SUBDIVISION HARING
The South Burlington Planning Commission will hold a
public hearing at the South Burlington City Hall, Conference
Room, 1175 Williston Road, South Burlington, Vermont on
Tuesday, October 12, 1976 at 7:30 p.m. to consider the sub-
division application of Nordic Ford, Mr. Jan Rozendaal,
1600 Shelburne Road, South Burlington, Vermont. The
application is for approval of a subdivision of a parcel
of land containing eight point three (8.3) acres into two
(2) lots of 2.8 acres and 5.4 acres. Subject property is
located on the easterly side of Shelburne Road, containing
six hundred (600) feet there -on, property is bounded on
the north by property of National Life Insurance of
Montpelier, Vermont, on the south by property of Fairview
Motors of Eurlington, Vermont anc on the east by other
properties of Nordic ord, as per plans on file at the
City Hall Offices.

Mr. Page said he had spent some time with Bruce Houghton and Bruce seemed
to think this was the best access for the plan presented, but he felt the
southern half of the curb cut should be for entrance and the northern part
for exit, with the turning movements taking place on the property.
Mr. Poger felt one of the stipulations should be that the parking lot be
marked for entrance and exit.
Mr. Wessel asked about landscaping.
'fir. Page said 70% of the landscaping would be new with 30% being made up
of what is existing.
Mr. Lash said there many good big trees that with two curb cuts would have
to be taken out. ,
T•'r. Ward said there are trees that they don't know whether they are worth
saving or not; the Tree Committee will determine that.
Mir. Page felt the trees were pretty well spotted on a survey showing the
existing trees on one of the plans.
Mr. Wessel asked about drainage, and if it would significantlalter the
traffic circulation or the access. y
Mr. Ward said it would not change anything; it would be putting in catch
basins.
Referring to landscaping again, 'fir. Page said there was enough existing
vegetation to landscape two lots if it was spread around. There is an
adequate amount of new planting planned and they could pick and choose from
a number of good trees to make up the balance.
Mr. Lash said he thought they had at least $7,000 or $8.000 in existing trees.
Mr. Ward said the Tree Committee has a guide it uses in evaluating existing
landscaping.

After a brief recess the meeting was reconvened at 9315 p.m.
Site Plan Review for Sambo's Restaurant which had been scheduled for this
meeting was cancelled.

Because Nordic ;ord had received a requested variance the day before from
the Zoning Board they were prepared to present their site plan even though
it had not been scheduled.

Mr. Ward said this hearing had. been scheduled originally for next week,
but considering it at this meeting would save time for Nordic Ford. He
explained this was a sketch plan for a subdivision, that any commercial
subdivision is defined as a major subdivision even though in this case it
Is only one lot.
Mr. Ward explained any car sales service or car facility is a conditional
use in a B.P.D. District and Nordic Ford received the conditional use
variance from the Zoning Board. Ghat they propose to do is to set off 205
feet of frontage by 200 feet of depth, remove the chalet building which is
presently being used as a rental car facility and a garage which is now
their reconditioning building and set up a separate dealership which is
Toyota. This will be a separate auto dealership as such but still owned
by Nordic. One of the reasons for going through subdivision is because
otherwise they couldn't have any identification at all. A multiple use can
only have one sign.
Jan Rozendaal explained there was going to be a Toyota dealership south of
him and, the dealership was offered for sale to him, and one of the con-
ditions he has to meet to get approval from Toyota is to build a separate
facility. They want to put it on the 200 foot lot north of their present
building.
Mr. Ward said the 600 x 600 lot of Nordic was never part of a subdivision
and the Fairview Toyota lot to the south was also divorced from the sub-
division.
Mr. Gonyea indicating on the sketch the existing landscaping and the
existing pavement and nothing will be changed except to set in the new
building.
Mr. Rozendaal said the two buildings would be identical in appearance
but there will be identification for the benefit of the public. There
would be access through Nordic Ford's lot.
There was considerable discussion regarding the service road, the right
of way, and the question of future access if ownership of the lot should
change hands.
Yx. Rozendaal said the right of way is owned by National Life; he has a
right of way over it but so do all the owners.
Mr. Ward pointed out that access to lots #4 and #1 was only from the
service road, inside circulstion, with no access to Shelburne Road.
Chairman Wessel said it would be necessary next week to have some kind of
statement clarifying the status of the roadway.
Mr. Page is to research the property and check with Roger Curtis on the
status of National Life concerning the property, and also the University
status on the right of way.
Mr. Rozendaal said no property division is going to take place, they would
still use the Nordic Ford curb cut. Mr. Wessel said as far as the City was
concerned it would be two separate pieces of property.
The curb cut was then discussed. Mr. Page suggested rather than dividing
the curb cut down the center line, that there be an easement to allow access
to the Toyota lot. Asked who would own the curb cut, Mr. Page said it might
be an undivided half interest. He would prefer it to be owned by Nordic
rather than having a line down the middle.

I. Background - Dick Ward has reviewed the action of the
Zoning Board of Adjustment in granting this conditional
use; site plan review is required of this proposal.
Since a detailed landscaping plan is the only item under
site plan review not covered by subdivision review, I
feel subdivision approval conditioned on approval of a
future landscaping plan would be in order. The Commission
should make it clear that, with the exception of final
landscaping, both subdivision and site plan review are
proceeding simultaneously on this project.
II. Comments
- access - should be guaranteed by easements granting access
to tFe Toyota lot over the existing Ford lot; I assume
that the Toyota lot has an unencumbered right of way through
the Hort Farm Road curb cut. The applicant should agree
that neither he nor future owners of the Toyota lot will
request direct access to Shelburne Road.
- other subdivision requirements - survey of lot plus corner
markers, storm drainage review.
Hort Farm Road - I have spoken to representatives of
Nationa 1- e (owner of the land) and UVM (holds an ease-
ment for R.O.W. purposes); it is still unclear to me how
this road will be closed. However, since it appears that
Nordic has some sort of legal interest in this road, I
would recommend that Nordic agree not to use the road for
access to any lot other then Toyota.
