SITE PLAN APPLICATION #SP-08-40
FINDINGS OF FACT AND DECISION
Lark Inns, LP, hereafter referred to as the applicant, is seeking site plan approval to alter
the building elevation by the construction of a roof over the existing terrace deck, 1712
Shelburne Road.
The Development Review Board held a public hearing on Tuesday, June 3, 2008. Greg
Rabideau represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
NDINGS OF FACT
1. The applicant is seeking site plan approval to alter the building elevation by the
construction of a roof over the existing terrace deck, 1712 Shelburne Road.
2. The owner of record of the subject property is Lark Inns, LP.
3. The subject property is located in the Commercial 2 (C2) Zoning District.
4. The plans submitted consist of a four (4) page set of plans, page one (1) entitled,
"Roof Plan Comfort Suites Roof Modifications", prepared by Rabideau Architects,
dated 3/6/08, last revised on 4/4/08.
5. The new roof is directly over an existing elevated terrace deck and therefore
there is no change in coverage on the site.
6. The new roof is above the height limit for the district, but below the existing
roofline of the main portion of the building. This proposal would not increase the
height of the building. The applicant's goal in the proposal is to solve a leak
problem associated with the existing roof and terrace.
7. As this proposal changes the record drawings depicting the elevations of the
building, it requires approval by the Development Review Board.

approve Site Plan Application #S -08-40 of Lark Inns, LP, subject to the following
conditions:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in full effect.
2. This project shall be completed as shown on the plans submitted by the applicant
and on file in the South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to the use of the new roof.
5. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

You will be bound by the decision, pursuant to 24 VSA 4472 (d) (exclusivity of remedy;
finality).
