Michele Kupersmith, hereafter referred to as the applicant, is seeking site plan approval to construct a
354 sq. ft. accessory residential unit, 23 Brewer Parkway.
Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to herein as staff,
reviewed the application submitted on January 25, 2010 and have the following comments.
ACCESSORY RESIDENTIAL UNITS
Pursuant to Section 3.10(E)(1) of the proposed Land Development Regulations, in any district where a
single-family residence is a principal permitted use, one (1) accessory residential unit within or attached
to a primary single-family residence or within an existing, permitted accessory structure may be permitted
by the DRB in accordance with Article 14, Site Plan Review, and the following additional criteria:
(a) Floor space of the accessory residential unit shall not exceed thirty percent (30%) of the total
habitable area of the single-family dwelling unit.
The single family dwelling unit is 1937 SF. The accessory residential unit is proposed to be 354 SF, or
18.3% of the habitable area of the principal dwelling. Thus, the applicant is in compliance with this
criterion.
(b) The principal dwelling shall be owner occupied.
The applicant currently resides in the principal dwelling. The principal dwelling must remain owner -
occupied.

(c) Adequate wastewater capacity is available to service the accessory unit, as demonstrated by the
issuance of a Wastewater Allocation or on -site wastewater permit pursuant to the South
Burlington Ordinance regulating the use of public and private sanitary sewage and stormwater
systems.
2. The applicant shall obtain wastewater allocation from the Director of Planning and Zoning.

(d) Two additional off-street parking spaces shall be provided on the same lot, either in a garage or a
driveway, or not in any areas required to meet coverage limitations, or any front yard other than a
driveway, required by these Regulations.
The site plan shows a two -car garage and space enough in the driveway for several vehicles. This is
more than sufficient to satisfy this requirement.
(e) A zoning permit shall be required for the accessory residential unit.
3. The applicant shall obtain a zoning permit from the Administrative Officer for the accessory
residential unit.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the following general
review standards for all site plan applications:
(a) The site shall be planned to accomplish a desirable transition from structure to site, from structure
to structure, and to provide for adequate planting, safe pedestrian movement, and adequate
parking areas.
There is adequate consideration given to pedestrian movement and parking on the site.
(b) Parking:
(a) Parking shall be located to the rear or sides of buildings.
(b) The Development Review Board may approve parking between a public street and
one or more buildings if the Board finds that one or more of the following criteria are
met. The Board shall approve only the minimum necessary to overcome the conditions
below.
(i) ......
(ii) The parking area will serve a single or two-family home;
As this is a single-family home, the parking is permitted to the front of the building.
(c) Without restricting the permissible limits of the applicable zoning district, the height and scale of
each building shall be compatible with its site and existing or adjoining buildings.
The height of the existing building is within the limits specified by the SBLDR.
(d) Newly installed utility services and service modifications necessitated by exterior alterations or
building expansions shall, to the extent feasible, be underground.
The applicant has not proposed any additional lighting as part of this application.
(e) The DRB shall encourage the use of a combination of common materials and architectural
characteristics, landscaping, buffers, screens and visual interruptions to create attractive
transitions between buildings of different architectural styles.
The principal residential dwelling and accessory unit are in compliance with this criterion.

(I) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing
buildings and roads in the vicinity that have a visual relationship to the proposed structures.
The principal residential dwelling and accessory unit are in compliance with this criterion.
Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the
South Burlington Land Development Regulations:
(a) The reservation of land may be required on any lot for provision of access to abutting properties
whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector
street, to provide additional access for emergency or other purposes, or to improve general
access and circulation in the area.
Staff does not feel it is necessary to require any additional access easements as part of the proposed
project.
(b) Electric, telephone and other wire -served utility lines and service connections shall be
underground. Any utility installations remaining above ground shall be located so as to have a
harmonious relation to neighboring properties and to the site.
Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and
service modifications shall be underground.
(c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or
other requirements, shall be accessible, secure and properly screened with opaque fencing to
ensure that trash and debris do not escape the enclosure(s).
As the subject building is a single family residence, staff understands that trash will be maintained inside
the building until time for trash pickup.
Traffic
This project will not generate a sufficient amount of traffic to warrant concern or further review.
Other
The accessory dwelling unit is limited to only one (1) bedroom.

Staff recommends that the Development Review Board approve Site Plan application #SP-09-76 and
Conditional Use application #SD-09-09 subject to the conditional items above.

