wall will restrict the overflow section causing increased velocity on the stream banks and erosion to the unprotected stream banks. The present stream bank which is adjacent to our access is of sandy material and is not protected by channel protection. We have also been informed that the adjoining property owner on the other side of the stream also plans to construct a wall further channeling the flow. We are also opposed to this construction. We believe that the City of South Burlington acting to represent all parties concerned had a responsibility to contact all of the affected parties. We believe that the City of South Burlington should have contacted the parties who have this interest in access to Lake Champlain.
