DEVELOPMENT REVIEW BOARD 6 J U LY 2004 The motion was amended to add to #14(f) the following: "...and advises residents that there are potential agricultural hazards associated with the agricultural use of the adjacent property." Stipulation 3(f) was amended to read: "The plans shall be revised to clearly depict roadway improvements at Hinesburg Road, Van Sicklen Road, and Meadowlark Rd., as agreed upon by the City, State, and developer. These revisions shall be approved by the Director of Public Works and shall be submitted to the Planning & Zoning Office prior to issuance of the first zoning permit. Mr. Boucher then moved to approve Final Plat Application #SD-04-43 of John Larkin as amended. Mr. Farley seconded. Motion passed 4-2 with Mr. Kupferman and Ms. Kupersmith voting against. 5. Public Hearing: Final Plat Application #SD-04-42 of Homestead Design, Inc., to amend a planned unit development consisting of 117 multi -family residential units in 16 buildings. The amendment consists of: 1) a request for the as -built relocation of building G (89, 91 and 101 Stonington Circle) and 2) a request of handicapped accessible sidewalks to buildings E, F, G, H, S, and M, Stonington Circle: Mr. Burke said they will provide additional square footages. Mr. Dinklage noted that the relocation meets the zoning regulations. Mr. Boucher moved to approve Final Plat #SD-04-42 of Homestead Design, Inc., subject to the stipulations in the draft motion of 6 July 2004. Mr. Kupferman seconded. Motion passed unanimously. 6. -Public Hearing: Final Plat Application #SD-04-41 of Tamarack Services of VT a Thrift Car Re ntal ental to amend a planned unit development consisting of three commercial and industrial buildings on two parcels totaling 6.73 acres. The amendment consists of changing the use of 900 sq. ft. of general office use to auto rental use, 1525 Shelburne Road: Mr. Dinklage asked about the possibility of getting more greenery. Mr. Belair noted that some green space was being taken for the Shelburne Rd. widening. Mr. Dinklage suggested the area at the Bartlett Bay Rd./Shelburne Rd. corner. Mr. Belair said that would take more parking spaces, and there is already a 25% waiver. Mr. Spillane said the business doesn't require much parking as people drive in and out. DEVELOPMENT REVIEW BOARD 6 J U LY 2004 Mr. Boucher moved to approve Final Plat Application #SD-04-41 of Tamarack Services of VT dba Thrifty Car Rental subject to the stipulations in the draft motion. Mr. Kupferman seconded. Motion passed unanimously. 7. Continued sketch plan application #SD-04-06 of Mike Anderson for a planned unit development consisting of: 1) subdividing a 14.5 acre parcel into four lots of 2.3 acres (lot #1), 2.3 acres (lot #2), 3.4 acres (Lot #3) and 6.2 acres (lot #4), and 2) developing these lots with 17 dwelling units. The sketch plan has been revised to subdivide the 14.5 acre parcel into three lots of 11.7 acres (lot #1), 1.3 acres (Lot #2) and 1.5 acres (lot #), for a total of three dwelling units, 1600 Hinesburg Road: Mr. McClellan said they are proposing to access the homes from Hinesburg Road in order to avoid impacting the wetland. Kendrick Drive would also have to be upgraded to a public street. Mr. Dinklage noted that staff does not want another access on Hinesburg Road. Mr. McClellan then gave members a graphic of the wetland impacts and also introduced Cathy O'Brien who did the wetland study. Ms. O'Brien indicated a steep slope and noted there is a lot of ground water at the base of the slope. There are also clay soils where water sits for a long time. She said the area is on the wetter spectrum of what is called "wet meadow." The Corps of Engineers and the State of Vermont people were out there. Both strongly felt that the least environmentally damaging impact should be considered. Ms. O'Brien gave members a copy of a memo from Michael Adams of the Army Corps and also a letter from April Moulaert. They indicated that Kendrick Drive should only be considered if there is a compelling safety issue with Hinesburg Rd. Ms. O'Brien noted that the Class 2 wetland will require state input. Ms. O'Brien reviewed impact numbers. She noted that there would be an 848 sq. ft. impact with utilities coming off Kendrick Drive and access coming from Hinesburg Road. There would be an 8,833 sq. ft. impact with both utilities and the road coming from Kendrick Drive. Mr. Boucher felt the cul-du-sac was placed in the worst possible place to emphasize the right -of- way. He suggested it could be turned toward Hinesburg Rd. To lessen the impact. Mr. McClellan said they only have 60 ft. to work with. Mr. Dinklage asked how valuable the wetlands are. Ms. O'Brien said they have a water quality function and are valuable for flood storage. N0. 