The South Burlington Development Review Board held a regular meeting on Tuesday, 16
February 2010, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset St.
Members Present: J. Dinklage, Chair; M. Behr, E. Knudsen, G. Quimby, R. Farley, B. Stuono

Mr. Belair advised that Item #3 had been withdrawn, and the applicants for Item #7 had asked

Ms. Quimby moved to approve the Minutes of 19 January 2010 as written. Mr. Farley seconded.

Mr. Dinklage reminded the applicant that the dwelling must be owner occupied at all times and
that the accessory unit was limited to one bedroom.
Ms. Kupersmith showed where the entrance would be to the back of the building.
Mr. Belair said staff had no issues with the application.
Ms. Quimby moved to approve Site Plan Application #SP-10-09 of Michele Kupersmith subject
to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously.
4. Site Plan Application #SP-10-11 of Ralph Deslauriers, Jr., for reapproval of a 32-
unit multi -family dwelling, 264 Quarry Hill Road:
Mr. McClellan said the reapproval is necessary because the prior approval has lapsed. He said
this is the same project as previously approved and will be the third building in the row.
Mr. Belair noted that the plan meets all requirements including the new ones.
Mr. Stuono said he would abstain since he had not been a member of the Board for the original
approval.
Ms. Quimby moved to approve Site Plan Application #SP-10-11 of Ralph Deslauriers, Jr. subject
to the stipulations in the draft motion. Mr. Farley seconded. Motion passed 5-0 with Mr. Stuono
abstaining.

Under the 2004 revisions to Chapter 117, the Development Review Board (DRB) has certain
administrative obligations with respect to interested persons. At any hearing, there must be an

This project, consisting of boundary adjustments to create lot 1

GENERAL

collection system. The work shall be done in accordance
with the Environmental Protection Rules, Effective September

Mrs. Lafleur noted that the property line -goes through a
corner of the present building. The new plan shows a 7-1/2
foot easement on either side of the water line; however, on
the plan it actually scales to only 7 ft. This will have to
be revised to show the 7-1/2 ft and was apparently a drawing
error. Mr. Lash said he had it excavated and surveyed.
Ms. Peacock noted that Sue Messina at the Water Dept. is
concerned about plantings on easements which may be ruined if
the Water Dept. had to dig. Mrs. Lafleur said that
landscaping in the right-of-way hasn't been changed on the
plan.

foot parcel. The two lots will be 27,000 square feet each with
the existing house on the westerly most lot. There are no major
problems with this subdivision.
3) SEMICON, 1000 HINESBURG ROAD
This final plat shows the two lot subdivision of the 111.2 acre
property into an 80 acre parcel and a 31.2 acre parcel with the
existing building. The r.o.w. for snow storage, the 80 foot
r.o.w. for Swift Street and utility easements are shown. Legal
documents have been prepared for Spoke's approval. There are no
outstanding issues.
4) LAKEWOOD ASSOCIATES, 1233 SHELBURNE ROAD
The developer proposes several modifications to the recently
approved plans. These include:
1) A reduction in office space from 48,000 square feet in 6
buildings to 35,500 square feet in four buildings. The 150 seat
restaurant in a separate building remains.
2) Use of the existing "Inn" for 6,500 square feet for Vermont
Federal Bank with a drive -through window,
3) Increased front yards and bermed areas to shield the view of
the parking lot.
A revised traffic study is being prepared by Tom Adler for review
by Craig Leiner. It should be available at the meeting. A
summary of the project is also enclosed. See Bill Szymanski's
and Jim Goddette's comments.

Mr. Knapp advised this was originally 2-1/2 lots. They are
moving the division line 30 ft. to the east and terminating
the 1/2 lot. The 2 new lots will be about 270 ft. deep.
A question of setback from the "drainageway" was raised. Mrs
Lafleur said there is a question of whether it is a
drainageway or a swale. If it is a drainageway, they must
have a 50-foot setback from it. This would leave an
inadequate building envelope. The issue will be decided at
permit by the Zoning Administrator.
4. PUBLIC HEARING: Preliminary Plat application of Semicon,
Inc. for a 2-lot subdivision of the'111.2 acre parcel into an
80 acre parcel and a 31.2 acre parcel with the existing
building at 1000 Hinesburg Rd.
Mr. Perry advised the plan now shows sewer easements, the
existing offer for a pumping station on the site, mechanical

