Mrs. Helen Paquin, City Clerk
City of South Burlington
South Burlington, Vermont 05401
Dear Mrs. Paquin:
We applied on March 18, 1974 for permission to modify our front
free-standing sign to include Peugeot identification, but were declined.
Though I realize the total area of the sign exceeds forty square feet,
we are just not able to use any other logo than as prescribed by Fiat and
Peugeot, and these are the smallest which can be had. The Fiat sign is 10x3,
giving thirty square feet, and the Peugeot sign is 4x4, or sixteen square feet,
making the total area forty-six square feet.
With all respect -to the city statute, we simply cannot conduct a
business without product identification. We have had the Peugeot franchise
since August, 1973 and we frequently have customers come in and tell us that
they had no idea that we were a Peugeot dealer.
I sincerely request that you advise us of what steps we may take to
permit us to display our sign, as shown in the enclosed snapshot, and do so
without being in violation of city statute.
Thank you.
Yours truly,

Dear Mr. Spokes:
This will acknowledge your letter received by us on May 16 ad-
vising us that we are in violation of the South Burlington sign or-
dinance.
I would respectfully submit that we have'not knowingly violated
the city sign ordinance. We have complied with Mr. Ward's directive
to remove our non -compliant sign within ten days of receipt of notice
in all instances. It is our understanding that once a sign is re-
moved, any replacement or reinstallation has to be reviewed and con-
sidered as an initial or new installation. It therefore follows that
the interpretation of the ordinance applied to conforming signs must
likewise apply to non -conforming signs.
I would very much appreciate a further clarification of the na-
ture of our alleged violation. In every instance that we have dis-
played a temporary sign, we have removed it as requested within the
prescribed time. Contrary to your allegation that we "are purposely
attempting to avoid application of the ordinance," we are rather try-
ing our very best to abide by it, as imperfect as it may be.
I would be quite willing to meet with you at your convenience
to discuss and resolve the matter of our compliance. I sincerely
wish to resolve the above at the earliest possible time, and there-
by eliminate the need of any further action by you and your client.
Yours truly _

Dear Denny:
'his letter is to confirm our conversation regarding
the Sign Violation at the Take Champlain Motors, Inc. at
1820 Shelburne Road.
The sign involved has been mounted on a snow.mobile
trailer ana is li,,Thted. The trailer is staked to the
ground.
In a recent conversation with Dick Spokes he informed
me that the sign was erected sometime over the weekend of
iov. bt-111 or 9th. to observea the sigr. Dn Sunuay, the 9th.
..'o feels they have received enough warning, therefore I am
turning tlie matter over to you.
I also have some junk car violations that 1 want to
discuss with you.

Dear Mr. Ward:
This will acknowldege receipt of your December 4th letter.
I would like to point out that all of the exterior and interior
illuminations which we provide at periods of darkness are principally
for the purpose of improved security. We have yard lights, spot lights,
and signs which illiminate our showroom, offices, shop, yard area, as
well as our new and used vehicles.
It would be helpful if you could be a little more specific in
regards to how we are in violation of the city sign law. The lights
and signs which we are presently operating for the above purpose have
been so operated since our opening almost two years ago, and we have
never, until your recent letter, been advised that we are in violation.
Additionally, virtually all the other auto dealerships on Shelburne Rd.
have illimination similar to ours operating at hours of darkness quite
as we do.
Please be advised that we wish to comply with all city ordinances,
and that I will be pleased to discuss with you the matter of our compli-
ance at any time convenient to both of us.
Yours truly,
Charles L. Robitaille,

I went out to Lake Champlain Motors and discussed the sign
situation with Mr. Robitaille. On his behalf, I would make the
following proposal:
He will immediately take down the Peugot sign and keep it
down and pay a $50 fine. lie will then apply for a permit to have
the two signs hung together. This permit will, as I understand
it, be denied because of the total square footage involved. He
will then proceed to appeal this decision to the Planning Commission
pursuant to Section 20. But he agrees in the meantime to keep the
Peugot sign down.
There are a couple of things that bother Mr. Robitaille about
this whole matter. First, Dick Ward, in a conversation with Mr.
Robitaille, seemed -to indicate that the Peugot sign on the snow-
mobile would be permissible under the statute since it was
"temporary," in other words, Mr. Robitaille seemed to feel that he
was mislead. Second, he has noted many similar violations both
on Shelburne Road and Williston Road and he feels that he has been
singled out.
As I understand it, the reason he cannot hang the Peugot sign
below the Fiat sign is that the total area will be approximately
two square feet more than allowed by the statute. I note that near
the end of Section 5 the regulati'ons state "the Board may place
greater or lesser emphasis on certain factors as the circumstances
of the case require." I think the Board should realize that it is
absolutely essential that passing motorists realize that Robitaille
has a Peugot franchise. To replace the Fiat sign to conform with
the forty square feet requirement would cost between $1,300 and $1,500.

No one can deny that the two signs are neat and conservative and
do not detract from the esthetic quality of Shelburne Road.
In closing, I would ask that if you will agree to our proposal
that you use your influence to see that the permit is given quick
consideration and if denied, that the appeal process be as speedy
as possible. Please give me a call at your convenience.
Very truly yours,
LATHAM, EASTMAN, SCHWEYER & TETZLAFF
