HomeMy WebLinkAboutSP-16-44 - Decision - 1690 Shelburne Road#SP-16-44 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING PIZZAGALLI PROPERTIES, LLC — 1690 SHELBURNE ROAD SITE PLAN APPLICATION #SP-16-44 FINDINGS OF FACT AND DECISION Pizzagalli Properties, LLC, hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan for a 63 unit multi -family dwelling. The amendment consists of: 1) minor sidewalk changes, 2) minor site modifications, and 3) adding a boulder retaining wall, 1690 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking after -the -fact approval to amend a previously approved plan for a 63 unit multi -family dwelling. The amendment consists of: 1) minor sidewalk changes, 2) minor site modifications, and 3) adding a boulder retaining wall, 1690 Shelburne Road. 2. The owner of record of the subject property is Pizzagalli Properties, LLC. 3. The subject property is located in the Commercial 2 Zoning District. 4. The application was received on 7/11/2016. 5. The plan submitted is titled, "Bartlett Brook Apartments 1690 Shelburne Rd. South Burlington, VT 05403", dated 1/06/14, and last revised on 07/11/16. DIMENSIONAL REQUIREMENTS 6. Building coverage, overall coverage, and front yard coverage will remain unchanged as the request as the site modifications are minor. 7. Setback requirements for the new retaining wall are being met. SITE PLAN REVIEW STANDARDS None of the site plan review standards are affected by this application. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-16-44 of Pizzagalli Properties, LLC, subject to the following conditions: - 1 - #SP-16-44 All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit within 12 months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the building. 5. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. Signed on this day of S1rl 2016 by and 1. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
