HomeMy WebLinkAboutSP-09-47 - Decision - 0002 Harbor View Road#S P-09-47 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CHAMP CAR CARE CENTER - 2 HARBOR VIEW ROAD SITE PLAN APPLICATION #SP-09-47 FINDINGS OF FACT AND DECISION Champ Car Care Center, hereafter referred to as the applicant, is seeking approval to amend a previously approved plan for a seven (7) bay car wash and 4,000 sq. ft. auto repair and service building. The amendment consists of after -the -fact approval to revise the landscaping plan for the auto repair and service building, 2 Harbor View Road (Girlington Garage). The Development Review Board held a public hearing on June 16, 2009. No one represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a seven (7) bay car wash and 4,000 sq. ft. auto repair and service building. The amendment consists of after -the -fact approval to revise the landscaping plan for the auto repair and service building, 2 Harbor View Road (Girlington Garage). 2. The application was received on June 5, 2009 3. The owner of record of the subject property is Champ Car Care Center 4. The subject property is located in the Commercial 2 Zoning District. 5. The plan submitted is entitled "Champ Car Wash South Burlington Vermont," prepared by Wiemann-Lamphere Architects, dated 6/1/2009. The last approved plan for the site dates to November, 1993. At some point since then, landscaping was installed that did not match the approved plan. This application is an attempt to rectify this mistake and to ensure that the ground conditions match an approved plan. Therefore, the applicant is requesting approval for the landscaping which has been installed. Staff has visited the site and reviewed the landscaping plan. It exceeds the minimum value which was required at the time of the last plan approval. The Board therefore supports the request to approve the landscaping changes. The applicant is also seeking approval for a change in parking lot layout: five parking spaces which were previously on the eastern edge of the parking area have been moved to the western parking area to be closer to the access door. One handicapped space is provided. No concrete exists but this area shall no longer serve as an approved area for parking. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to occupancy of the auto service and repair building. 5. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer.