11210 LETTER OF CREDIT AGREEMENT THIS AGREEMENT, in triplicate, by and between New Fnglnnd Jiffy T,uhP Co_ , hereinafter referred to as "Developer", the CITY OF SOUTH BURLINGTON, hereinafter referred to as "Municipality", and Franklin Lamoille Banko hereinafter referred to as "Bank". W I T N E S S E T H WHEREAS, Developer has received site plan approval from the Municipality's Planning Commission for the construction of a Jiffy Lube Center as depicted on a plan entitled Site Plan Jiffy Lube Center , dated February 12, 1990 , prepared by Pinkham Engineering , and n WHEREAS, Developer is required by said approval, at its own expense, to complete certain public improvements; and WHEREAS, the parties to this agreement wish to establish a mechanism to secure the obligations of the Developer as set forth above, and WHEREAS, the bank executes this agreement solely in the capacity of issuer of the Letter of Credit hereinafter specified. NOW, THEREFORE, the parties hereby covenant and agree as follows: I. Developer will at its own expenses complete the following improvements in connection with its development: (Description of public improvements required by subdivision approval) Landscaping as stipulated in Site Plan Jiffy Lube Center ------------------------------------------------------------------ ------------------------------------------------------------------ ------------------------------------------------------------------ 2. Developer will convey to the Municipality by properly executed Warranty Deed, free and clear of all encumbrances, the roadways, easements, and other public improvements prior to the Municipality granting any zoning permits to the developer. 3. The Developer shall complete the improvements set forth in paragraph one no later than June 1, 1990 4. The Developer shall repair or replace any faulty or defective work or improper material which may appear within One ** year of completion. *- The Letter of Credit may be renewed for two additional one year periods. 5. For the guaranty of Developer's performance of all requirements hereinabove set forth, Developer and Bank agree that the sum of $(Amount set by planning commission or its designee) shall be set aside and held in escrow by the Bank and shall be available for payment to the Municipality, in accordance with the terms herein set forth. 6. If the Municipality shall file with the Bank a statement that Developer is in the judgment of the Municipality in sixty (60) day default under the terms of this agreement, the Bank shall from time to time pay monies from said escrow fund to the Municipality to complete the improvements and requirements set forth in this agreement. 7. The Municipality will promptly submit to the Developer a copy • of such statement as it files with the Bank. The consent of the Developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. The Municipality shall not file with the Bank a statement of default until sixty (60) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 9. All monies released by the Bank to the Municipality pursuant to paragraph 6 shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis, or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgment of the Municipality shall accomplish the work most expeditiously and economically. 10. If monies are released by the Bank to the Municipality pursuant to paragraph 6 and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this agreement. 11. The curb opening for the 24' right of way shall also serve parcel "B". 2. There exists a drainage pipe along the east side (184.89' distance) an easement should be deeded to City for this pipe. It drains Mary Street. 4) JIFFY LUBE, BARTLETTS BAY ROAD Parking signs and no parking signs must be installed and enforced because of the distance from the Fassetts store to the parking area. 5) LAKEWOOD COMMONS, SHELBURNE ROAD 1. Storm water runoff must be controlled from this expansion so as not to impact Holmes Road where it connects. 2. There should be some sidewalks around building H. All pedes- trians must walk in the parking lot to and from other buildings in the complex. 6) BAYVIEW MOTORS, SHELBURNE ROAD There exists a drainage system across this property. Mrs. Esty said all those houses had variances to be built. Is he asking for a greater variance than those houses? Mr. Ward said the average setback of all those houses is about 35'. Mr. Pyle said the request we have is for 32'. We don't want to cut down trees. Mrs. Yandow asked why a 2 family when everything else is one family? Mr. Pyle said the reason why we need the 2 family is to make it economical to purchase the property and make it. Mr. Randazzo said a 2 family home alters the character of the neighborhood. Mr. Blais said let's not forget that a duplex is allowed in a single family neighborhood. The only question for a 2 family is the lot size. Mr. Sheahan said that to me is a residential type area and I have a problem with a duplex because it could affect the character of the neighborhood. Mr. Pyle said I think having a 2 family duplex is going to cause a lot less noise than having 5 people living in a single family house. Mrs. Pell said it's a problem having 5 or more living next door. Mr. Graf asked Mr. Pyle if he owned the property and he replied I don't own the property yet. Mr. Blais said the problem is Mrs. Eaton's. Mrs. Pell said the cul-de-sac is being abused now. The appeal was denied 4 - 3. Mr. Ward said since the last meeting they added 4 parking spaces in the front and have an 18' clearance from edge of road. They have a total of 7 parking spaces. Mr. Beldock said this is a multiple use structure and has been expanded from 2 uses to 3 uses. I contend that this is as