Mr. Farley seconded. Motion passed unanimously. 5. Site Plan Application #SP-06-61 of Brad Rabinowitz to amend a previously approved plan for a 24' x 24' 2-story medical office addition to an 1809 sq. ft. medical office building. The amendment consists of reducing the parking requirement from 15 spaces to 12 spaces, 34 Patchen Road: The applicant noted that when they came to paving the parking lot, they realized they would have to take down some good trees in order to get 15 spaces. Mr. Belair then suggested they look for some off -site parking, but no one in the area was interested or willing to accommodate them. The applicant said they are not strictly speaking a "medical" use. They are psychologists, and all 6 of them are never in the building at the same time. There has never been a full parking lot in 20 years. They are hoping not to have to destroy trees when it isn't necessary. Mr. Bolton, from the neighboring building, expressed concern that if there are no parking spaces available in this lot, people will come and park in his lot, and it will become his problem. He said he doesn't want to have to police the situation. Ms. LaRose said she had talked with Craig Lambert, and he would like to see the trees saved. Mr. Belair said this could become an enforcement action. If he is called, and there is a problem, the DRB can then require the added spaces. The applicant said he is willing to work with Mr. Bolton if there is a problem. Mr. Bolton said he is happy with that assurance. Ms. Quimby moved to approve Site Plan Application #SP-06-61 of Brad Rabinowitz subject to the stipulations in the draft motion. Mr. Plumeau seconded. Motion passed unanimously. 6.) Public Hearing: Appeal #AO-06-03 of Magali Mouscardy appealing the �./ denial of zoning permit #ZP-06-348 for a detached garage, 25 Brigham Road: Mr. Belair indicated he had denied the permit because the applicant did not have approval from the DRB for expansion of the footprint, which is required in that district because of the stream buffer. Mr. Belair showed the area on the map and indicated the buffer zone. Mr. Goodrich gave the Board a folder of information. He noted that all towns have different setback requirements, and he felt there should be consistency so the Lake can be cleaned up. -2- DEVELOPMENT REVIEW BOARD 17 OCTOBER 2006 Mr. Goodrich said the garage area would be 16 ft. above sea level, and it is their contention that this property is 413 feet from the shoreline. He showed an aerial photo and a line 150 ft. from the shoreline. Mr. Behr noted that the 102 foot elevation extends back from the Lake. Ms. LaRose said they have to consider what will happen if the Lake reaches 102 feet. Mrs. Mouscardy's property will flood. Ms. Leslie, a neighbor, said she can attest to the flooding. The brook fills up in 7-10 minutes in a hard rain. She noted that the Lake was at 98 feet this summer. Both her property and the Mouscardy property have underground doors that face the Lake, and both of their homes have flooded. Mr. Behr said the regulations are very straight forward, and the applicant is within the surface water buffer. Mr Goodrich said there are only 3 areas being monitored. A special retention pond was built at Shearer Chevrolet which has cleaned up the situation tremendously. Mr. Plumeau then moved that with regard to Appeal #AO-06-03 of Magali Mouscardy, the Board upholds the decision of the administrator office to deny. Mr. Birmingham seconded. Motion passed unanimously. 7. Public Hearing: Continued Public Hearing: Preliminary plat Application #SD-06-66 and Final Plat Application #SD-06-67 of VT Wholesale Foods DBA Harrington Bros., for a planned unit development consisting of a 7500 sq. ft. building with 5000 sq. ft. of warehouse use and 2500 sq. ft. of wholesale distribution use. The amendment consists of constructing a 3750 sq. ft. addition for warehouse use, 400 Patchen Road: Ms. LaRose said the item had been continued while they waited for a survey which has now been received. Ms. Quimby moved to approve Preliminary Plat Application #SD-06-66 and Final Plat Application #SD-06-67 of VT Wholesale Foods DBA Harrington Bros., subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. Purpose. It is the purpose of this Section to provide .for the protection and improvement of the surface waters and streams within the City of South Burlington, Lake Champlain and Shelburne Bay, and the watersheds contained wholly or partially within the City. These regulations and standards are intended to lead to the establishment and protection of natural areas along the City's surface waters to provide improved protection for water quality and the provision of open space areas and wildlife habitat. It is the further purpose of this Section to provide for the retention of pre- existing residential neighborhoods located along Lake Champlain and Potash Brook in a manner consistent with the resource protection goals of this Section and the Comprehensive Plan. B. Comprehensive Plan. These regulations hereby implement the relevant provisions of the City of south Burlington adopted comprehensive plan and are in accord with the policies set forth therein-. C. Surface Water Buffer Standards ("Stream Buffers") (1) Applicability. The requirements of this Section shall apply to all lands described as follows; (a) All land within one hundred (100) feet horizontal distance of the centerline of Muddy Brook and the main stem of Potash Brook, with the exception of lands within the Queen City Park zoning district. which shall be subject to the provisions of (D) below. (b) All land within one hundred (100) feet horizontal distance of the edge of the channel of the Winooski River (c) All land within fifty (50) feet horizontal distance of the centerline of any minor stream (d) All land within ten (10) feet horizontal distance of the centerline of a drainage way (d) All land within one hundred fifty (150) feet