SITE PLAN APPLICATION #SP-17-05
FINDINGS OF FACT AND DECISION
1820 Shelburne Road, LLC, hereinafter referred to as the applicant, is seeking approval
to amend a previously approved plan for an 86 student daycare. The amendment
consists of: 1) reducing the number of students to 76, 2) converting 3,780 sq. ft. to
general office use, 3) adding one (1) parking space, and 4) converting 2,790 sq. ft. to
personal instruction use, 1820 Shelburne Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for an 86
student daycare. The amendment consists of: 1) reducing the number of students to 76,
2) converting 3,780 sq. ft. to general office use, and 3) converting 2,790 sq. ft. to
personal instruction use, 1820 Shelburne Road.
2. The owner of record of the subject property is 1820 Shelburne Road, LLC.
3. The subject property is located in the Allen Road Commercial Zoning District.
4. The application was received on January 30, 2017.
5. The plan submitted is entitled "Leaps and Bounds Child Development Center 1820
Shelburne Rd South Burlington, VT", prepared by Gardner Kilcoyne Architects, and dated
1/27/17.
DIMENSIONAL REQUIREMENTS
6. No changes to coverages proposed.
7. Setback requirements will continue to be met.
SITE PLAN REVIEW STANDARDS
Pursuant to Section 14.03(A)(6) of the Land Development Regulations, any PUD shall
require site plan approval. Section 14.06 establishes the following general review standards
for all site plan applications:

Only the standards below are affected by this application. All other standards will
continue to be met.
Traffic
8. The existing use is estimated to generate 64.95 pm peak hour vehicle trip ends (vtes)
based on Site Plan Approval #SP-11-08. Since that approval was issued, the Impact Fee
Ordinance was revised to include a pass -by credit of 30% which would reduce the
estimated vtes to 48.76. Since the applicant did not request an amendment to the
approval of the 64.95 vtes, this number represents the current estimated traffic
generation. The changes in use are estimated to decrease vtes down to 58.57. This
number includes 43.09 vtes for the reduced student day care (this takes into account
the pass -by reduction), 5.63 vtes for the general office use, and 9.85 vtes for the
personal instruction use.
(c) Parking shall be located to the rear or sides of buildings
9. The applicant is proposing to add one (1) parking space in the Shelburne Road front
yard. Section 14.06 (B) (2) (1) of the LDRs does not allow the addition of parking spaces
in the front yard. The plan will have to be revised to reduce the number of spaces in the
Shelburne Road front yard by one (1) space and revise the note on the plan accordingly.
(c) AM dumpsters and other facilities to handle solid waste, including
compliance with any recycling or other requirements, shall be accessible,
secure, and properly screened with opaque fencing to ensure that trash and
debris do not escape the enclosure(s),
10. The dumpster enclosure will be relocated and will be screened on all sides.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves Site Plan
Application #SP-17-05 of 1820 Shelburne Road, LLC, subject to the following conditions:
All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and will be on file in the
South Burlington Department of Planning and Zoning.
3. The applicant must obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.

4. The plan must be revised to show the changes below and shall require approval
of the Administrative Officer. Three (3) copies of the approved revised plans
must be submitted to the Administrative Officer prior to permit issuance.
a. The plan must be revised to remove one (1) parking space in the
Shelburne Road front yard and revise the note on the plan accordingly.
5. For the purpose of calculating road impact fees under the South Burlington
Impact Fee Ordinance, the Administrative Officer estimates that these changes in
use will generate zero (0) additional vehicle trip ends during the p.m. peak hour.
6. Prior to issuance of a zoning permit for the project, the applicant must submit to
the Administrative Officer a final set of project plans as approved in digital (PDF)
format.
7. The applicant must obtain a Certificate of Occupancy from the Administrative
Officer prior to use of the newly converted spaces in the building.
8. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
