SITE PLAN APPLICATION #SP-17-65
FINDINGS OF FACT AND DECISION
Willie Racine's, Inc., hereinafter referred to as the applicant, is seeking approval to
amend a previously approved plan for an auto sales and service facility. The amendment
consists of: 1) adding a dumpster enclosure, and 2) replacing the light poles and light
fixtures for the parking lot lights, 1650 Shelburne Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The project consists of approval to amend a previously approved plan for an auto
sales and service facility. The amendment consists of: 1) adding a dumpster
enclosure, and 2) replacing the light poles and light fixtures for the parking lot
lights, 1650 Shelburne Road.
2. The owner of record of the subject property is MDT Partnership.
3. The subject property is located in the Commercial 2 Zoning District.
4. The application was received on September 11, 2017.
5. The plan set submitted consist of two (2) sheets, page one (1) is titled, "Plat of
Survey Wilfred R. & Annette R. Racine Prop. No. 1700 Shelburne Rd. So.
Burlington, VT (Lot No. 4)", dated on June, 1986.
DIMENSIONAL REQUIREMENTS
6. No changes to coverages.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the
following_ general review standards for all site plan applications:
Only the standards below are affected by this application. All other standards will
continue to be met.

Lighting
1. Eight (8) existing pole lights will be replaced with 20 ft. poles and the fixture will
be replaced by new fixtures which comply with Appendix D in the LDRs. A point
by point lighting plan was submitted which indicates compliance with Appendix A
for maximum lighting levels.
Bicycle Parking
2. The plan will have to be revised to comply with Section 13.14 of the LDRs to
include the new type and location for bicycle racks, to accommodate the
minimum requirement of two (2) (50% of requirement) short-term bicycle parking
spaces or comply with the full requirement of four (4) bicycle spaces.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-25 of Willie Racine's, Inc., subject to the following conditions:
1) All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2) This project must be completed as shown on the plan and will be on file in the
South Burlington Department of Planning and Zoning.
3) The plans must be revised to show the changes below and will require approval
of the Administrative Officer. Three (3) copies of the approved revised plans
must be submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to include the minimum requirement of two
(2) (50% of requirement) short-term bicycle parking spaces or comply
with the full requirement of four (4) bicycle spaces.
4) The applicant must obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
5) The applicant must obtain a Certificate of Occupancy from the Administrative
Officer prior to using the new vehicle display spots.
6) Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision
by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