compatible a use as a mini -mart and gas station. This is a 10 minute drive through service and these two uses. This building originally had 8 different uses. When you have quick uses you -9- f, have parking. Drive through takes care of its own. We will have a maximum of 6 employees. Right now we have 3 employees plus myself. Will have on -site landlord and I am concerned in keeping the fire lane clear. Mr. King said one of the concerns for the 2 other uses was the traffic flow. Safety in the parking lot - people running in and out. Mr. Beldock said we put in a 4' walkway. Mr. Sheahan said I realize you have 3 heavy traffic uses but this is less use than the previous use. Mr. Beldock said Beardsley would have 30 cars a day and Jiffy Lube 18 a day. The previous use had 76 to 94 cars a day. Mr. Casey said this is an easy safe turn to the right and there is a signal coming out. Easy to get into and once you're in there it becomes Gregg's baby to manage. There is nobody that we can get in the automotive business. The appeal was granted unanimously. Mr. Blais said just a reminder that in your envelope there is an invitation on Wednesday from 7 - 9 put on by the Regional Planning Commission. I will try and obtain a planting schedule before Tuesday's meeting. This project will require significant clearing of an existing wooded area. This will have a dramatic aesthetic impact from Patchen Road. I recommend that a very dense stand of pine (blue spruce, red pine) be planted along the back property line of the duplex lot to screen the parking lot and building. The caliper of the red maple should be increased to at least 2 1/2". Lighting: The final plat should show the type and location of proposed lighting. We would be relocating our existing retail bakery outlet from one Shelburne Road location to another, and don't anticipate a great change in sales. Our current store is open 6 days a week from 9 a.m. to 6 p.m. Peak sales hours are usually during mid —morning and mid —afternoon. Many of our customers are senior citizens who ride together, shop for each other, or ride to the bus, and therefore don't generate high traffic counts at our stores. At peak times we might see 10 — 12 cars an hour. The "Day Old Bread" business just doesn't generate the kind of consumer excitement to get people to battle heavy traffic to stop in our stores, and therefore we feel we'll have the same kind of limited impact on Shelburne Road. traffic that we have now. BURLINGTON r X r QS fThe purpose of this report is to identify the traffic impact of is ita proposed Jiffy Lube service center on Bartletts Bay Road at �y its intersection with Shelburne Road. This involves converting + 5,040 square feet of the former Tinguini's Market into a two bay lubrication facility for automobiles, and the front + 1,540 square feet into a Sting Ray Electronics Shop. The previous specialty food market could be estimated to have had a trip generation rate of perhaps twice that of a supermarket, and possibly one -quarter the rate of a convenience market. Utilizing the trip generation rates published by the Institute of Transportation Engineers 4th Edition, the supermarket rate (land use code 850, page 1237) is an average 8.82 trips per 1,000 square feet gross floor area, and the convenience market rate (land use code 851, page 1,242) is an average 71.12 trips per 1,000 square feet GFA, both for the peak hour of adjacent street traffic, one hour between 4:00 and 6:00 p.m. Doubling the first rate and taking one-fourth the second rate result in a composite rate of approximately 17.7 trips. Multiplying this by the former 6,578 square feet market size yields + 116 trips generated during the P.M. peak hour. Acknowledging that this is a "by -the -book" estimate, our considered judgement is that the actual trip rate, when the market was operating, was more likely in the range of 60 to 80 trips in the p.m. peak hour. The proposed service center, with two working bays, is expected to average + 30 vehicles per day and might service 40 on the busiest days. Atypical traffic�attern from Jiffy Lube's regional chain showed the _busier times to be from 10 00__.,a m_.to 5:00 p.m., with the 4:00 to 5:00 p.m. hour having 12%_of the day's volume. this reduces peak hour. Based on this relatively low turnover business, six trips are estimated for this facility during the p.m. peak hour. Combining the trips from both uses of the converted building totals an estimated 16 trips during the p.m. peak hour. It is concluded that a substantial reduction in site -generated trips will occur with change in use, and that the traffic impact will be to slightly lower the volumes on the adjacent streets. LIILGC 3F.aeDee locations On Saturday, March 5, 1988 from 8 a.m. to 6 p.m. The study made note of the number of vehicles parked on site in permanent parking spaces on an hourly basis. The study also made note of the number of vehicles stacked (qued) awaiting service at 15 minute intervals. The study was conducted in Portsmouth, NH at the New England Regional Headquarters by Daniel Duffy, president of SpeeDee oil Change & Tune -Up of New England. Data was collected via telephone from the Managers of the Somersworth and Concord locations on an hourly basis.
