Public Hearing on Subdivision proposal for Nordic Ford property, 1600
Shelburne Road._Messrs. Rozendaal and Goaea.
Chairman Wessel referred to the preliminary discussion at the last meeting
and said one problem was the sharing of the curb cut, also the second curb
cut in the right of way to the University Hort Farm.
?air. Rozendaal explained the proposal to split off one lot and to construct
a building of 8000 square feet to accommodate another franchise, Toyota.
This would be the same ownership of the land, same ownership of the businesses.
There would be no change in the curb cuts. The access would be through the
same driveway of Nordic Ford and the existing 70 foot right of way turning
into what is presently the used car lots The building will be on what is now
the Nordic Ford used car property, with the existing buildings moved to the
back. All the driveways, the curb cuts, the landscaping, would remain the
same. They are just placing the building on the second terrace of the
property, with the existing chalet and small garage to be moved back.
Asked about the curb cut to the University Fh rm road, N.r. Rozendaal said the
present curb cut serves the jug handle down to the other lots and also gives
them access into the Toyota lot. If the Planning Commission wished to have
the right of way cut off at any point up the road, they would have no ob-
jections. He said they didn't own this; National Life does. It really does
not affect their project one way or the other because this curb cut has to
remain open to get to the jug handle.
Roger Curtis read aloud a letter and also a resolution from the University
of Vermont. The transfer of the right of way to National Life is in the
process, if not accomplished yet; the particular concerns were a guarantee
that the new access road would be paved and that it would tie into the
remaining portion of the Hort Farm access road. He indicated the location of
this on the drawing and said it is the intention of National Life that this
portion be closed. There have been some changes at National Life and during
that change, and also changes at the University, this has not been accomplished
but it is in the works. The intention is that it would be merged into the
adjoining property. National Life did make a commitment for Lot #3, and he
believed Nordic Ford had indicated they would like this right of way also
and he believed that would be acceptable to National Life also. He indicated
the part to be given up as being easterly of the jug handle.
Mr. Ward asked Mr. Curtis if this could be resolved by the time a new plan
is filed for National Life. He understands some of these lots will be com-
bined in a revised plan. Today nobody uses the right of way heavily, perhaps
a car or two a day and they would like to prevent everybody from using it.
Someone should be forced to close that road; that was one of the conditions.
Sometimes these tactics have to be used to get things done. The road was
supposed to be seeded, not just closed. There will always be sewers there.
Mr. Rozendaal said they agreed to having it closed but they can't close it
themselves.
Mx. Curtis said in his dealings with National Life there had never been any
question or talk of other than this road being closed. At one point a deed
was sent to the City but never was returned.
Mr. 'Morency asked who would close it up and seed it, etc.
Mr. Poger explained the over-all developer, National Life.
Tor. Erring suggested a bond would have to be posted for that.
Mr. Poger said when the revised plan is brought in, if the road is not yet
closed, before any lot can be sold off a bond can be put on at that time.
Mr. Ward agreed with that suggestion.

Mr. Poger asked if it was decided that the Nordic Ford would retain the
driveway in the southern part of this property but that access would be
guaranteed to the new lot being set up.
Mr. Rozendaal said the center drive. Yes.
Mr. Morency asked about the purpose of the northerly access.
Air. Rozendaal said it has always been there; it is just a convenience.
Mr. Ward said that with the design of the parking lot, this functions well.
Mr. Rozendaal said it would be more important now because of the used car
area being in the back; the used car traffic would probably use that access.
Mr. F'essel asked if the used car would still be part of Nordic. and Mr.
Rozendaal said Yes, it would be.
Mr. Poger asked if this would cause a problem, allowing a double use on the
same lot. If
Mr. Ward said if Nordic -Toyota should split, then there would be two separate
areas set off for selling new and used cars. What they are going to do is
to have the back of this lot for used cars and trucks; the only thing that
will identify the strictly used car section is that the building will be in
back there for the used car salesmen.
Mr. Morency asked about storm drainage.
Mr. Ward said Mr. Szymanski hasn't had a chance to look at it. Nothing is
changed. The only thing Mr. Szymanski might want would be a roof drain
because this is to be a flat roof. The lot is already developed and there
are no site improvements necessary. Landscaping and blacktop are already
there. The only change is taking down the two small frame buildings and
putting up a new one.
Mr. Ward then said the mylar plan was there, and because this was set up as
subdivision review and site plan at the same time, this could be considered
a final site plan all at once unless the Commission wished the developer to
come back at a later date with a site plan. The only bonding requirement
would be for some ground cover around the new building, and with that in
mind probably a $300 or $500 bond would take care of that.
Chairman Wessel asked if the City Attorney had said this could be combined.
Mr. ',lard said Yes.
The Chairman said this was really a simple plan and the only hesitation he
would have is that the Commission really hasn't been presented with a land-
scaping plan.
Mr. Ward suggested the landscaping plan could be reviewed later.
The Chairman said his preference would be simply to finish the dubdivision
at this meeting and complete the site plan separately.
Mr. Rozendaal said the lighting and the landscaping are not to be changed;
the lighting is already there and the trees; he would like to get going on
this.
Mr. Poger said he had no objection to approving the site plan with the
stipulation that a final landscaping plan be submitted.
Mr. Poger then moved that the Planning Commission _approve this subdivision
plan and site plan of Nordic Ford with the following stipulations: 1 that
a final lP at plan showin landscaping be submitted subject to the approval
of the Tree Committee; 2 that a bond of j,�00 be posted to cover the cost _
of landscaping; 3that access be provided to the new lot from the northern
driveway of Nordic Ford lot; 4 that the applicant frees to support the
right of way above the jug handle on the old Horticulture Farm road.
Seconded by Mr. Woolery and voted unanimously.