Mr. Dooley moved that the Planning Commission approve the
preliminary plat of Robert Perry, Esq., agent for Semicon,
Inc., for the 2 lot subdivision of the 111.2 acre parcel into
a 31.2 acre parcel with the existing buildings and an 80 acre
parcel as depicted on plans prepared 12y Trudell Consulting

5. PUBLIC HEARING: Revised Final Plat of Daniel O'Brien for a
revision to parcel 1 from 24 multi -family ,_ 4 single family
units to 28 multi -family units at Foxcroft, Hinesburg Rd.
Mr. Llewellyn said only Hayes Ave. will be a public street.
All others will conform to city standards. There will be the
same number of units but all will now be condos. Mrs. La-
fleur noted an evergreen screen between this and Cardinal
Woods i,s pro osed. Mr. Dooley said there appears to be less
green space pthan the previous plan and the footprints of the
buildings look considerably larger. Mr. O'Brien said this is
not so. Mrs. Lafleur said the applicant paid the recreation
fee rather than having open space. Ms. Peacock said she is
not comfortable with the 24 foot roads. Mr. Jacob said there
is not on -street parking, so this shouldn't be a problem.
The applicant prefers to leave the drainage pipes open and
use a ditch for storage. This may be a "catch 22" between
the City and State. Mrs. Lafleur noted there has been some
buildup and mudslide activity on the other side. A resident
of Cardinal woods said since trees were removed, there has
been a drainage problem and a pond has filled up. Haybales

Coverage: The building covers 24% of the property. The total
coverage is 69.4%.
Landscaping: A complete landscaping plan is required at
preliminary plat. Large trees should be planted along Williston
and Hinesburg Roads. See Bill Szymanski's comments regarding the
large existing trees.
Traffic: A traffic study that analyzes the pre and post develop-
ment conditions must be submitted to the Planning office and the
Regional Planning Commission at least two weeks prior to the
Preliminary Plat hearing. It must analyze the level of service
at Hinesburg and Williston Road, as well as at the Williston
Road/Midas Muffler Road intersection.

Mr. & Mrs. Shea propose to subdivide a 54,000 square foot parcel
with an existing house into two 27,000 square foot parcels. Each
lot will have 27,000 square feet. Property set backs are
maintained to the existing building. There are no major problems
with this subdivision. See Bill Szymanski's comments.
9) LDB, Inc., (Vermont Structural Steel)_, 1175 Hinesburg Road
Attorney Richard Spokes has given the following opinion on this
subdivision:
a) It does not have to be rewarned as a new preliminary
plat hearing since the change in the number of lots is small
in relation to the entire plan and there will be at least
one more warned public hearing at the final plat stage.
b) If the Commission chooses, the 7-10 acres of agricul-
tural soils can be developed at a future date even though
the 50 acre minimum is not met, provided the Commission
stipulates that such a subdivision is an amendment to this
subdivision and for a maximum of X lots.
The developer has redesigned the subdivision to meet the condi-
tions expressed by the Commission and the Council. The plans now
show 115 single-family lots. The old "Street E" cul de sac
abutting the Economou property to the west has been deleted.
This open space will be part of the park. The r.o.w. to Economou
has also been deleted since it leads to the park and presumably
will not be needed as a future street connection.

7) HINESBURG ROAD SHOPPING CENTER
1. New road should be completed to south-west property line and
in line for the connection as planned for Corporate Circle. It
shall be built to City standards and City owned and maintained.
2. I would recommend the motel pool be located behind the motel
not adjacent to the proposed street which is expected to be a
high volume street.
3. It appears that some of the well established and healthy
trees in the Grand Union parking lot will have to be removed. I
would recommend these trees be preserved even if it results in
loss of some parking spaces.
4. Landscaped islands and parking lot barriers should be lined
with poured in place concrete curbs, not asphalt or precast
concrete set in place.
5. The low wall along the Williston Road sidewalk shall be set
at least three feet away from the sidewalk to allow for snow
plowing.
8), SHEA LOT. BREWER PARKWAY
1. This is a very wet area with high ground water. The proposed
builder should be aware of this and build for those conditions.
2. There exists a very flat drainage swale along the lot line
between the two lots which was constructed by Mr. Shea a few
years ago. This swale shall remain open.

Date: 8/23/84
I have field inspected the area and have no objection to the
work as proposed on plan as prepared by Site Concern/Landscape
Architects, dated 8/7/84.
The area is aflat marshy area with no defined water course.
Cutting a swale will improve surface runoff from the adjacent
area. I would recommend that the metal pipe be bedded in sand