horizonWl distance of the high water elevation of Lake Chalaln, which for purposes of these regulations shall be one hundred two (102) feet above mean sea level datum. This same year is also the target for Vermont and Quebec to meet their phosphorus reduction goals. Although the public commitment to reach this goal is stronger than ever, adequate funding for effective actions is essential. Algae blooms and aquatic plant growth in the Lake are exacerbated by too much of the nutrient phosphorus. The bays and segments of the Lake are monitored to see if they meet the water quality targets for phosphorus that were agreed upon by New York, Vermont and Quebec in 1993. Although many conditions, I?vich as §hallow, warm water Eontribilte to algal blooms, as phosphorus levels go down these blooms should eventually decrease. Today, about 90% of the phosphorus enters the Lake from the landscape —lawn and agricultural fertilizers are common sources. Only 10% is from wastewater (sewage) treatment plants, compared to 30% when the LCBP started in 1991. FACTS 1. The appellant and owner of record of the property which is the subject of this appeal is Magli Mouscardy. 2. On September 11, 2006, the appellant submitted a zoning permit application for construction of a detached garage and converting the existing attached garage to a family room. 3. On September 13, 2006 the Administrative Officer assigned the application #ZP-06-348 and denied the application on the grounds that the proposed garage requires approval of the Development Review Board pursuant to Section 12.01(D) of the Land Development Regulations and this approval has not been obtained (copy of application enclosed). 4. On September 25, 2006, the appellant submitted a Notice of Appeal (#AO-06-03) appealing the denial of Zoning Permit #ZP-06-348 (copy enclosed). 5. The issue at hand is whether this property is located within a "Stream Buffer" as described in Section 12.01(C)(1)(d) of the Land Development Regulations which reads as follows: `"All land within one hundred fifty (150) feet horizontal distance of the high water elevation of Lake Champlain, which for the purposes of these regulations shall be one hundred two (102) feet above mean sea level datum". 6. The 102 foot elevation line along the lake extends eastward from the lake along Bartlett Brook which runs along the north portion of the property and the corresponding 150 feet buffer extending from the 102 ft elevation encompasses most of the property, and specifically encompasses the location of the proposed garage (see enclosed plan labeled "EXHIBIT A"). 7. The property is therefore clearly within the "stream buffer" necessitating approval of the Development Review Board before a zoning permit can be issued. Mr. Dinklage then reminded people in the audience to sign the sign-up sheet and explained the new state regulations regarding appeals. `:J Sketch Plan Application #SD-05-78 of Magali Mouscardy for a planned unit development consisting of a 2-family dwelling on a 0.82 acre parcel developed with a single family dwelling, 25 Brigham Road: Mr. Goodrich identified the parcel as #25. It has frontage on Brigham Rd. and goes back to the brook. Ms. Mouscardy purchased the property with the understanding that it would be 1.1 acres. Four duplexes were then designed which would have been allowed. When the property was surveyed, it was found that to be only 3/4 of an acre. This allows only 3 units. There is an existing single-family house, so 2 more units would be allowed. -1- DEVELOPMENT REVIEW BOARD 4 OCTOBER 2005 All proposed units would be served by the existing curb cut. All are within the regulations. Mr. Belair noted that the deck on the back does project into the stream buffer. Mr. Goodrich said they are willing to omit that terrace. Mr. Dinklage stressed that the city doesn't want anything in the 50-foot setback, and the Board will require a physical delineation so the setback doesn't become part of someone's backyard. Ms. LaRose noted that the Natural Resources Committee agreed that with the correct plantings it wouldn't become a "lawn." Mr. Dinklage said that from a practical point of view, these people won't have a backyard. He felt not having a physical delineation would invite all kinds of problems. Mr. Dinklage asked about the use of lot #19. Mr. Goodrich said it belongs to lot #36 and is used to store boats, etc. Ms. Leslie said she lives on lot #18. She noted the property borders Brigham Road and comes down S. Beach Road. There is a tree -line barrier between the two properties. She felt the single-family house was in keeping with the integrity of the neighborhood, but a duplex was not. She also noted that there is a common right-of-way which serves as access to the beach, and this has been legally designated. Mr. Goodrich said Ms. Mouscardy respects that right-of-way. Ms. Leslie noted that the opening for the driveway will be 21 feet which will make the impervious surface greater than the green area. She felt there will be far too many vehicles on that area. Ms. Ekhart presented a letter from the residents of 36 Brigham Road. They note Brigham is a very short, narrow road with 3 houses on it. They feel 2 more units will put a strain on the road. Fire trucks can't get down there, nor can garbage trucks. Ms. Ekhart also noted that people who live in the existing house now have cars parked all over the place, so that it looks like a UVM fraternity. The place next to the brook is being trampled by them. Ms. Ekhart said it appears the absentee landlord doesn't care. Mr. Ekhart noted there is a law that no more than 4 unrelated individuals can live in a dwelling. He asked how that is determined. Mr. Belair said it is very hard to enforce, and to his knowledge nobody has ever been taken to court about it. Mr. Dinklage noted that the Planning Commission and City Council are working to limit the number of vehicles that can be on a property. He