HomeMy WebLinkAboutSP-92-0000 - Decision - 1785 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Tim Purcell for construction of a parking lot for automobile display, 1785 Shelburne Road. On the loth of November, 1992 the South Burlington Planning Commission approved the request of Tim Purcell for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of constructing an auto sales lot on a vacant lot adjoining the applicant's auto dealership. The applicant received a conditional use permit for this facility on November 9, 1992 from the Zoning Board of Adjustment. 2. This property located at 1785 Shelburne Road is within the C2 District. It is bounded on the north by undeveloped land owned by the State of Vermont, on the east by Shelburne Road, on the south by the applicant's Acura dealership and on the west by Bouyea- Fassetts bakery. 3. Access/circulation: Access to the new parking lot will be via a 24 foot existing curb cut and shared access drive with the adjacent Acura dealership. The parking lot will have three (3) 24 foot and one (1) 14 foot access points with the shared access drive. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 0% and overall coverage is 35.9% (maximum allowed is 70%). The 15 foot minimum setback along Shelburne Road is being met. 5. Traffic: No additional traffic is expected according to I.T.E. since estimated trips is based on gross floor area and there will be no increase in the size of the building. 6. Bartlett Brook watershed: This project is within the Bartlett Brook watershed. The applicant has submitted a report from Wagner, Heindel and Noyes, Inc. dated November 10, 1992 which evaluates the proposed parking lot and its effect on the watershed. This hydrologic assessment indicates "that the proposed parking lot expansion will not result in a significant increase in peak discharge rate at the confluence of the small ditch to the west of the site and at the mouth of Bartlett Brook. Thus, no stormwater retention is required on the site". 1 This project has been designed to avoid any encroachment into two (2) C.O. zones on this lot. The Natural Resources Committee has visited the site and have no adverse comments. 7. Lighting: Exterior lighting will consist of four (4) 400 watt metal halide lamps with shoe -box type cut-offs on 18 foot poles. 8. Sidewalks: The applicant will construct 110 feet of sidewalk from the project access north to the C.O. zone. The applicant will pay $15 per foot for the remaining 170 feet. 9. Landscaping: There is no minimum landscaping requirement for this project. Applicant is proposing landscaping with a value of $638. Plantings will include Juniper and Burning Bush. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Tim Purcell for construction of a parking lot for automobile display as depicted on a plan entitled, "New Parking Lot for Knight Acura Auto Sales", prepared by Gordon G. Woods Associates, dated October, 1992, last revised 10/30/92, with the following stipulations: 1. All lighting shall be shielded, cut-off luminaire and shall not cast light beyond the property line. Any change in proposed lighting shall be approved by the City Planner prior to implementation. 2. The applicant shall be made aware that no fill or any other type of disturbance shall be allowed in the Conservation Zones crossing the property. The slope of the fill area shall be properly stabilized with appropriate plantings, rip -rap, or other acceptable method/material. 3. The plan shall be revised prior to construction to show a sidewalk to be constructed from the project access north to the CO Zone. The applicant shall contribute to the City's sidewalk fund $15.00 per linear foot for the remaining frontage along Shelburne Road where a sidewalk will not be constructed. 4.
