RE: Request for Variance from Height Restriction, Howard Johnsons
Dear Dick,
Please review the enclosed application materials regarding the
request for a waiver from LTH Associates to exceed the height limits
as established by section 18.112 of the South Burlington Zoning
Regulations. The applicant requests permission to place (2) roof top
air conditioning units on top of the recently completed Harbor View
Ballroom. These units, if permitted, would exceed the maximum height
allowed under section 18.112 subsection (b) as authorized by the
planning commision by a total of 3.31 feet. Our response to the five
required criteria are as follows:
1. The site has en exceptional topography, dropping from a high
of 210 feet to a low of 158 feet for a total of 52 feet or 5
stories. At the direction of the planning commision and in order to
minimize the visual impact of the project on Shelburne Road, the
buildings were placed on site perpendicular to that topography
causing large changes in grade over the length of any individual
building on the site. The buildings were also placed as close as
possible to the Bartletts Brook Conservation Area to the south,
prohibiting any ground level expansion of the project.
2. The restrictions imposed on further development of this
property by the loss of area to the conservation easement and the
large drop in topography caused by placement of the buildings as
directed creates a situation where the logical direction to expand
is up but the calculation of average grade becomes unusually
restrictive.
3. These limitations are the result of natural circumstance and
not any fault of the applicant.
4. This variance, if granted, would have no impact on adjoining
properties or the general good because it will be effectively hidden
by conservation easements to the south and north, by the mass of
building number 4 to the east and by the topography and the main
mass of the existing hotel and restaurant to the west.

5. This variance will provide the minimum variance possible
because it involves only 1/10 of one percent of the total footprint
on this site, it does not expand density or revise use, and it will
not be visible from off site.

whatever steps are necessary to comply with the 45 foot height

inform this office when the work is completed.
