Re: Findings of Fact, application of John Larkin to amend an
approved planned unit development consisting of a 200 room hotel
and restaurant, 1720 Shelburne Road. The amendment consists of
constructing a covered drop-off area for guests.
On the 27th day of May, 1997, the South Burlington Planning
Commission approved the request of John Larkin for revised final
plat approval under Section 204 of the South Burlington Subdivision
Regulations based on the following findings:
1. This project consists of amending a planned unit development
for a 200 room hotel and restaurant previously approved and last
amended on 9/27/94. The amendment consist of constructing a 1296
square foot accessory structure (porte cochere).
2. This property located at 1720 Shelburne Road lies within the C2
and C.O. Districts and the Bartlett Brook Watershed Protection
Overlay District. It is bounded on the north by a motel,
undeveloped property and a City park/natural area, on the east by
multi -family units, on the south by Harbor View Road, on the west
by Shelburne Road.
3. Access/circulation: Access is provided by a 34 foot curb cut
on Shelburne Road and a 30 foot curb cut on Harbor View Road. No
changes proposed.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverage is 16% (maximum allowed
is 30%). Overall coverage is 50% (maximum allowed is 70%). Front
yard coverage is 41% (maximum allowed is 30%). Front yard coverage
is an existing situation which will not be made worse by this
application.
Setback requirements are met.
5. Parking: On 9/27/94 the Planning Commission approved a total
of 247 spaces and an additional 24 spaces to be constructed at a
future date if determined to be necessary. The parking study
reviewed on 7/26/94 showed that the highest count taken was 207
cars. This is 40 spaces or 16% more than is apparently needed.
This current proposal would not change the number of spaces which
are available or required.
6. Landscaping: The minimum landscaping requirement, based on
building costs, is $360 which is not being met. Proposed
plantings, which include Burning Bush and Juniper, are $155 short
of the requirement. Plan should be revised to add landscaping to
meet the minimum requirement.
7. Sewer: No additional sewer allocation needed.
8. Traffic: No additional traffic expected.
9. Lighting: Additional lighting will be placed within the new
structure. No light fixture will be visible from the exterior.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the revised final plat application of John
Larkin to amend a previously approved planned unit development for
a 200 room hotel and restaurant. The amendment consists of
constructing a 1296 square foot accessory structure (porte
cochere), 1720 Shelburne Road, as depicted on a two (2) page set of
plans, page one (1) entitled "Holiday Inn Pavilion South
Burlington, Vermont," prepared by Gregory T. Rabideau Architect,
dated 4/23/97, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. For the purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Planning Commission estimates
that the proposed accessory structure will generate zero (0)
additional vehicle trip ends during the P.M. peak hour.
3. Prior to issuance of a zoning permit, the applicant shall post
a $360 landscape bond. The bond shall remain in effect for three
(3) years to assure that the landscaping takes root and has a good
chance of surviving.
4. Any new exterior lighting shall consist of downcasting
shielded fixtures so as not to cast light beyond the property line.
Any change in lighting shall be approved by the City Planner prior
to installation.
5. The final plat plans shall be revised to show the changes below
and shall require approval of the City Planner. Three (3) copies
of the approved revised plans shall be submitted to the City
Planner prior to recording.
a) The landscape plan shall be revised to provide additional
landscaping to meet the minimum landscaping requirement.
6. The applicant shall obtain a zoning permit within three (3)
years pursuant to Section 605 of the subdivision regulations or
this approval is null and void.

7. The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to use
of the accessory structure.
8. Any changes to the plat plans shall require approval by the
South Burlington Planning Commission.
9. The final plat plan (i.e., site plan sheet SP-1) shall be
recorded in the land records within 90 days or this approval is
null and void. The plan shall be signed by the Planning Commission
Chair or Clerk prior to recording. The plan shall be recorded
prior to issuance of a zoning permit.
