HomeMy WebLinkAboutSD-02-19 - Decision - 0123 Nesti Drive#SD-02- l 9 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of fact, preliminary plat application #SD-02-19 of Chamberlain-Mucklow to amend a plan for a 16,000 sq. ft. retail building. The amendment consists of developing the property into a commercial warehouse complex consisting of 1) converting the existing 16,000 sq. ft. building to a temperature controlled storage facility, 2) removal of existing pole structures, and 3) constructing 35,850 sq. ft. of warehousing, storage and distribution use in seven (7) buildings, 123 Nesti Drive. On the 16th of April 2002, the South Burlington Development Review Board approved the request of Chamberlain-Mucklow seeking preliminary plat approval under Section 203 of the South Burlington Subdivision Regulations based on the following findings: 1) The request is to amend a site plan for a 16,000 sq. ft. retail building. The amendment consists of developing the property into a commercial warehouse complex consisting of : 1) converting the existing 16,050 sq. ft. building to a temperature controlled storage facility, 2) removal of existing pole structures, and 3) constructing 35,800 sq, ft. of warehousing, storage and distribution use in seven (7) buildings. Sketch plan was reviewed at the 1/22/02 DRB meeting. 2) The owner of record is SAS Realty Co. 3) This project located at 123 Nesti Drive lies within the C2 District. It is bounded on the north by Nesti Drive on the east and south by commercial property on the west by south by State of Vermont railroad tracks. 4) Access: Access is via a private 40' ROW from Shelburne Road. 5) Coverage/setbacks: Building coverage is 30.4% (maximum allowed is 30%). Overall coverage is 66.8% (maximum allowed is 70%). Proposed front yard coverage is 14.1% (maximum allowed is 30%). The final plat plan should not exceed the 30% building coverage limitation. 6) Parking: This project requires a total of 4 parking spaces. Two spaces for office, one for non -office employee, and one accessible parking space. The applicant is providing 8 spaces; two are handicap accessible. A bike rack is provided as required. 7) Traffic: This property's current use generates 118.86 vehicle trip ends (vte's) as estimated by ITE. This property is in Traffic Overlay Zone 5 which allows this property to generate a maximum of 194.5 vte's during the P.M. peak hour. The estimated vte's during the P.M. peak how for the new use is 13.48 calculated from ITE. This represents a 88% reduction in vte's. 8) Lighting: Proposed wall lighting is 1.00 watt, metal halide light fixture, which reflects light back onto the wall of the building. The proposed pole fixtures are 12 feet in height, 100 watt, metal halide, sharp cut off luminaire. Staff finds these acceptable. 9) Dumpsters: The site plan shows the location of a single dumpster. 10) South Burlington Water Department: The applicant was made aware that they must be in compliance with all South Burlington Water Department recommendation prior to obtaining a zoning permit. 11) Phasing: The applicant is proposing to complete the project in two phases over a period of five years. Phase one includes: 1) the conversion of the existing building to a two floor temperature controlled storage facility, 2) the construction of the proposed buildings A, B, and C, 3) pouring the slabs for D, E F, and G, 4) the final grading for the entire site, and 5) the removal of the two pole buildings. Phase 2 will include the construction of the proposed buildings D, E F, and G. 12) Other: The applicant will be required to obtain a conditional use permit at final plat. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves preliminary plat application #SD-02-19 of Chamberlain-Mucklow to amend a plan for a 16,000 square foot retail building. The amendment consists of developing the property into a commercial warehouse complex consisting of: 1) converting the existing 16,000 square foot building to a temperature controlled storage facility, 2) removal of existing pole structures, and 3) constructing 35,800 square feet of warehousing, storage and distribution use in seven (7) buildings, 123 Nesti Drive, as depicted on a three page set of plans, page one (1) entitled "Burlington Self Storage South Burlington Vermont Site Plan" prepared by Llewellyn -Howley, Inc., dated 12/13/01, last revised on 4/8/02, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The plat plans shall be revised prior to final plat submittal as follows: a) The site plan shall be revised to show a reduction in building coverage to the maximum of 30%. b) The site plan shall be revised to show a light distribution for the two proposed pole fixtures, showing the light cast from the fixtures does not reflect beyond the property lines. 2 c) The site plan shall be revised to show two (2) fire hydrants in locations approved by the Fire Department. 3) The applicant shall post a landscape bond in an amount of $9,500, prior to issuance of a zoning permit. This bond shall remain in effect for three (3) years to assure that the landscape has taken root and has a good chance of surviving. 4) The existing building shall be equipped with an automatic fire alarm system tied into a central receiving station and a fully automatic sprinkler system. 5) The final plat application shall be submitted within 12 months. The fee is $150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