asked neighbors to call the City Manager and support that initiative. Ms. Leslie asked about easement rights for properties that abut Brigham Rd. She also noted that the proposed development property is not on city services but uses a private well. Ms. La Rose said there will be a stipulation that they must use city water and sewer. Mr. Dinklage suggested the application not go further until the DRB can examine what controls it can exercise here. Mr. Belair noted the proposal meets the density and -2- DEVELOPMENT REVIEW BOARD 4 OCTOBER 2005 setbacks. No encroachment is planned in the storm buffer except for grading which the Board does not have to endorse. If the applicant goes to the next step, they will have to show locations for sewer lines, etc. Mr. Goodrich said the existing house is connected to the city sewer. Ms. Leslie noted that when it rains, water backs up in their drains, and the water is black. Mr. Behr felt this would be too much development for the site. Mr. Dinklage said there may not be a legal basis to deny it. Ms. Leslie was concerned with the impact on the stream because of so much impervious soil. Mr. Goodrich said they would omit the existing paved area and would agree not to pave the new parking area. 4. Continued miscellaneous application #MS-05-04 of Malcolm Willard to stockpile up to 2000 cubic yards of fill, 1100 Hinesburg Road: Mr. Willard said the fill would be about 4-5 feet high. He felt they may fall under the stormwater regulations because gravel is considered an impervious surface. I think it is on the opposite side of the drive from the existing home. Adding a duplex would strain the carrying capacity of that pipe. Plus I am not sure if that line is public or private (I suspect it's private). Tuesday, October 04, 2005 We the residents of 32 Brigham Rd oppose the building of a Duplex on the Mouscardy property at 25 Brigham Rd, while keeping the existing house on that lot. Brigham Rd is a narrow short road right now, with three houses on it. The addition of 2 more dwellings will put a strain on that narrow road. Snow removal will be more difficult. Now even fire trucks and garbage trucks can't navigate it properly. In the winter the parking will be impossible as the people at the three dwellings will spill onto the road. Who will reside in these dwellings? Right now, as has been the case for many years since the people who owned the place moved away, it has been rented to transient people. These are absentee landlords who will rent to anyone who meets their price, right now the place looks like a fraternity at UVM. We can never tell how many people are living in the house; there are at least 4 cars there at any time. It is our uncierstaa *- that SB has a law that prohibits more than 4 unrelated adults from living together at the same dwelling. In the 21" century we are sure that that is next to impossible to enforce. This is the most disturbing fact to us; we never know who is living there. With two more places how many people will actually be jammed on to this small piece of land. We live on a quiet street in South Burlington with mostly elderly people the presence of another two places with hordes of young adults living there is not what we are looking forward to. We don't want to be bad neighbors but the rental of the house now and the prospect of them renting two more is a disturbing thought. That means in the winter we can expect 12 cars parked on this very small piece of land and consequently the road. Last but not least if this is allowed we can see that at a future time our neighbors and we will also want to add two more dwellings to our building lots. What is to stop us? The applicant shall submit grading and erosion control plans as part of the preliminary plat application. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan shall meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. (c) The project incorporates access, circulation and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. Access to the project is proposed by an existing 22' wide curb -cut off of Brigham Road. This is a sufficient means of access for the project. The applicant is not proposing any sidewalks. Circulation appears to be adequate. (d) The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. There does not appear to be any wetlands on the subject property, but Bartlett Brook runs adjacent to the property. A portion of the proposed fill is within the 50 ft. buffer of Bartlett Brook. The applicant appeared before the Natural Resources Committee (NRC) on August 4 and September 1, 2005 to discuss the proposed fill and a proposal to thin the tree line. The NRC issued recommendations on this matter to the Development Review Board on September 1, 2005 (attached). Pursuant to Section 12.01(C) of the SBLDR, the DRB may allow fill within the buffer. The applicant has also proposed that a first -story patio and a second -story deck be located within the 50 ft. buffer of the brook. The patio and deck are considered to be new land development activity and are not among the permitted uses included in Section 12.01(C) of the SBLDR. The patio and deck should be removed from the plans or the plans revised to be shown outside of the 50 ft. buffer. 