HomeMy WebLinkAboutSD-99-51 - Decision - 1720 Shelburne Road#SD-99-51 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application of Lark -Inns, LLP, Inc. to amend a planned unit development consisting of a 200 room hotel, 60 room hotel, restaurant, and a 3-unit multi -family dwelling, 1720 Shelburne Road. On the 21"' day of September, 1999, the South Burlington Development Review Board approved the final plat application of Lark -Inns, LLP, Inc. to amend a planned unit development consisting of a 200 room hotel, 60 room hotel, restaurant, and a 3-unit multi -family dwelling under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a planned unit development consisting of a 200 room hotel, 60 room hotel, restaurant, and a three (3) unit multi -family dwelling, 1720 Shelburne Road. The amendment consists of removing the previously approved sewer allocation for the 60 room hotel and three (3) unit multi -family dwelling. This project was approved on 5/25/99 and 6/29/99. 2. The owner of record of this property is John Larkin, Inc. 3. The applicant was granted 40,000 gpd of sewer allocation in 1985 for the 200 room hotel (formerly known as Harbor Inn, now known as Howard Johnson's and Holiday Express). The PUD has a 43,174 gpd allocation, and Mr. Larkin has spent $107,935 in sewer fees. The average of the actual flows during the peak usage is 25,820 gpd. This is an excess allocation of 14,180 gpd. The applicant requested removing the previously granted allocation of 3,773 gpd and applying the excess allocation to the new hotel and three (3) unit multi -family dwelling. Staff felt this was acceptable because the new hotel is part of the PUD which has the excess allocation. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the final plat application of Lark -Inns LLP, Inc. to amend a planned unit development consisting of a 200 room hotel, 60 room hotel, restaurant, and a three (3) unit multi -family dwelling, 1720 Shelburne Road. The amendment consists of removing the previously approved sewer allocation for the 60 room hotel and three (3) unit multi -family dwelling, subject to the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The previously approved sewer allocation of 6020 gpd is hereby removed. The applicant shall be allowed to apply 6020 gpd of excess allocation previously granted to the applicant for a 200 room hotel and existing restaurant located on this property.
