HomeMy WebLinkAboutSD-00-50 - Decision - 1702 Shelburne Road#SD-00-50 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY CHITTENDEN CITY OF SOUTH BURLINGTON Re: Final plat application #SP-00-50 of John Larkin to amend a planned unit development consisting of a 200 room hotel, a 60 room hotel, restaurant, and a three unit multi -family dwelling. The amendment consists of adding a ground mounted HVAC unit, relocating a transformer, and revising the landscaping, 1702 Shelburne Road. On the 16" day of January, 2001, the South Burlington Development Review Board approved the final plat application of John Larkin under Section 204 of the Subdivision Regulations based on the following findings: 1. This project consists of amending a planned unit development consisting of a 200 room hotel, a 60 room hotel, restaurant, and a three (3) unit multi -family dwelling. The amendment consists of adding a ground mounted HVAC unit, relocating a transformer, and revising the landscaping. The Board was made aware that the applicant has already installed the HVAC unit and transformer without approval or permits. 2. The owner of record is John Larkin, Inc. 3. Coverage/setbacks: Staff requested that the applicant submit the updated total coverage as the HVAC pad and the transformer will increase the total coverage for the lot. The previously approved overall coverage was 39% (70% maximum). 4. Landscaping_ The applicant proposed relocating five (5) Little Leaf Linden trees from the west elevation of the building to the south elevation of the building in order to provide adequate area for the trees to grow. The applicant proposed relocating three (3) Pin Oaks to allow for adequate growing room. The quantities and value of the approved material will therefore not be altered. 5. The Development Review Board hired the consulting firm of Pearson & Associates, mechanical and electrical engineers, to evaluate the proposal. Mr. Ed Pearson indicated that the chiller could be placed at the north end of the building. A cost estimate provided by Mr. Pearson indicated that it would cost $33,000 to $34,000 to relocate the chiller to this location. 6. The Department of Fish & Wildlife indicated in a letter dated 1/9/01 from Kristen Rose to Ed Pearson that they are against placing the chiller at the north end of the building as it would encroach into a buffer area and "may compromise the stability of the steep slope." DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves final plat application #SD-00-50 of John Larkin to amend a planned unit development consisting of a 200 room hotel, a 60 room hotel, restaurant, and a three unit multi -family dwelling. The amendment consists of adding a ground mounted HVAC unit, relocating a transformer, and revising the landscaping, 1702 Shelburne Road, as depicted on a three page set of plans, page one entitled "Landscaping Plan Stay -bridge Sites 1720 Shelburne Road South Burlington Vermont," prepared by Rabideau Architects, Inc., dated 3/26/98, with a stamped received date of 8/30/00, with the following stipulations: 1. All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. The plat plan shall be revised to show the changes below and shall require approval of the Director of Planning and Zoning (hereinafter Director). Four copies of the approved revised plat plan shall be submitted to the Director prior to recording: 2. The final plat plan shall be revised to show additional evergreen landscaping to screen the chiller and transformer. 3. The applicant shall obtain a zo, ig permit within six months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the units. 5. The final plat plan (sheet 1) shall be recorded in the South Burlington land records within 90 days or this approval is null and void. The plan shall be signed by the Development Review Board Chair or Clerk prior to recording.