5. The rear patio and deck should be removed from the plans or the plans should be revised to be shown outside of the 50 ft. stream buffer (e) The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. (h) Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. The City Engineer and Superintendent of the South Burlington Water Department will review the plans to determine the project's compliance with this requirement. (i) Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is consistent with City utility and roadway plans and maintenance standards. The project is in compliance with this criterion. Q) The project is consistent with the goals and objectives of the Comprehensive Plan for the affected district(s). Staff feels that the proposed project is in compliance with the South Burlington Comprehensive Plan. SITE PLAN REVIEW STANDARDS Pursuant to Section 14.03(A)(6) of the Land Development Regulations, any PUD shall require site plan approval. Section 14.06 establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. Staff feels the project accomplishes a desirable transition from structure to site and from structure to structure. The site does provide for adequate planting and safe pedestrian movement. No further curb cuts will be required as there will be a shared access drive from Brigham Road. According to Section 13.01(B) of the Land Development Regulations, the proposed project requires a minimum of seven (7) parking spaces. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. Staff finds the parking layout to be acceptable for this project. There are several garage spaces available. Although parking is located to the front of the building, it would be an unnecessary encroachment into the stream buffer area to locate parking to the rear (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The applicant has indicated that the height of the building be 40 ft. This should be shown on the elevations and should include the height from the pre -construction grade. 8. The elevations shall be revised to show the height of the building from pre -construction grade. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. 9. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. (fl Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. Staff does not feel it is necessary to require the reservation of land to provide access to abutting properties. Exterior lighting details (cut -sheets) in compliance with Appendix D of the Land Development Regulations should be submitted with the preliminary plat application. Stormwater drainage plans must demonstrate compliance with the Vermont Stormwater Management Manual, pursuant to Section 15.13(F) of the Land Development Regulations. A portion of the property falls within the Bartlett Brook Watershed Overlay District. Thus, the proposed project shall be in compliance with Section 12.03 of the Land Development Regulations. 2. All applicable data required by Section 12.03 of the Land Development Regulations shall be submitted with the preliminary plat application. The applicant shag obtain preliminary wastewater allocation approval from the Director of Planning and Zoning, Juli Beth Hinds, prior to final plat plan approval. (b) Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. 6. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan shall meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. (c) The project incorporates access, circulation and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. Access to the project is proposed by a 22' wide curb -cut off of Brigham Road. This is a sufficient means of access for the project. The applicant is not proposing any sidewalks. Circulation appears to be adequate. (d) The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. There does not appear to be any wetlands on the subject property, but Bartlett Brook mans adjacent to the property. Staff has already stated that the applicant should submit the information required in Section 12.03 of the plans with the preliminary plat application, so that impacts to the Brook can be analyzed. (e) The project is designed to be visually compatible with the planned development pattems in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. Staff feels that the proposed project is in keeping with the stated purpose of the LN Zoning District (t) Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. Open space on the property is sufficient. The major open space corridor relevant to this project is the Bartlett Brook, which runs to the north of the subject property. Adequate protection of the Bartlett Brook will be required of this project. (g) The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. 7. The South Burlington Fire Department should review the plans, prior to final approval. SITE PLAN REVIEW STANDARDS Pursuant to Section 14.03(A)(6) of the Land Development Regulations, any PUD shall require site pan approval. Section 14.06 establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement; and adequate parking areas. Staff feels the project accomplishes a desirable transition from structure to site and from structure to structure. The site does provide for adequate planting and safe pedestrian movement. According to Section 13.01(B) of the Land Development Regulations, the proposed project requires a minimum of nine (9) parking spaces. 8. The plans should be revised to depict a minimum of nine (9) parking spaces in compliance with Table 13-8 of the Land Development Regulations, prior to submittal of the preliminary plat application. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. 9. Parking spaces should be located to the rear or sides of the proposed buildings. (c) Without restricting the permissible limits of the applicable zoning district; the height and scale of each building shall be compatible with its site and existing or adjoining buildings. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of difilerent architectural styles. 10. Proposed building elevation plans should be submitted with the preliminary plat application. In addition to the above general review standards, site plan applications shall meet the following specific standards as set forth in Section 14.07 of the Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street; to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not feel it is necessary to require the reservation of land to provide access to abutting properties. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). 11. The plans should be revised to depict proposed dumpsters, adequately screened, prior to submittal of the preliminary plat application. Lighting 12.
