FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, final plat application #SD-02-66 of Nigel Mucklow to amend a
commercial warehouse complex consisting of a 16,000 square foot temperature
controlled storage facility and 35,850 square feet of warehousing, storage and distribution
use in eight (8) buildings. The amendment consists of relocating several of the buildings,
123 Nesti Drive.
On the 150' of October 2002, the South Burlington Development Review Board approved
the request of Nigel Mucklow seeking final plat approval under Section 204 of the South
Burlington Subdivision Regulations, based on the following findings:
1) This project consists of amending a commercial warehouse complex consisting of a
16,000 square foot temperature controlled storage facility and 35,850 square feet of
warehousing, storage and distribution use in seven (7) buildings. The amendment
consists of. 1) relocating buildings D and E, and 2) dividing building C into two (2)
separate buildings, resulting in eight (8) new buildings. The application was last
reviewed by the DRB at their June 4, 2002 meeting.
2) The owner of record is Chamberlain Mucklow.
3) This project located at 123 Nesti Drive is within the Commercial 2 District. It is
bounded on the north by Nesti Drive on the east and south by commercial property
on the west and south by the State of Vermont railroad tracks.
The only issues affecting this application are setbacks and coverage.
4) Lot Coverage/ Setbacks: The applicant proposed shifting buildings D and E
south, and separating building C into two (2) buildings. The overall coverage
remains the same due to the note that the concrete pad was poured. The plan
shows the building coverage at 29.8% which remains unchanged since the last
approval (maximum allowed is 30%). Overall coverage remains unchanged from
the previous approval at 67.4% (maximum allowed is 70%). Front yard coverage
remains unchanged at 14.1% (maximum allowed is 30%).
All setbacks are met with the change in building footprint locations.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves final plat application #SD-02-66 of Nigel Mucklow to amend a commercial
warehouse complex consisting of a 16,000 square foot temperature controlled storage
facility and 35,850 square feet of warehousing, storage, and distribution use in seven (7)
buildings. The amendment consists of 1) relocating buildings D and E, 2) dividing building
C into two (2) separate buildings, resulting in eight (8) new buildings, 123 Nesti Drive, as
depicted on a two (2) page set of plans, first page entitled "Burlington Self Storage South
Burlington Vermont Site Plan", as prepared by Llewellyn -Howley, dated 12/13/01, last
revised on 9/25/02, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. Any change to the final plat plans shall require approval by the South Burlington
Development Review Board.
3. The final plat plan (sheet 1) shall be recorded in the land records within 90 days or
this approval is null and void. The plan shall be signed by the Board Chair or Clerk
prior to recording.
