Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on May 11, 1998 by application
of , Michiaki Soga the applicant, for a variance to build a 10' x 16' deck to within twenty two (22) feet of the
required front yard at 67 Brewer Parkway according to plans submitted. The Board of Adjustment finds as
follows:
1) 67 Brewer Parkway is a single family residential dwelling located within a Residential 4 District.
2) Section 25.00 requires a minimum setback of thirty (30) feet.
3) The applicant is requesting a variance to construct to within twenty two (22) feet of the front yard
property line.
4) The existing setback of the house is thirty two (32) feet.
5) Location of the structure on the lot prevents construction of a deck (front & rear) without a waiver.
6) Lot is narrow and odd shaped.
7) Proposed deck is only eight inches off the ground.
8) General character of the neighborhood will not be affected by the proposal.
ORDER
The variance to construct a 10'x 16'deck at 67 Brewer Parkway is hereby GRANTED.
