! The South Burlington Zoning Board of Adjustment held a regular meeting on
Monday, December 14, 1987 at 7 PM in the Conference Room, City Hall, 575 Dorset
Street.

Appeal of Katherine Gahagan seeking approval from Section 12.20 Conditional
uses, sub section 12.225 automotive repair and service. Request is for
permission to construct a 34' x 80' Quik Lub shop and a 40' x 108' muffler
shop, also requiring a variance from Section 19.65 Multiple uses, proposed
buildings are in conjunction with a seven (7) bay carwash on a lot containing
2.8 acres, located at 1810 Shelburne Road.
CMr. Ward said this area is zoned C-2 District. Section 12.20 Conditional uses
sub section 12.225 automobile repair service. Proposed use quik lub shop and
muffler shop in conjunction with carwash (permitted use Section 12.110),
carwash (7 bays) under construction. Proposed quik lub 34' x 80' (2720 square
feet) Proposed muffler shop 40' x 108' (4320 square feet). Section 19.65
Multiple uses sub section 19.651 - proposed three buildings - one lot. Lot
contains 2.86 acres, L shaped parcel, fronts on Shelburne Road and Harborview
Road. Minimum lot for C-2 District 40,000 square feet or 2.75 acres for three
lots. Entrance off Harborview Road.
Mr. Ponsetto said we have to demonstrate that there is a hardship created which
makes a reasonable development in conformance a problem. The shape of the
site, elevation, and requirement for access for the various uses presents a
problem.
Mr. Lavigne said the water consumption will be the same about 150 - 200 gallons
a day. This will not change the character of the area - there are 2 car washes
at the present time, 2 gas stations, 5 - 6 automobile sales facilities, 2
office facilities. Traffic will be about 84 trip ends per hour. By laws under
conditional use - auto repair and service fits in. We are recycling into a
certified company the oil from the quik lub. Will be complementing each other
muffler shops use more than one facility during one trip.
Mr. Condos asked if there was any attempt made to try to combine the two in one
building.

Mr. Ponsetto said the variance we're looking for is to have more than one
building. Mr. Graf asked if this was a self wash facility and Mr. Lavigne said
it's all self wash.
Mr. Ward said that in order for the Planning Commission to consider a
commercial complex the minimum size lot has to be 4 acres. Mr. Graf asked if
they planned to sell anything at any of these locations like auto accessories,
wax, etc. Mr. Lavigne said there will be dispensers for car wash - they will
not be selling anything else but in dispensers.
Mr. Blais called the question on Conditional use. The Conditional use was
granted unanimously.
Mr. Lavigne said on variance we are asking for 3 separate structures for repair
and service. He explained the sketch showing the existing car wash under
construction, the elevation and the shape of the lot. He said it is possible
to put one building on site with 3 conditional uses but we're asking for a
variance in order to get a less massive building. The slope of the corners of
the land was existing prior to the owners purchase of the property and this
creates a harship to the owner. The proposed use will not alter the essential
character of the district. We are asking for the minimum variance. We believe
that this plan is a better plan than following the letter to the law - it works
better traffic wise and looks better.
Mr. Dinklage asked to explain the connection shown on sketch if facilities were
under one building. Mr. Lavigne said we would still have 3 structures but all
connected.
Mr. Ponsetto said we could put all 3 of these structures under a single roof
but it is not practical and the reasonable use of the site is as we have
designed it. The hardship is associated with conditions of the site as it was
when they purchased it - the shape of the lot, the slope and elevation creates
a hardship to the owner. This will not alter the character of the
neighborhood. The variance we are looking for is the minimum that we could in
order to function as we plan with the 3 buildings.
There was some discussion with Mr. Ward regarding a fee for the improvement of
the intersection at Harborview Road and Shelburne Road.
Mr. Dinklage moved that in light of what Dick said and in light of the fact
that the proposal before us would allow the appealant to make the most
economical and get maximum use of this property that the zoning board requires
as a stipulation for approval that the Planning Commission stipulate a traffic
impact fee to be paid by the appealant for the improvement of the Harborview
Road and Shelburne Road intersection. This was seconded by Mr. King and all
voted aye. The appealant was in agreement.
The Variance was granted unanimously.
