HomeMy WebLinkAboutVR-78-0000 - Supplemental - 1830 Shelburne Road10/19/78 RW SUGGESTED MOTION OF APPROVAL That the South Burlington City Council approve the conditional use application of Warren Young, 1830 Shelburne Road allowing for the operating of a mobile food service, according to the proposal of record, based on the following findings and subject to the following stipulations. Findings The proposed use is consistent with the health, safety and welfare of the City of South Burlington and standards 2,3 and 4 of Section 5 of the Interim Zoning Regulations. The proposed use is consistent with standard 1 and 5 based on the evidence submitted by the applicant, that the proposed use will have no adverse impact on the city. Traffic should not increase, intended customers will be those people using the services provided by the existing gasoline station. Stipulations 1) Any additional signs shall be erected in conformance with the City Sign Regulations. 2) Hours of operation shall be the same as those of the service station and shall operate in conjunction with the service station. 3) The proposed use shall be strictly a take-out operation, with no outside sitting involved. 4) This approval is limited to the use proposal and shall expire six months from this date (for commencement of this use). In conjunction with this use the applicant proposes to operate a snack bar type business from a converted bus. The bus is to be parked to the south side of the station, this bus is fully self contained and is registered for highway travel. It is my understanding that Mr. Young has secured the necessary State permits. September 21, 1978 Shelburne Road Getty 1830 Shelburne Road South Burlington, Vermont 05401 Dear Warrens This letter is a follow up regarding our conversation this Cate relating to your operating a foot service mobile unit from your property at 1830 Shelburne Road. The Shelburne Road area is presently in an interim zoning cistrict- this regulation states that any use (with a few exceptions) is conditional and requires approval by the City Council. Having recentlyinspected your mobile unit, I find that it is a second use of the property and therefore is subject to conditional use approval by the City Council. Until such time as you have been granted approval, you would be in rirect violation of the City's Zoning regulations. We request that you take the necessary action to secure approval, your failure to do so, and continuation of the business in question will only result in the city's having to take further legal action.
