HomeMy WebLinkAboutSD-99-22 - Decision - 1720 Shelburne Road#SD-99-22 FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Findings of Fact, application of Lark Inns, Inc. to amend a planned unit development consisting of a 200 room hotel and restaurant, 1720 Shelburne Road. The amendment consists of adding an access easement to the property to provide vehicular access to the adjoining property to the south. On the 271h day of April, 1999, the South Burlington Planning Commission approved the request of Lark Inns, Inc. for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a previously approved planned unit development consisting of a 200 room hotel and restaurant. The amendment consists of 1) adding an access easement to the plat to serve 1700 Shelburne Road, and 2) relocating the dumpster storage area. 2. The owner of record of this particular property is Lark Inns, Inc. 3. This property located at 1720 Shelburne Road lies within the C2 and C.O. Districts and the Bartlett Brook Watershed Protection Overlay District. It is bounded on the north by a motel, undeveloped property and a City park/natural area, on the east by multi -family units, on the south by Harbor View Road, and on the west by Shelburne Road. 4. Access: Access is provided by a 34 foot curb cut on Shelburne and a 30 foot curb cut on Harbor View Road. The proposal is to add an access easment which is approximately 34 feet wide by 270 feet long along the property's northerly boundary to provide access to the hotel on 1700 Shelburne Road which has no curb cut on Shelburne Road. The approval of the easement was a requirement for the issuance of a permit to construct the hotel at 1700 Shelburne Road. 5. Dumpsters: The access between this property and the 1700 Shelburne Road property resulted in the displacement of the dumpster storage area. The new screened dumpster storage area is shown on the plat. 6. Legal document: The legal document for the access easment should be approved by the City Attorney and recorded in the land records prior to recording the final plat plan. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Lark Inns, Inc. to amend a planned unit development consisting of a 200 room hotel and restaurant, 1720 Shelburne Road. The amendment consists of adding an access easement to the property to provide vehicular access to the adjoining property to the south, as depicted on a plan entitled, "Overall Site Plan Lot 11 Bartlett Subdivision Shelburne Road - Route 7 South Burlington, Vermont," prepared by Krebs & Lansing Consulting Engineers, Inc., dated February 19, 1999, last revised on April 19, 1999, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Prior to recording the final plat plan, the applicant shall record a legal document approved by the City Attorney for the access easement. 3) Any change to the final plat plan shall require approval by the South Burlington Planning Commission. 4) The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior to recording the final plat plan the applicant shall submit a copy of the survey plat in digital format.
